Whether, with regard to the Nuclear Framework Agreements signed with different countries for the procurement of 9 600 MW nuclear generating capacity, she will provide a timeline detailing the exact date when (a) each framework agreement will be made public, (b) the tender process for the nuclear build programme will start, and (c) she will discuss the nuclear build programme tender process in Parliament? Reply:

(a) The Agreements will be submitted to the Cabinet for consideration and thereafter be tabled in Parliament for deliberation by both houses of Parliament. The submission to Cabinet will be made after the Nuclear Framework Agreements have considered by Energy Security Cabinet Subcommittee at an appropriate time.

(b) The decision on the type of nuclear procurement will be approved by Cabinet. This decision has not been made yet. Therefore the exact date to start nuclear new build programme procurement will be announced after Cabinet approval of the nuclear procurement.

(c) The nuclear procurement process, strategies and plan will be submitted to Cabinet for approval and thereafter be tabled in Parliament for deliberation by both houses of Parliament at an appropriate time.

a) The ISMO Bill was submitted and deliberated over by the previous Parliament. Several concerns were raised regarding the impact on Eskom and the Bill never served before the National Assembly.

b) The ISMO Bill is currently being considered and after further stakeholder consultation a discussion will be made.

(3) The Department of Energy is still negotiating agreements with other countries in preparation for procurement process. The release of the Agreement for South Africa with Russia would jeopardise or compromise the delicate process of negotiations which is still on going with other countries pertaining to the nuclear new build programme.

The Department of Energy does not have municipal accounts registered under its name with any municipality in Gauteng Province. A lease agreement was signed with Department of Public Works to lease office accommodation in National Office: Pretoria. In terms of the lease agreement the accounts for municipal services are paid directly to the Municipality by Department of Public Works and thereafter claimed as a direct charge from Department of Energy.

(1) Whether, with respect to nuclear energy power, the Government has taken a decision that South Africa will build up to 9.6 gigawatt of nuclear power; if so, what are the relevant details;

(2) whether a decision has been taken to review and change the South African nuclear policy of 2008; if so, what are the relevant details;

Reply:

(1) Government took a decision that South Africa will build the 9.6GW of nuclear power when Cabinet approved the Integrated Resource Plan 2010-2030 in March 2011. The Department of Energy is therefore implementing this Cabinet decision to prepare for the rollout of the nuclear new build programme.

(3) The Cabinet approved IRP2010-2030 was consulted extensively with relevant Government Departments including National Treasury. As part of implementing the IRP2010-2030, the Department of Energy is part of the Energy Security Cabinet Committee. National Treasury is part of this committee.

Yes, Eskom continues to receive power from the Cahora Bassa Apollo HVDC scheme.

a) The average power delivered during the financial period to date i.e. April to October 2014 was 1250MW, whereas the average for the month of October 2014 was 1470 MW.

b) Both poles are in full operation.

c) Reliance is placed on both poles

(1) With regard to her department meeting with nuclear scientists at the end of October 2014 in the Drakensberg, (a) what was discussed at this meeting and (b) why was the meeting not held in public;

(2) whether her department paid for the meeting; if so, (a) what was the cost of this meeting and (b) has there been any further agreement with Rosatom;

(3) will other countries that have submitted bids be given the same opportunities, such as this unpublicised conference, to make their proposals to the department? NW2942E

Reply:

1 (a) nuclear vendor technology offerings to demonstrate how they propose meet South Africa's needs

(b) The meeting was not held in public in order not compromise the vendor confidential information. It should be indicated that during the vendor parade workshop, delegates of the Russian Federation openly shared information without restriction, and it remains the responsibility of the Department to ensure that such confidential information that form part of their intellectual property is not compromised by being release to the general public.

2 (a) The Department paid for the meeting. The cost of this meeting will be included in the annual financial report for the Department

3. There is no bidding process underway. Therefore no country has submitted the bids. The Department is preparing for the procurement phase. In its media statement of the 23rd October 2014, the Department indicated that vendor parade workshops will be held with other vendor countries that South Africa has Inter-Governmental Framework Agreements with, such as France, China, United States of America, South Korea and Japan, pending their confirmation of readiness to participate.

(a) Will the workshops with the nuclear vendor countries that were announced by her department on 18 October 2014, also be open to Members of Parliament to attend and (b) will the documents presented in these workshops be submitted to the Portfolio Committee on Energy to scrutinise; if not, why not in each case? Reply:

(a) No. The workshops with vendor countries will not be open to members of Parliament to attend. The vendor parade workshops will only be open to invited Government officials and nuclear experts, State Owned Entities nuclear experts and Academia experts. These experts will produce government reports for the vendor parade workshops.

(b) No. The documents presented at these workshops will not be submitted to the Portfolio Committee on Energy to scrutinize. These documents will be treated confidentially to protect the vendor proprietary information that will be shared with Department in these workshops.

With regard to the Integrated Resource Plan (IRP) update which explicitly states that the nuclear procurement programme must be abandoned if the installed price is more than U$6500 per kilowatt, (a) will the Government be sticking to this recommendation and (b) has the Government also set a threshold price per kilowatt hour if the decision is taken to favour a Build Own Operate model of procurement; if so, what is that threshold price per kilowatt hour? REPLY

(a) No. The Department of Energy is implementing the nuclear new build programme in line with the Cabinet approved Integrated Resource Plan 2010-2030, that has stipulated that 9.6GW nuclear power will form part of energy mix. The final installed price per kilowatt will be negotiated during the nuclear procurement process.

The Integrated Resource Plan (IRP) update has not been approved by Cabinet. Therefore Government will not abandon the nuclear new build programme based on recommendations of this draft document.

(b) No. The nuclear procurement process has not started. No decision has been taken in favor of the model for procurement.

a) Once the consultation process has been completed with the various government departments, the IRP will be taken through the necessary approval process before being published.

b) The interdepartmental consultation process, including considerations regarding air quality regulations, greenhouse gas limits, demand projections, updated costs and alignment with the Integrated Energy Plan, have led to the delay. Notwithstanding this, the IRP update will form part of the Energy Master Plan that integrates all the other sector plans including Energy Efficiency Action Plan, Gas Utilization Master Plan and the Liquid Fuels Roadmap.

a) It is expected that the final procurement documents will be released to the market by the first quarter of 2015.

b) The consultation process took longer than anticipated, in order to align with the Biofuels Mandatory Blending Framework, which targets the same sectors. We are currently in the process of finalizing the consultation process with stakeholders such as NERSA, Eskom, Departments of Water and Sanitation, Environmental Affairs, who are expected to play a vital role in the process.

How is aviation fuel regulated in terms of (a) transportation, (b) price, (c) stockpiling and (d) the sale? NW2339E

Reply:

(a) The transportation of aviation fuel via pipelines is regulated in terms of the Petroleum Pipelines Act, 2003 (Act No. 60 of 2003). Road transportation is handled in terms of various prescripts governing the transportation of dangerous goods.

(b) The price of aviation fuel is not regulated.

(c) The major airport operators are responsible for ensuring adequate stockpiles are kept by the suppliers within the precinct of the airports under their respective jurisdiction. The Department of Energy monitors the stockpiles at major airports.

(d) The sale of aviation fuel is regulated in terms of the Petroleum Products Act, 1977 (Act No. 120 of 1977) as amended; the Regulations regarding Petroleum Products Wholesale Licenses, 2006 and Regulations regarding Petroleum Manufacturing Licenses, 2006.

Reply:

(a) The Department of Energy is planning to rollout the nuclear build programme through the development of strategies to address all aspects of the nuclear value chain. The nuclear power build programme is aligned to achieve the targets of the cabinet as endorsed by the Integrated Resource Plan 2010-2030, that is ensure 9.6GWe of nuclear power into the generation mix. In line with IRP, the first plant will be commissioned by 2023/2024 and last plant commissioned by 2030.

(b) The Financing strategy that deals with various financing options is currently at an advanced stage of development by the Department of Energy, in conjunction with several other key Departments such as National Treasury, and Department of Public Enterprises.

(c) The country has sufficient human resources to deal with existing programme. However, the Department of Energy working with other Departments such Trade and Industry and Science and Technology, Department of Public Enterprises has developed a National skills development strategy that is at an advanced stage in order to address any potential future lack of human resources for the nuclear programme.

(2). Transfer of nuclear technology in South Africa is administered and controlled in terms of the national and international obligations (Nuclear Energy Act, Non-Proliferation Treaty, Pelindaba Treaty). To transfer the Technology an application is lodged with the Department of Energy and it is evaluated in accordance with the Legislation and International Obligations.

(a)There are currently 59 vacant posts in the Department of which

(i) 20 are highly skilled,

(ii) 27 highly skilled supervision and 9 are Senior and top management (SMS)

(b) the duration in each case is:-

(i) an average of 3 months on highly skilled positions,

(ii) 4 months on highly skilled supervision (with the exception of 4 Deputy Director posts that are still having grievances).

The technologies under IRP2010 include coal, gas, nuclear, imported hydro, renewables and energy efficiency interventions. 1. For both (a) Milnerton and (b) Saldanha, the Strategic Fuel Fund (SFF) is bound contractually not to disclose the identity of the lessee/s to a third party, without the consent of that lessee. At the time of submission of the answers to these questions, SFF had not obtained the required concurrence from the contractual counter-parties.

2. Not all the storage tanks have products.

(a) The utilization of the tanks depends on crude oil market conditions. The market conditions have not been favourable for storage of crude oil.

REPLY :

1. Yes, there were tenders issued by Eskom for installation of low-pressure solar water heaters in Musina, Polokwane and Buffalo City Municipalities (on behalf of the Department) as well as in Soweto. However, these tenders were not awarded and Eskom cancelled the process.

In August 2013, the department issued a request for registration and information to test the market and confirm if there were complaint systems in regard to 70% local content as outlined in the SWH instruction note issued under the Preferential Procurement Policy Framework Act.

2. Accumulative 395,088 SWH units (inclusive of low and high pressure) installed by the end of December 2013 with 53,000 SWH units installed in 2013 calendar year.

3. a. There are 480,000 low pressure SWH units to be installed by 31 March 2016;

b. The Department concluded the new contracting model in October 2013. The revised contracting model will allow Eskom to do mass procurement for all participating municipalities. However, prior to the said procurement, the SABS will have to verify the local content threshold capacity of all manufactures as outlined in the instruction note.

4. The DoE appointed the SABS to carry out the local content measurement and verification process, which is scheduled to begin on 1st March 2014.

1) Since 2008, electricity consumption has decreased. Table 1 below sets out the electricity consumption in Gigawatt hours (Gwh) per annum and the percentage growth for the period 2008 to 2013 based on Eskom's financial year ending 31 March of each year. In addition it should be noted that demand is seasonal in that there is higher demand during winter season than the summer season, and demand tends to drop during holidays, such as the Easter Holidays.

Reply:

PetroSA is registered as a mine and therefore has to comply with the requirements of the Mine Health and Safety Act (MHSA) in terms of noise.

a) Since noise exposure is identified as a significant risk at the mine, a mandatory Code of Practice (COP) for an occupational health programme for noise was submitted to and accepted by the Department of Mineral Resources (DMR).

The noise levels at the GTL Refinery exceeds 82 dB Aeq,8hr (action level) and PetroSA therefore has an occupational hygiene monitoring programme for noise. This programme is managed by a Certified Occupational Hygienist and includes noise zoning, personal exposure monitoring and submission of mandatory reports to the DMR (required by regulation 9.2 of the MHSA).

b) Recent noise zoning and personal exposure sampling reports indicate noise levels between 82 and 98 dB (A). Very high noise levels that exceeds 110 dB (A) may result during upset conditions at steam release vents on the plant. During these conditions access control is enforced where possible and the use of Variphone (Hearing Protection Device (HPD)) is mandatory.

In order to control exposure of the workforce, PetroSA implements a hearing conservation standard that requires management to take reasonable practicable measures to control the noise by eliminating sources, segregating noise sources with less noisy ones and implementing engineering and administrative controls. Since it is not always possible to control noise to below the Occupational Exposure Limit (OEL) of 85 dB (A), no person is allowed to work in the demarcated noise zones without HPD's.

c) All employees exposed over the OEL are required to undergo audiometric testing on an annual basis to timeously identify workers with a reduction in hearing acuity. These incidents are reported by the on-site Occupational Health Practitioner and investigated to identify the root cause and to take appropriate remedial action when and where required.

It can be concluded that PetroSA is adhering to legal requirements and that all reasonable measures have been taken to protect the workforce from Noise-Induced Hearing Loss (NIHL) due to noise exposure.

Reply:

(1) Yes, NERSA is still investigating the Negotiated Pricing agreement between BHP Billiton and Eskom as requested by Eskom. The investigation is almost complete and the report is in the process of being compiled. The initial report will go through all the NERSA internal processes by the end of May 2014.

(2) The investigation has not been suspended nor cancelled.

ENERGY EFFICIENCY

In 2005, the Government approved the National Energy Efficiency Strategy which sets sectoral targets for energy efficiency to be achieved by 2015. The government and various sectors of the South African Economy have been engaged in several initiatives , in an effort to implement clean energy initiatives including the installation of energy efficient technologies including lighting , solar water heating , space heating , mechanical and electrical equipment and launching energy efficiency campaigns. The advertisements developed are aimed at communicating and promoting the Energy Efficiency and encouraging members of the public to use energy efficiency in order to save energy.

Access to electricity remains one of government's key priority areas. Electricity assists in economic growth and access to job opportunities and the alleviation of poverty. Infrastructure development is not possible without electricity. Since 1994 government has provided access to electricity to over 5.8 million homes that had no electricity before. Government's plan is to strive towards improving electricity access by 2025 through the upgrading ad strengthening of the electricity network infrastructure in the country. The primary purpose is to demystify Nuclear and to promote careers in nuclear as part of the Nuclear awareness programme. It is also aimed at ensuring that nuclear expansion programme is understood by all citizens and reflect that nuclear energy is safe, sustainable and reliable and is environmentally friendly technology that is an important part of South Africa's energy mix.

RENEWABLE ENERGY

The Renewable Energy White Paper was approved in 2003 aimed at creating conditions for the development and commercial implementation of renewable technologies. It also aims to diversify energy supply by developing advanced, cleaner more efficient affordable and cost effective energy technologies. Our adverts and public engagements are aimed at communication this strategy and providing an effective awareness campaign to ensure behavioral changes in energy use which will inevitably lead to the creation of an overall understanding of the critical importance of implementing a diverse energy mix for all citizens.
