1. Yes, the Department has implemented the Use of Official Languages Act, 2012 (Act No. 12 of 2012). The Department adopted its Official Language Policy before the deadline of 2 November 2014.

2. All 11 official languages have been adopted as official languages of the Department.

REPLY:

Chapter 4, clause 15.3 of the SMS Handbook guides the awarding of bonuses to SMS members while the DPSA Employee Performance Management and Development System Framework (for levels 12 and below) guides the awarding of bonuses to levels 12 and below. In terms of clause 9.5 of this framework, departments must not spend more than 1.5% of their remuneration budget for bonuses.

The information requested will be available in Annual Reports once these are tabled in Parliament.

(1). What is the status of the investigation into fraudulent and corrupt activities pertaining to the Windybrow Theatre in Johannesburg;

(2). whether the investigation has been finalised; if so, (a) What were the findings, (b) were criminal charges laid and (c) what disciplinary actions were taken? NW3521E

REPLY:

1. The forensic audit was concluded and the final report was issued in June 2014.

2. (a). The investigation was finalised, the findings include overpayments, irregular payments, unauthorised payments, Fruitless and Wasteful Expenditure as well as non-compliance with the local authority regulations.

(b). Yes, the criminal charges have been laid against the

former (Chief Executive Officer) CEO: Mr Vuyo Mphela and the former Chief Financial Officer (CFO): Mr Allie Achmat. The case is being investigated by the Serious Economic Offences Unit and Directorate for Priority Crime Investigation (HAWKS). Furthermore, a civil claim will also be instituted against the officials implicated and the companies cited in the forensic audit report.

(c). The two executive members (CEO and CFO) were dismissed in March 2014.

(1) What measures are being instituted to protect our national heritage artefacts;

(2) have our current measures been reviewed to test their effectiveness?" NW3520E

REPLY:

1. National heritage artefacts are kept in museums. These museums have security measures in place. Artefacts that are kept in storage are kept in strong-rooms, which are monitored by security cameras. Artefacts on display are kept in specially designed exhibition cases that are monitored by security cameras. Furthermore, museums employ security guards that are trained for the specific needs of a museum.

The Department is in the process of resurrecting a forum, consisting of the Department of Arts and Culture, the South African Police Service, the South African Revenue Service (Customs), the South African Heritage Resources Agency, Interpol-SA, the South African Museums Association and the South African Chapter of the International Council of Museums. The purpose of this forum is to serve as a platform for heritage and law enforcement officials to cooperate in terms of measures to fight against theft and illicit trafficking of heritage objects.

Additionally, national heritage artefacts are protected by Section 32 of the National Heritage Resources Act, 1999 (Act No. 25 of 1999). This legislation makes it illegal for any person to destroy, damage, disfigure, alter or export any heritage object without a permit by the South African Heritage Resources Agency.

Furthermore, South Africa is a Member State of the UNESCO Convention of the Means of Prohibiting and Preventing the Illicit Import, Export and Transfer of Ownership of Cultural Property (1970). This Convention provides for an international cooperation framework whereby state parties can assist each other in fighting against illicit trafficking of cultural property. The Convention guides state parties in terms of taking preventative measures such as having proper inventories and export certificates as well as to prohibit the import of cultural objects that have been stolen in another state party. The Convention also provides for measures of restitution when cultural property from one state party has entered the borders of another state party by illegal means.

South Africa is also in the final stage of the process of becoming a Member State of the 1995 UNIDROIT Convention on Stolen or Illegally Exported Cultural Objects. This Convention is complementary to the 1970 UNESCO Convention. The UNIDROIT Convention offers operational capacities of private law as claims of restitution are processed directly through national courts. The Convention also provides for compensation towards good faith holders or innocent purchasers of stolen cultural property.

(2) Current measures have not yet been reviewed.

REPLY:

1. Yes, my department is involved in attempts to trace, exhume and repatriate any remains of South African persons buried in Foreign countries. Currently the department has located the remains of Moses Kotane and John Beaver Marks at the Novodevichy cemetery in Moscow in the Russian Federation, and approval has been granted to my department, through the South African Mission in Moscow to exhume the mortal remains of Messer's Kotane and Marks from the Novodevichy cemetery, as well as approval to repatriate their mortal remains to South Africa. Preparations for the exhumation and repatriation of the mortal remains are at an advance stage.

2. No, my department is not involved in the efforts to repatriate the remains of Mbuyisa Makhubu back to South Africa. At the moment, no person is sure about the whereabouts of Mr. Makhubu or whether he is still alive or late.

3. No, my department was not involved in the erection of the statue of Mbuyisa Makhubu at Maponya Mall.

(a). I have established a task team to review operations at PanSALB, and preliminary findings revealed that the organisational structure of PanSALB is bloated and a main cost driver. As such, an organisational re-design informed by a revised mandate of the institution is necessary to cut down costs and avail funds for the core programmes of the institution. The task team is expected to present its recommendations and a turnaround strategy to me before end of November 2014.

(b). The mandate of the aforementioned task team is to look holistically at all the factors that may have contributed to the dysfunctional state of the institution (PanSALB), including the findings of the Auditor-General. As such, the expected turnaround strategy will seek to also address issues that led to the disclaimer findings of the Auditor-General.

The department has also sought technical assistance from National Treasury to conduct forensic audit at PanSALB.

Northern Cape

There is an existing Provincial Heritage Resources Authority (PHRA) in the Northern Cape with a functional Council. However, the PHRA is not represented in the South African Heritage Resources Agency (SAHRA) Council.

Limpopo

There is no PHRA established, however, there is a representative as per SAHRA regulations appointed by the Minister to serve on the SAHRA Council. The representative reports to the MEC. The SAHRA had several engagements with the then MEC of Limpopo to ensure that a functional PHRA is established. SAHRA will continue to engage with the new MEC in that regard.

Why do the (i) Western Cape and the (ii) Northern Cape not have any representation in the SA Heritage Resources Agency (SAHRA) council and (b) what steps has his department taken to ensure that these provinces are duly represented in the SAHRA?

REPLY:

In April 2013, the Department wrote letters to the Members of Executive Council (MECs) for all the Provinces requesting them of initiating the process of appointing individuals to serve in the SAHRA Council. Subsequently, the department received names of the nominated persons from seven Provinces with the exception of the Western Cape and the Northern Cape.

In September 2013, letters were sent to the two Provinces requesting the two MEC's again to send their nominated provincial representatives to serve in the Council.

My department will continue to communicate with the two provinces to ensure that they are represented as prescribed in the National Heritage Resources Act.

REPLY:

Since assuming this responsibility, I have realised amongst other things that the department has no shareholder representation to all the councils or institutions reporting to the department. The shareholder compact has not been updated over many years.

The Presidency has recently released the Medium Term Strategic Framework (MTSF). I will identify the areas that speak to Arts and Culture and update the Annual Performance Plans (APP).

The APP's will cascade down to various entities that report to me. The shareholder compact to be developed with entities and will reflect the elements of APP's relevant to the entity.

I am in the process of finalising these shareholder compacts, amongst other they will reflect cost cutting measures as part of their targets.

(1). No. The Department made use of a private law firm who had helped in drafting the language legislation. This is so because that law firm was well versed with the issues concerning languages rights and had the necessary knowledge and skills to carry out the task at hand.

(2)(a). The Department appointed Cheadle Thompson and Haysom Inc, because

that law firm had drafted the language legislation and was well versed with the issues concerning languages rights.

(b). The law firm represented the Department in four matters.

(c). The total legal costs paid out from 1 March 2013 to date is the sum of R828 143.00.

(a). Nothing officially was reported to me, however, a workshop was undertaken by the Council and Executives in August 2014 to reflect on the governance issues which have impacted negatively on the entity. The workshop was also aimed at improving relations between the Council and Executives. These workshops will be cascaded down to all levels to ensure improved cooperation and transparency.

The entity has in place governance structures such as the Council meetings, Executive committee meetings and staff meeting which are used to communicate important decisions and concerns.

(b. Yes, there is a concerted effort from management to improve working relations with staff at all levels. The entity has established management meetings and staff communication forums to share information. Focussed meetings are held with the Unions to discuss and resolve staff concerns.

(c). Yes, the applications by property developers are processed on time, except for those that are complex and required further research and consultation.

(d). Yes, statutory obligations are fully met by the entity

(e). Yes, heritage resources are taken care of optimally, except for

some properties which are in the process of being rehabilitated and leased contracts that are being renewed to enable fair rental collections

1. The provision of national flags to the schools is part of a bigger campaign to popularize National Symbols and to complement the school curriculum. National symbols are highlighted through the curriculum, and they are covered in learning outcomes such as Social Science and Life Orientation, to mention but a few.

Flag in Every School project is part of Outcome 14: to transform society & uniting the country. This project does not only focus on the hoisting of the flag but complements other school based initiatives such as the, recital of the preamble to Constitution and the Bill of Rights. The hoisting of the national flag is the expression of national identity and unity in the school community.

Furthermore, schools are scattered all over the country with some found in the most remote parts, where there is no other public building with a national flags such as a police station. In this case, the school with the national flag becomes the community's source of national identity and pride, and fosters a sense of belonging.

2. The hoisting of the national flag, recital of the preamble to Constitution and the Bill of Rights is an expression of national identity and unity. My department working together with the Department of Basic Education will monitor and evaluate the project in order to ensure that all schools supplied with national flag becomes the community's source of national identity and pride, and fosters a sense of belonging.

As I have indicated in the reply to question 1254, is to mobilise society to appreciate their national symbols.

Outcome 14 of the Medium Term Strategic framework enjoins us to mobilise society around these issues.

The number of schools that we have covered so far is nine thousand five hundred and thirty (9530). The programme has picked up the pace, now with each province having two service providers.

This is amongst the means that the government is using in promoting national symbols and mobilise the South Africans to know who they are and the things that define them.

154 jobs were created by the project over the same period.

My Department and Pan South African Language Board have a number of legal matters with regard to person whose name and details were furnished.

(a) To date, no quantified costs have been awarded in favour of the Department of Arts and Culture and/or PanSALB.

(b) To date no funds have been recovered as the costs have not yet been determined.

(i) As per standard processes, costs must be taxed and such the amounts will be determined by the Taxing Master of the relevant High Court.

(ii) For 2010 and 2012 cases, the State Attorneys have been instructed to act on behalf of the Department and PanSALB in this process.

With reference to the promulgation of the Use of Official Languages Act, (Act 12 of 2012), which his department is the custodian, which aims to provide for the regulation and monitoring of the use of official languages by the national government and requiring national departments, national public entities and national public enterprises to adopt language policies, (a) what steps will his department take to implement the legislation and, (b) how will his department ensure that national departments' use of official languages is regulated to the extent that all official languages are utilised equitably? REPLY

(a). Sections 4 and 7 of the Act, and the Regulations in terms of the Act set out the requirements and guidelines for drafting language policies and establishing language units.

To date my department has convened a National Language Forum on 07 February 2013 to introduce all relevant stakeholders to the Act, taking them through the Act and its draft regulations.

Furthermore, a technical workshop was convened where stakeholders were given the opportunity to seek clarity on issues before finalising their policies. A second National Language Forum was convened on 26 -27 June 2014, giving stakeholders an opportunity to report progress on the drafting of their language policies. To ensure that the implementation of the Act remains top of mind, on 14 August 2014 a notice was sent out to reminding government departments about the deadline for adopting their policies.

My department will now publish a notice in three national newspapers reminding all accounting officers of the deadline and requesting them to submit progress reports on the development of language policies and establishment of their own language units to me by not later than 30th September 2014.

The department has also adopted its own Language policy in order to provide leadership and be exemplary to other departments.

(b) Section 9 of the Act stipulates that each national department, national public entity and national public enterprise is required to submit a report to me and Pan South African Language Board (PanSALB) annually on activities of their language unit, implementation of language policy and any complaints received regarding its use of official languages and the manner in which these complaints were dealt with. The department will prescribe the form and content of the reports to be submitted and timeframes for submitting such reports to monitor the equal use of official languages by all national departments, national public entities and national public enterprises.

(a). All the national days are attended optimally thus far. However, we are continually working with all the stakeholders in the society to improve a diverse representation in these events. Furthermore, when we launch each national day we call upon the society as a collective to participate in the realisation of the meaning of such a national day as we understand that nation building and social cohesion is a continuous process. Heritage Day is a one such national day that calls for all South Africans to celebrate their cultural identity as enshrined in the constitution.

(b). Commemorations are a one day event, and contribute to creating short term jobs. In cases where these events are happening to where there are institutions of higher learning that provide events management courses, these events create a platform for future investment to young people that are studying events management. During the 2014 Freedom Day Celebrations 10 leaners from the Tshwane University of Technology were part of the skills transfer programme that gave practical experience to these students.

(c)(i). Social Cohesion dialogues are organised prior to hosting a national day in order for the society to engage on the theme and meaning of such a particular commemorative day and finding lessons from such a dialogue that will move South Africa forward.

(ii). The commemoration days are hosted in all the 9 provinces on a rotational bases. The only national day that does not rotate is the Freedom Day Celebration that takes place at the Union Buildings in Pretoria, Gauteng Province.

(iii). Young people accounts to over 60 per cent of attendance in these national days. What is critical is for young people to understand the value and meaning attached to these national commemorative days.

(b). The post was once again advertised with a closing date of 22 August 2014, and the department is busy with the selection process.

2 (a). This is a rare skill in the country and as such the National Archivist has not been appointed as yet, the post has been advertised.

(b). The Department is now busy with the selection process.

In the initial advert that closed on the 22 August, 2014, no responses were received. In the light of that we extended the closing date to the 19th September 2014. It has come to my attention that industrial action by postal service workers might have an impact in us receiving applications.

It is the Eastern Cape Provincial Heritage Resources Authority (ECPHRA) that can take action upon receiving complaints.

(2). In the final analysis, the owner is accountable for the maintenance of the integrity of the sites. In terms of the Act, pending the due processes as mentioned above being followed by ECPHRA.

(1)(a)(i) The exact number of museums is difficult to establish as there are many museums that are constantly established and many that closes without the knowledge of the Department of Arts and Culture. This situation is compounded by the fact that museums do not have to be registered with any organisation/agency. Many museums (especially private museums) are established in small towns without the museum being a member of the South African Museums Association (the official museums organisation).

(1)(a)(ii) The Department of Arts and Culture funds a total of 38 museums. These include 14 museums under the banner of Iziko; 8 under the banner of Ditsong; and 6 under the banner of the National Museum.

(1)(b)(i) There are no particular criteria for museums to qualify or (ii) to not qualify for national funding. The museums that do receive funding have been declared as Declared Cultural Institutions in terms of the Cultural Institutions Act, 1998 (Act No 119 of 1998).

This is a situation that the Department is attempting to correct by the development of the National Museums Policy. The Policy specifies that criteria in this regard should be developed.

1. (a)(b) My predecessor wrote to Ministers of other government departments, heads of public entities and institutions, notifying them of their obligations in terms of the Act. The technical; workshop was hosted by this department and attended by delegates from government departments, public entities and institutions outlined the legislative framework, as well as responsibilities as prescribed by the Act.

(b)(i). The notice was sent/dispatched on 16/08/2013 and the delegates attended the technical workshop on 4 September 2013.

(b)(ii). The notice informed them of their obligations in terms of the Act, and requested them to delegate Communications, Language Practitioners and Legal representatives to attend a technical workshop to be hosted by my department.

2. The Regulations of the Use of Official Languages Act, (Act No. 12 of 2012), gazetted in February 2014, provides guidelines on the drafting of language policy in terms of the Act.

3. (a). The Pension Fund Adjudicator is the only public entity that has applied for exemption from establishing an official Language policy.

The department will ensure that calls for proposals are advertised, awarded and concluded early for the following financial year. This process will enable the department to correctly allocate funds to avoid virements and ensuring that spending commences from the start of the financial year.

The National Archives unit held a number of Public Programs in order to raise awareness about archival services, functions and available career options, stressing on the importance of preserving societal memory.

  • Annual Archives week was held on 8-12 May 2012 with the theme "Archives for the Past Present and Future". Learners from around Gauteng giving presentations on archival services and possible careers in archives and records management. Film screenings were conducted on 12 May 2012.
  • Public programme at Baviaansport Correctional Facility on 18-19 June 2012. Presentations about archival services and functions, career options and screening of films were given.
  • The Friends of the Archives workshop was held in February 2013, with the Theme "Know your Archives". Genealogical Researchers as well as records managers from different departments and civil society participated in the workshop.
  • Taught Mangaung learners Oral History Methodology and on the importance of Oral History in closing the gaps in archival records
  • Annual Oral History Conference was held in Thaba Nchu on 9-12 October 2012 with the Theme " Oral History, Communities and the Liberation Struggle: Reflective Memories in Post-Apartheid South Africa"
  • (ii) The Library Service unit of my Department participated and supported the South African Library Week (SALW) celebrations that were held in 2013 from 16 to 23 March. This is one of the flagship programmes in the library and information services sector celebrated annually in March. The same theme is celebrated by all the libraries nationally. The theme of the celebrations in 2013: Educate yourself @ your library wasdriven byLIASA (Library and Information Association of South Africa). The South African Library Week (SALW) is an important initiative used to raise awareness of the crucial role played by the library and information services throughout South Africa in improving literacy, inculcating a culture of reading, socio-economic development, the educational development of our citizens, and in nation-building throughout South Africa.

    As the jHonourable Member might be aware that Members of the Executive, by the very nature of their ministerial work are required to travel. Ministers and Deputy Ministers may choose to occupy a state-owned residence in the area, in which their seat of office resides. However, ministerial work is not limited to seats of office and their duties require them to visit provinces around the country and travel abroad in order to fulfill their duties, which include among others, interaction with communities and stakeholders in the course of delivering on their mandates. In these instances, Ministers and Deputy Ministers are accommodated in hotels or guest houses, when fulfilling official duty away from their ordinary place of residence, befitting their office requirements and as outlined in the relevant policies. Equally the departmental officials on an annual basis submit their Annual Performance Plans to their respective Portfolio Committee. Some of these plans require the officials to travel to effect the relevant actions.

    The 2013/14 financial year for which the information is required, has just been audited. It will be presented to Parliament and published for the general public. The honourable members will be able to obtain this information through the progress reported to be presented by the relevant officials against their preapproved operational plans.

    It also important to highlight that the department has approved service providers and guidelines for the procurement of accommodation. These were further adjusted to align them with National Treasury guidelines that were issued in November/December.

    QUESTION 1 (a) & (b) : Irregular, Fruitless and Wastefull Expenditure

    Whether any disciplinary action has taken place against officials for irregular and fruitless expenditure as recommended by the Auditor General in respect of the 2011-12 and 2012-13 Financial Years

    The irregular and fruitless expenditure incurred by the department for the past financial year were investigated by the Special Investigation Unit (SIU). The outcome of the investigations recommended that the department take disciplinary action against the officials who were implicated with financial misconduct. Since the officials were no longer working for the department, disciplinary action against them were not taken.

    Accounting Officer reviewed cases of irregular and fruitless expenditure and discovered that most of the cases were due to misclassification of expenditure where prior approvals were not obtained from National Treasury for spending earmarked funds. The Department reported these cases and requested the National Treasury to condone the irregular expenditure.

    Some of the irregular expenditure were due to misinterpretation of the Treasury Regulations 16A6.4 which states that if in a specific case it is impractical to invite competitive bids, the accounting officer or accounting authority may procure the required goods and services by other means, provided that the reasons for deviating from inviting competitive bids must be recorded and approved by the accounting officer or accounting authority.

    The Accounting Officer subsequently approved the deviations from competitive bidding processes following the Treasury Regulations 16A6.4 stated above. The irregular expenditure cases became a subjective matter because the Auditor General argued that such cases were not impractical to invite competitive bids and had to be reported as irregular expenditure.

    Since the irregular expenditure cases were due to misclassification, a decision to take disciplinary action has not been taken.

    The department has developed a policy on irregular, fruitless and wastefull expenditure. There were workshops that were held during the year to train officials on preventing the irregular and fruitless expenditure. Furthermore, there was an establishment of the Investigation Task Team that was tasked to interrogate the irregular and fruitless expenditure cases and recommend to the Accounting Officer steps to be taken against officials that are implicated with such the irregular and fruitless expenditure cases.

    (b)

    Who will monitor his department's progress in this regards?

    Since the establishment of the Investigation Task Team on the 02nd January 2014, the Accounting Officer and the Acting Chief Financial Officer monitors the irregular expenditure internally. The Department further engage the Auditor General and Internal Auditors to perform independent review to ensure that irregular expenditure does not reoccur by dealing with the root causes.

    1 Whether he will provide an update on the work his Department has done in terms of section 9(1), 9(3) and 42 of the National Heritage Resources Act, Act 25 of 1999, to preserve the unique heritage sites of (a) Hout Bay in the Western Cape in General and (b)(i) East Fort, (ii) West Fort and (iii) Apostle Battery in particular since 1 November 2010; if not, why not; if so, what are the relevant details;

    2 Whether he would consider establishing a heritage agreement in terms of section 42 of the specified Act with the Hout Bay and Llandudno Heritage Trust; if not, why not; if so, what are the relevant details?

    REPLY:

    The said sites fall within Grade 1 Sites as defined by Provincial Heritage Resources Agency (PHRA) Western Cape, the arrangement relating to the management thereof is that the South African Heritage Resources Agency (SAHRA) makes comments while the PHRA gives permission. In this regard the declaration of these heritage sites is tied in with that of Table Mountain as a National Heritage site. SAHRA has been in discussion with the service provider responsible for the drafting of the Integrated Conservation Management Plan (ICMP) as well as SANParks, however, the challenge is that the ICMP has not been given the final approval relating to the use, management and value of these sites. As soon as such an approval is granted I will provide an update My department is not considering establishing heritage agreement in terms of the specified Act with Hout Bay and Llandudno Heritage Trust. The said heritage resources are all captured under Grade 1 designation, and in this regard an memorandum of understanding (MoU) exist between Heritage Western Cape (HWC) and SAHRA, and only in case of a specific request can an agreement be established between HWC and SAHRA.

    (a). On assuming office I picked up the issue regading Enyokeni Palace at Nongoma as raised by the member. As result I have instituted an investigation about the project and other similar projects as well. I will appraise the member once the investigation is completed.
