Whether she or her department has been monitoring the (a) role and (b) representation of women in rural development and land reform projects; if not, why not; if so, what are the relevant details?

REPLY:

Yes, my Department has been monitoring the role and representation of women in rural development and land reform projects. From 2011 to October 2013, my Department has facilitated visits to rural women' projects in Limpopo, Gauteng, North West, KwaZulu-Natal, Mpumalanga and Eastern Cape. In some of the provinces this is done closely with the Department of Rural Development and Land Reform, as well as the Department of Agriculture, Forestry and Fisheries. In some instances interventions were put in place to address the identified challenges.

We have ensured that the rural women's role in rural development and land reform projects is not only institutionalized but supported by the creation of enabling environment through the Land Reform Gender Policy framework as well as the Gender Policy in Agriculture, Forestry and Fisheries.

Further enabling programmes to support women participation are in place. These include:

· Savings and Self Help Groups which is a programme that address hunger and poverty. It has mobilized 70 women in Limpopo, 300 in Mpumalanga, 62 in Gauteng as well as 120 Free State. The programme has four legs, namely, financial literacy, group formation where they get trained on how to form savings and credit clubs enterprise development and institutionalization by creating convergence with the formal sector.

· Promoting women's access to land and support through the Land Redistribution and Transformation of Certain Rural Areas Act, Act 94 of 1998 (TRANCRAA) Areas in all provinces. The following statistics of women who received land are as follows: 3 555 in Eastern Cape, Free State with 2 247, Gauteng with 7 390, Kwa-Zulu/Natal with 21 510, Limpopo with 1 177; 1 384 in Mpumalanga, 8 787 in North West, Northern Cape with 932 and the Western Cape with 9 859.

· Women's outreach and exchange programme: women learning and replicating lessons learned. 70 women have been identified to form a leadership cohort and others are participating in dialogue with Women in leadership Magoshigadi (Limpopo).

· Capacity and skills training programme: e.g. animal husbandry, poultry, entrepreneurial skills and financial management, conflict resolution. 68 women participate in poultry farming training and 400 women in Free State. The DWCPD further selected 40 women whose enterprises were visited during 2012-2013 for further training. This was done in partnership with NAMC, Buhle Agricultural College.

· Indigenous alternative method of building as an economic empowerment for rural women. This is done by rural women producing block bricks and then building houses for each other. The project has been implemented in Caguba (Eastern Cape) as well as Gombani in Limpopo.

· Advocacy and lobbying programme as a platform of promoting dialogue with women Commemoration and observation of important days such as International Rural Women's Day. The Department has to date raised awareness on women's rights and opportunities available for them. Educational programmes are structured around knowledge and understanding of women's rights as beneficiaries of rural development and land reform. My Department has also partnered with the Commission on Gender Equality to advocate for the "One Hectare, One Woman"

All of the above are mainstreamed in line with the 1997 White Paper on Land Reform which is seeking the removal of the injustices of racially- based land dispossession of the past, emphasizes the need for a more equitable distribution of land ownership; the need for land reform to reduce poverty and to contribute to the economic growth and provide security of land for all, and a system of land management that will support sustainable land use patterns and rapid land release for development.

Land ownership by women is one surest way for promoting an anti-poverty programme for poor women both in urban and rural areas and the economies of these areas starting with the most vulnerable - people with disabilities and the poorest of the poor. A deliberate and conscious targeting of women in land redistribution in this way will go a long way towards narrowing the gap between ratios of ownership of land between males and females.

a) The department did not incur any costs on the men's rally;

b) The estimated number of people who attended were about 3000- 4000;

c) By the number of men and boys that become more aware of the harmful effects is GBV on women and children; and become gender sensitive. By seeing more men join campaign against the scourge of violence against women and children.

Yes, the department has lobbied the Department of Trade and Industry and other departments to ensure that women and people with disabilities are empowered in the codes.

Furthermore, the BBBEE codes have not changed with regards to socio-economic development issues.

a) The R388 000 reflecting as outstanding payments is not owed by the department.

· The R388 000 consists of the following four (4) individual amounts:

o Salary payments of R9 196.16 and R4 878.78 to MP Shiviti and NNP Shange respectively;

o A refund from Government Communication Information of R273 742.00;

o A refund for an investment deposit with First National Bank for R100 000 that was closed towards end of financial 2012/13.

b) The amounts have no impact on the 2013/14 budget as they were charged in the 2012/13 budget. At year end the amounts were sitting in the Accounts Payable Control account and were interfaced into the individuals' bank accounts and departments' in April 2013.

1.1 The purpose of the MoU is to formulate a partnership and regulate the working relationship between the Departments; and

1.2 to establish a tool to monitor and evaluate the performance of the Department of Health on implementation of its initiatives on, inter alia; reduction of infant, child and youth mortality by improving immunization coverage from 88 per cent to 95 per cent by 2013; and training of health care workers on gender based violence.

2.1 The purpose of the MoU is to collaborate on specific areas of interest and to establish a tool to monitor and evaluate the performance of the Department of Rural Development and Land Reform in meeting the needs, interests, priorities and targets for women, children and people with disabilities.

2. The Office of the Premier: Northern Cape.

3.1 The purpose of the MoU is to collaborate on specific areas of interest and to establish a tool to monitor and evaluate the performance of the Office of the Premier in meeting the needs, interests, priorities and targets for women, children and people with disabilities.

3. Nelson Mandela Children Fund.

a. The purpose of the MoU is to formulate partnership on agreed areas of cooperation for the progressive realisation of children's rights; including advocacy campaigns and facilitating the process to generate country reports in order to comply with local and international instruments.

4. Statistics South Africa.

a. The purpose of the MoU is to collaborate as partners in the development and sustainability of the Ulwazi Ngabantwana database. The database is aimed to monitor and evaluate the implementation of the legislation that seeks to protect and promote the rights of children.

5. Uweso Consulting: Techno Girl.

a. The purpose of the MoU is to create the basis for collaboration to coordinate and facilitate placements of girl learners in mentorship programmes through job shadowing; and to develop more effective strategies to lobby mentorship partners to secure internships and full time employment for the learners who participated in the programme.

6. National Development Agency

a. The purpose of the MoU is to collaborate on specific areas of interest inter alia; providing support on implementation of the Techno-Girl Programme; and the Early Childhood Programme.

7. South African Police Services

8.1 The purpose of the MoU is to collaborate on specific areas of interest, including co-ordinating the implementation of the 365-Days-Plan-of-Action, to stop violence against women and children, through the establishment of a National Council against Gender Based Violence.

8. The Mvula Trust

9.1 The purpose of this MoU is to establish a collaborative relationship between the DCWPD and The Mvula Trust relating to the promotion and implementation of construction, Environmental, water, waste, sanitation and agricultural projects and programmes. The implementation of projects and programmes involves DCWPD and The Mvula Trust members, Women in Agriculture and Rural Development, Youth, community members, leaders in community and non-governmental organisations.

From July 2011 to date the department of Women, Children and People with Disabilities signed MoU's with the following Departments:

1. Department of Health

2. Office of the Premier: Northern Cape

3. Department of Rural Development and Land Reform

4. Statistics South Africa

5. South African Police Services

6. Mvula Trust

7. National Development Agency

Department of Health (DOH)

The DWCPD entered into an MoU with the DOH to:

(i) Collaborate on maternal and child health programmes.

(ii) Support HIV and AIDS programmes (including prevention of mother to child transmission).

(iii) Participate in SANAC.

(iv) Collaborate with the DOH on UN reports on the UNCRC, UNCRPD, CEDAW and CSW reports

(c) Outcomes

· Access to assistive devices such as wheelchairs and hearing aids has improved; and

· Strengthening access to eye care services and prevention of blindness.

Northern Cape: Office of the Premier

(c) Outcomes:

· The Northern Cape Province has made a good beginning with the establishment of baseline data for the implementation of the Convention on the Rights of Persons with Disabilities, as per their 2012 submission for the Baseline Country Report. It was the only province to have included district-based data in their baseline report. The province is now working on an integrated programme of action to improve service delivery to persons with disabilities

(d) DWCPD's contribution towards outcomes:

· The DWCPD launched the 16 Days Activism campaign on the 25th of November 2012 in the Northern Cape Province.

· The DWCPD launched the first Orange Day campaign, a campaign to eradicate violence against women, in the Northern Cape Province.

· The DWCPD launched the sanitary dignity campaign for girls in the Northern Cape Province.

· DWCPD visited homes for abused women and children in the province.

· The Ministry met with the Provincial Executive Council, HODs as well as Executive Mayors and Municipal Managers across the provinces to provide guidance on the national disability rights agenda priorities, unlocking bottlenecks and accelerating barrier-free service delivery.

· The Department co-hosted the launch of the 2013 National Disability Rights Awareness Month with the Northern Cape Provincial Government in November 3, 2013.

Department of Rural Development and Land Reform

The DWCPD entered into an agreement with the DRDLR to among others:

· Engender all policies, programmes and procedures of the department;

· Ensure that policies and budgets on land reform and rural development are responsive to the rights of women, children and people with disabilities.

· Ensure a 50% women ownership and a minimum of 4% ownership by people with disabilities of the 411 recapitalized farms.

(c) Outcomes:

· The DWCPD in partnership with DRDLR hosted the international rural women's day in the Eastern Cape and KwaZulu Natal provinces.

· The DRDLR employment equity performance for persons with disabilities improved from 1.64% in December 2011 to 1.8% in December 2012, still significantly below the agreed upon 2%.

(d) DWCPD's contribution towards outcomes:

· The DWCPD has assisted women in the agricultural sector to set up agricultural projects in provinces.

· The DWCPD has also signed an MoU with The Mvula Trust to support women projects through skills transfer and coordination of skills training.

Statistics South Africa (STATS SA)

(c) Outcomes:

The DWCPD entered into an MoU with STATS SA to facilitate the establishment of sex disaggregated data on women, children and people with disabilities.

(d) DWCPD's contribution towards outcomes:

· The DWCPD had meetings with STATS SA to facilitate the establishment of sex disaggregated data on women, children and people with disabilities.

The South African Police Services (SAPS)

The DWCPD entered into an MoU with SAPS to amongst others:

  • SAPS is playing a leading role in the National Council Against Gender Based Violence
  • Participate in the campaign and ensure the implementation of the 365 days National Action Plan for no Violence against Women and Children;
  • Intensify efforts to combat crimes against women, children and people with disabilities, including capacitating members of the SAPS to effectively implement the Domestic Violence Act, the Sexual Offences Act and other relevant legislation;
  • (c) Outcomes:

    · Ongoing support on follow-up to GBV cases across the country; as well as partnership in campaigns (women's day, 16 Days and the Diepsloot) project planning and implementation of the safety and security of women and children,

    • Participation in the Orange Day campaign against gender based violence on the 25th of every month.
    • The DWCPD in partnership with SAPS visited the homes for abused women and children and police stations in the Northern Cape Province.
    • Actively participate in the 16 Days Activism Campaign Against Gender Based Violence and the 365 Days National Action Plan.

    The Mvula Trust

    (c) Outcome

    The DWCPD entered into an MOU with Mvula Trust to:

    · collaborative on the promotion and implementation of construction, Environmental, water, waste, sanitation and agricultural projects and programmes to empower women. The implementation of projects and programmes involves DCWPD and The Mvula Trust members, Women in Agriculture and Rural Development, Youth, community members, leaders in community and non-governmental organisations.

    National Development Agency (NDA)

    (c) Outcomes

    The DWCPD entered into an MoU with the NDA to:

    · collaborate on specific areas of interest inter alia; providing support on implementation of the Techno-Girl Programme; and the Early Childhood Programme.

    (1) In compliance with the country and global obligation to people with disabilities, (a) how far and (b) how beneficial is the Integrated National Disability Strategy for all institutions in South Africa, (c) what difficulties confront people with disabilities to access training and skills development and (d) what has she found to be the best ways to overcome these difficulties, if any;

    (2) Whether there is a plan of action to improve on the successes to date; if not, why not?

    REPLY:

    1(a) (b) The White Paper on an Integrated National Disability Strategy (INDS) was released in 1997 to provide guidance to government departments and institutions on the mainstreaming of disability considerations across all three spheres of government during the post 1994 legislative and policy reform processes.

    The United Nations disability rights source documents, the UN Standard Rules on the Equalisation of Opportunities for Persons with Disabilities and the World Programme of Action Concerning Persons with Disabilities were used as baseline documents during the development of the INDS.

    As the Honourable Member knows, South Africa ratified the Convention on the Rights of Persons with Disabilities (CRPD) in 2007. This requires a review of all legislation and policies against the obligations contained in the CRPD, including a review of the INDS.

    The Baseline Country Report on the implementation of the CRPD has just been finalised and is in the process of being deposited with the United Nations. The compilation of this Report has highlighted the priority areas of policy and legislative reform required, as well as provided the country with baseline information on how far the country has come with implementation of the CRPD. The baseline indicates that government has succeeded in mainstreaming disability considerations across sectoral legislation and policies, but falls short on implementation and translation of these laws and policies into practice, as well as on enforcement of existing legislation such as the National Building Regulations.

    The Department will accelerate the process of finalising the National Disability Policy and Implementation Guidelines through an in-depth Regulatory Impact Assessment in 2013/14, which will in effect domesticate the CRPD and update the INDS.

    1(c) Equal access by people with disabilities to training and skills development remains a challenge, although there has been a gradual improvement over the past few years. The Baseline Country Report indicates that attitudinal barriers remain the major obstacle, followed by barriers to access to built environment, the unavailability of accessible public transport as well as lack of reasonable accommodation measures linked to training and skills development programmes.

    1(d) The Baseline Report highlights examples of good practice such as, among others, innovations by the Athena Private FET College, the South African Disability Development Trust, the Medunsa Organisation for Disabled Entrepreneurs, as well as National Student Financial Aid Scheme (NSFAS), in providing access to higher education and training and skills development opportunities for people with disabilities. These models focus on removing
    attitudinal barriers and putting in place reasonable accommodation support measures to ensure that people with disabilities have equal access.

    The Department, as part of its core business, provide institutional support to promote mainstreaming of disability considerations. Some of the activities currently being implemented, include, among others:

    ▪ An Executive Roadshow under the leadership of Deputy Minister Bogopane-Zulu to all institutions of higher and further education and training to engage on accessibility of young people with disabilities and reasonable accommodation support measures required in these institutions;
    ▪ Sharing of good practice such as the ones illustrated above through the Disability Rights Mailing List, as well as promoting shared learning by stakeholders implementing similar projects;
    ▪ An extensive capacity development project for disabled people's organizations (DPOs) as well as government institutions will be rolled out in partnership with United Nations Agencies this year. Exposure to good practice will form a cornerstone of this initiative.
    ▪ The finalization and roll-out of disability rights indicators across the government-wide planning and monitoring system, and the development of a National Disability Rights Programme of Action for the period 2014-2019, which will also contain agreed upon targets and monitoring of disability-responsive budgeting, will accelerate progress in the medium term.

    This is an ongoing challenge and the Department has engaged heads of departments and bought this to the attention of the Forum of South African Directors-General (FOSAD) and Cabinet. We believe this will assist in improving the response rate from departments.

    We also hope that the WEGE bill, once it is passed by Parliament will assist a great deal in the enforcement of the mandate of the DWCPD and enabling efficient collation of information and data in order to ensure that women empowerment and gender equality is better enhanced.

    1. Dismissal of Adv. Nomazotsho Memani-Baleni

    Adv Memani- Baleni special advisor to the former Minister Noluthando Mayende Sibiya was dismissed. She referred the matter to the Bargaining Council for conciliation. Conciliation failed and the matter was referred to Arbitration. The Arbitrator ruled in favour of the department of Women, Children and People with Disabilities. Adv Memani-Baleni proposed a settlement i.e payment of her legal costs and 4 months' salary by the department.

    The Office of the State Attorney represented the department in the matter and the legal costs were R113 456 53.

    2. Kabini v Paxton Cerva Properties, Barend Vand Erkom Fonds and the Minister of Women, Children and People with Disabilities.

    In this case, the Department of Women, Children and People with Disabilities was cited as a respondent by Mr Kabini for the interest it may have in this matter and no substantial relief was sought against it (Mr Kabini is a person living with a disability).

    The matter is pending in the North Gauteng High Court, Pretoria and no amount has been claimed from the department.
