The Department has done a participatory research on challenges faced by women in rural areas, including the impact of policies, laws and programmes in their lives. The department has also conducted monitoring of women led businesses and cooperatives and convened various consultations and workshops with women in rural areas to understand their areas of needs relating to access to land, infrastructure such as water and resources.

With regard to recommendation 11.3 of the SA Human Rights Commission report of 15 October 2013 on the Child Protection Register (CPR), what steps has her department taken to increase the monitoring of the implementation of the CPR?

REPLY:

The Child Protection Register as per the Children's Act, includes a Part A and Part B - Part A of the register includes the function of capturing information about children who enters into the child protection system as a result of reported abuse or neglect and the progress made on the management of the specific case; while Part B is intended to be a record of persons who are unsuitable to work with children. If the court makes a finding that the person is unsuitable to work within environments where there are children the person's name will be placed on the register.

The matter of the Child protection register and the challenges of implementation was indeed an issue that was raised during our consultations with departments and provinces during 2011 and 2012. We reported on the matter in the recently approved UNCRC and AU reports.

The DWCPD participate actively in the National Child Protection Forum and the Review of the Children's Act. These are platforms where these matters are addressed collectively in a constructive and progressive manner by all those who are serious about finding solutions to the challenges that face the country and its children.

In addition, The DWCPD participated and responded to the Human Rights Commission's report on the Child Protection Register. We are therefore aware of the challenges experienced by the Departments responsible.

We have noted the recommendations made to the relevant departments by SAHRC. The response to these recommendations and implementation thereof lies with the departments concerned.

The Department's advocacy and monitoring role is informed by the understanding that the country has international treaty, national constitutional and legislative obligations to ensure the protection of children.

The DWCPD upholds the position that the current resource constraints including human resources, technical and institutional capability continues to hamper the full implementation of the Child Protection Register.

The Departments of Social Development, Justice and Constitutional Development and the South African Police Service should receive the full support needed from both government and civil society to review, capacitate and operate an efficient and effective Child Protective Service System – this goes beyond the implementation of the CPR. This is pertinently clear in light of the very serious crimes committed against children.

The DWCPD remains committed to promote, coordinate and monitor the realization of the rights of children.

Whether her department intends to embark on awareness campaigns to educate women about the pros and cons of polygamous marriages; if not, why not; if so, what are the relevant details?

South Africa is a diverse and multi -cultural society as articulated in chapter 2, section 9 of the Constitution, that the state may not discriminate on the basis of culture, religion amongst others. Polygamy is not a crime in this country and therefore the Minister cannot prevent an adult woman of sound mind who makes a conscious decision and choice for such a marriage. The Recognition of Customary Marriages Act, 1998 recognises that in some cultures and religions, polygamy is practiced. Parliament thus gave recognition and rights to women in polygamous marriages and to their children through this act of parliament, e.g. they have the right to inherit from their husband or father's estate.

This is different from the abhorrent practice of forced marriages or ukuthwala wherein in the most recent case in court, the perpetrator has been jailed for 22 years because that crime was committed against the young woman's will and amounted to abduction and statutory rape. It also means that the girl was denied the right to education and to choose the future she wants.

Individual South Africans have a right to express their views on polygamy but that does not make it illegal.

I have on many occasions spoken out against forced marriages and I have visited hotspots with my counterparts at national, provincial and local government in places like Lusikisiki, Mbizana, etc where we addressed communities and traditional leaders, as well as law enforcement officers. This is an ongoing programme that the department will always speak out against and the National Council Against Gender Based Violence has been established to deal with similar societal challenges, particularly gender-based violence.
