2080. Mr M Waters (DA) to ask the Minister of Police:

(1) (a) On what date was the new Tembisa police station in Gauteng supposed to open, (b) what are the reasons for the delay and (c) on what date is the station now scheduled to open;

(2) what (a) amount was originally tendered for the construction of the station and (b) is the current construction cost of the station?

REPLY:

(1)(a)No date has yet been set as the construction work has not been completed. The official opening of any police station is only arranged after the building construction has been completed and an occupancy certificate has been issued by the local municipality's building control office. Arrangements are then made for an official opening with the Minister of Police, the National Commissioner of the SAPS as well as the relevant Provincial Commissioner of the SAPS.

(1)(b) The original scope of work was completed on 15 November 2012, in line with the completion date of the building contract. However, the Ekurhuleni Metro Council required the following additional statutory requirements to be met:

- The appointment of a certified rational fire designer and the submission and approval of a rational fire design.

- The preparation, submission and approval of a storm water management plan.

This resulted in additional construction requirements which first had to be met in order to obtain an occupancy certificate. Once the additional requirements became visible a variation order application was submitted in order to address the requirements from the local municipality. This application was approved by the SAPS Bid Adjudication Committee on 5 August 2013 and is currently at the office of the National Commissioner of the SAPS for ratification.

(1)(c) As stated above in (1)(a) the official opening will only be when all the requirements have been met. However, the appointed building contractor indicated that he will need 150 working days to complete the additional required construction work. This period will only commence once the application has been ratified by the National Commissioner and an instruction to continue construction has been issued to the contractor.

(2)(a) The original construction cost was R 61 126 535.86.

(2)(b)The revised construction cost as applied for in the variation order application is R 68 053 714.50

The blood sample analysis is a competency located within Forensic Laboratories managed by the Department of Health. The Forensic Science Laboratories in the South African Police Service is not housing the database containing requested information, thus the question must be directed to the Minister of Health.

(1) Whether he has (a) agreed with and (b) implemented all findings and recommendations by the SA Human Rights Commission (SAHRC) relating to the SA Police Service; if not, why not;

(2) whether he has ever appealed against the findings or recommendations of the SAHRC in court; if so, (a) on how many occasions and (b) what were the (i) results and (ii) costs relating to these appeals?

REPLY:

(1) Findings and recommendations were received from the SAHRC in two matters namely C Maxwele and Tatane. A meeting has been requested with the Chairperson of the SAHRC to discuss the findings and recommendations on both matters and implementation thereof. A report has also been submitted to the SAHRC on Tatane. It should also be noted that a report from My office has been submitted through the Civilian Secretariat for Police on certain recommendations made in the Tatane case.

(2) The findings and/or recommendations on Maxwele were taken on review. The matter was argued on 12 June 2013 and a point in limine(i.e. apoint in law / technical point) was raised by the SAHRC on whether the appeal lodged by the SAPS to the SAHRCis a reviewable decision according to The Promotion of Administrative Justice Act 3 of 2000 (PAJA). The Court found in favour of the SAHRC on this in that the SAHRC's appeal procedure and the dismissal of the SAPS' appeal by the SAHRC does not fall within the categorisation of the definitions of what constitutes an "administrative action"which falls within the ambit of PAJA. The review was accordingly dismissed with costs. The costs relating to the review must still be taxed and are therefore unknown at this stage.

Yes, the SAPS recruited one thousand, five hundred and eighty five (1585) security officers for training during the 2012/2013 financial year.

Forty three (43) SAPS trainers were trained by an external provider from the security industry. The security officers were thereafter trained in a skills programme from the Certificate in Security Practices.

(ii) 896, persons were arrested for illicit narcotics at Ports of Entry during 2011/12 financial

(i) The narcotics that they were in possession included dagga, mandrax, tik, cocaine,heroin and Khat

(1) The forensic audit report forms part of the criminal investigation. The forensic audit report cannot be released until the criminal matter has been finalised.

(2) The investigation is in an advanced stage. The investigation team has not been in a position to charge suspects as yet and cannot pre-empt the possible arrest and charging of suspects.

(1) In terms of our records no member has been charged for misconduct as a result of civil claims against SAPS. This is a matter I have asked the National Commissioner to look into and to provide me with a report on what action can be taken in matters where police officers where clearly operating outside the law or were grossly negligent.

(2) I will address this after I have received a report from the National Commissioner.

REPLY:

The Government already has such a programme of action which recognizes the importance of perceptions of crime, hence Outcome 3 of the JCPS Agreement is defined as "All people are and feel safe".

The Justice, Crime Prevention and Security Cluster further recognises the importance of dealing not just with crime but also with perceptions (including fear) of crime. Output 4 of the cluster's delivery agreement therefore provides for: "Managed and improved perceptions of crime among the population."

With reference to his reply to question 1153 on 11 June 2013, (a) when were minimum hour flight requirements removed, (b) by whom, (c) on what grounds and (d) what were the minimum hour flight requirements before they were removed?

REPLY:

SAPS pilots operate with Civil Aviation Authority licenses. The CAA does not stipulate a minimum required hours a pilot must fly in a year. Therefore flight hours are not stipulated on an annual basis as asked in question 1153.

However SAPS complies with the CAA regulations to maintain their license which stipulate the following:

SAPS Pilots need to do a Revalidation check every 24 months and need to do at least 3 take-offs and 3 landings every 90 days per aircraft class in order to be current.

Civil Aviation Regulation Part 61 (Pilot Licensing) states in Par 61.06.6 (1) The holder of a CPL (Helicopter) shall undergo a revalidation check within 12 months from the date of the initial issue and thereafter within a period of 24 months.

Civil Aviation Regulation Part 91 02.4 Recency states in Par 91.02.4:

(1) A pilot shall not act as PIC of an aircraft, or second-in-command (SIC) of an aircraft required to be crewed by more than one pilot, carrying passengers by day, unless such pilot has personally, within the 90 days immediately preceding the flight, carried out either by day or by night at least three take-offs and three landings in the same class or, if a type rating is required, type or variant of aero plane, and in the case of a helicopter three circuits including three take-offs and three landings in the same type of helicopter as that in which such flight is to be undertaken.

(2) A pilot shall not act as PIC of an aircraft, or SIC of an aircraft required to be crewed by more than one pilot, carrying passengers by night, unless the pilot has personally, within 90 days immediately preceding the flight, carried out at least three take-offs and three landings by night in the same class or, if a type rating is required, type of variant of aero plane, and in the case of a helicopter three circuits including three take-offs and three landings in the same type of helicopter as that in which such flight is to be undertaken.

(1)&(2)The Provincial Commissioner of KwaZulu-Natal Province has not conducted any study to develop or upgrade the Imbali satellite police station due to the reason that her office is currently focusing on areas where communities experience the greatest hardship in accessing police services. A detailed accessibility study was conducted to analyse access to SAPS services and identified needs prioritized accordingly.

The Imbali area is located in the Plessislaer police area and is approximately 6 kilometres from Plessislaer police station. This distance is considered reasonable when compared with some other communities in the Province.

The Imbali satellite police station was established to enhance police accessibility in terms of frontline services and to make it easier for the communities involved to access these services.

There are no immediate plans to develop or upgrade Imbali satellite police stations as more critical areas have been prioritized.

(a) During February 2013.

(b) The INTERPOL Red Notice is not an international arrest warrant which allows for immediate arrest. Once a fugitive is detected, a provisional arrest warrant should be requested and provided through INTERPOL channels, followed by original documentation between the competent authorities through diplomatic channels. Requests for clarity on whether this specific person is still wanted and to provide the required documentation were sent through the INTERPOL communication channel to Libya. These requests are still to be answered. There is no Extradition Treaty in place between Libya and South Africa.

(2) (a) No, INTERPOL does not have a so-called Most Wanted list.

(b) Once the presence of persons, whose name is circulated on the INTERPOL Red Notice database, is detected in the country, the relevant INTERPOL National Central Bureau is informed that the fugitive may have been found. The validity of case against the fugitive is also questioned.

In the event of the case still being valid, a provisional arrest warrant through INTERPOL channels is requested in order for the South African Police Service to arrest the fugitive and bring him/her before court for an enquiry in terms of the Extradition Act, 1962 ( Act No 67 of 1962).

The pre Budget Vote engagements created an opportunity for interactions between government and stakeholders to communicate information which enables citizens to exercise their democratic right to hold government accountable. The engagements varied from department to department and some may have been accompanied by promotional material aimed at promoting the work and brand of government.

In the case of the budget vote on IPID and Police the entities were involved in exhibitions at the Parliament during the day of the vote and in the dinner hosted. It needs to be noted that SAPS organized a sponsor for the dinner.

(b) The National Commissioner and Provincial Commissioners agreed on a framework to equitably distribute staff to police stations as from 2013/2014 financial year. A provincial allocation per salary grade for station level is approved by the National Commissioner annually. The grading, minimum / maximum personnel thresholds and a minimum command structure for each police station is also provided.

Provincial Commissioners thereafter distribute posts to stations within the allocation received. The allocation distributed to each station is based on operational requirements.

Provincial Commissioners submit the distribution per station for approval by the National Commissioner.

Should any deployment of personnel be necessary, it should be effected in consultation with the Human Resource Establishment Committee.

Promotions up to the level of Colonel are regulated by the Promotion and Grade Progression Policy of the SA Police Service as per Safety and Security Sectoral Bargaining Council (SSSBC) Agreement 3/2011. The following period of time must elapse before a member of the Service can be considered to be promoted to each subsequent rank:

Constable to Sergeant

Post Promotion (Dependant on advertisment of vacant funded post and selection process)

A minimum of 2 years uninterupted service on the level of Constable plus at least an NQF6 qualification, or

At least a minimum of 4 years uninterupted service on the level of Constable.

Grade Progression (In current post and dependant on availability of funds)

A minimum of 7 years service as member of the Service.

Sergeant to Warrant Officer

Post Promotion (Dependant on advertisment of vacant funded post and selection process)

A minimum of 2 years uninterupted service on the level of Sergeant plus at least an NQF6 qualification, or

At least a minimum of 4 years uninterupted service on the level of Sergeant.

The issue of availability of fund does have an effect the ability of SAPS to promote people. In addition, I have already announced that we are busy developing a recruitment to retirement policy and strategy and the manner in which people get promoted is part of this process.

The complainant statement was obtained and medical records were also obtained. IPID have taken a warning statement of the police officer involved. The only eye witness who was at the scene does not want to make a statement. The NPA has been approached with regard to obtaining a Section 205 subpoena to force the witness to make a statement. The investigation is still ongoing
