1. South Africa has two (2) national language policies that inform all other language policies in the country, the National Language Policy Framework for the nation as a whole (NLPF), and, the Language -in- Education Policy (LIEP) for education. Municipalities work within these frameworks as they are bound by the Constitution to develop policy in this regard.

2. Promulgated language legislation in the provinces and language policies to inform municipal ones are necessary to specify which languages are to be and as such, it is not possible to specify what languages have been legally adopted for each province.

3. In light of the foregoing, there is no copy of policy available at this stage,

4. In the context of policy and legislation with regard to the development and promotion of official languages, provinces are encouraged to develop and adopt specific language policies and legislation.

1. The Department entered into a Memorandum of Agreement with the 1820 Settlers Monument for the 2008-200912009-2010/2010-2011 MTEF cycle. A total amount of R2.523 Million was transferred in the first year, R2,674 Million was transferred for the following year and a total of R2,836 Million was transferred for the final year respectively. The Memorandum of Agreement signed with the 1820 Settlers Monument could not be renewed due to lack of funds in the Department.

Funding for the 1820 Settlers Monument can be reinstated if the Department is able to raise more funding for this and other heritage properties.

(1) Whether his department conducted an audit of the heritage sites that will be affected by the land restitution programme; if not, when will this audit be undertaken and finalised; if so, (a) what are the names of these sites and (b) where are they located;

(2) Whether his department reached an agreement on who will take responsibility for the maintenance of the sites in cases where protected land has already been transferred to new owners; if so;

(3) Whether his department will provide training to those new owners for the maintenance of the respective sites?

REPLY:

1. The South African Heritage Resources Agency (SAHRA) is responsible for managing heritage sites in accordance with the National Heritage Resources Act, Act 25 of 1999. Furthermore, there is also the Provincial Heritage Resources Agencies are responsible for the identification, conservation and management of heritage resources at a provincial level. SAHRA does not have a list of all the sites affected by land restitution. If SAHRA and the Provincial Heritage Resources Agencies can be provided with the list of land restitution they will be able to respond to 1 (a) and (b).

2. The maintenance of sites is the responsibility of the owner. SAHRA provides guidelines on how these should be conserved.

3. When sites are declared a conservation management plan is developed which stipulates how sites should be managed and conserved.

1.Whether any performance bonuses were paid to employees in the Department in respect of the 201212013financial year; if so, (a) what is total number of employees that received bonuses and (b) what is the total amount paid out by the Department for employee bonuses;

2. What percentages of outputs were achieved by the Department as measured against the targets set in the Annual Performance Plan of the Department in respect of the said period?"

REPLY

1.No, performance bonuses have not yet been paid to employees in respect of the 2012/2013 financial year.

2.The Department made huge inroads towards the achievement of most of its targets for the 2012/13financial year. Although the audited performance information reflects only 55% of the targets as fully achieved, there were other targets that were fully achieved but were later declassified as not achieved by the Auditor-General due to non-availability of supporting documentation to prove completion. For example, a number of our infrastructure projects were completed during the aforesaid financial year including renovation of the OR Tambo homestead, construction of phase 2 of Ncome, construction of Matola Raid, and many more. But because the Department could not provide the Auditor-General with completion certificates of the latter projects, these achieved targets were declassified as not achieved. This is in spite of the fact that the issuing of completion of certificates is out of the Department's control. Moreover, more than 75% progress was made towards the achievement of some of the other Departmental targets. For example, the target for new libraries was set at 14and the Department managed to fully complete 13new libraries (construction of the 14thlibraries was still on-going at the time of reporting). However, the system used by the Auditor-General to gauge performance does not recognise the latter as achieved nor does it acknowledge such progress in its assessments and reporting.

No National Language Unit as prescribed in the Use of Official Languages Act, Act 12 of 2012 has been established. An existing National Language Service (NLS) carries out the precise functions identified in the Act, namely, promoting parity of esteem and equitable treatment of the official languages of the Republic; facilitating equitable access to the services and information of government, promoting language management within government, and performing any other functions that the Minister may prescribe. Programmes are in place to ensure that these requirements are fulfilled Advising the Minister on policy and strategy involving regulating and monitoring the use of official languages by national government for government purposes is carried out by the Language Planning section. The mandate of PanSALB itself speaks to these very functions. It is not envisaged that a National Language Unit will be established at this stage, given that the functions of units as prescribed by the Act are being adequately fulfilled by the current structure.

(a) The Pan South African Language Board Act, Act 59 of 1995 must be revised for two reasons. Firstly, it must be aligned with the Constitution of the Republic of South Africa, 1996 as the relevant overarching legislation which it predates.
Secondly, it must strengthen provision for the oversight of PanSALB to improve the governance and functioning of the entity.

(b) The process is likely to be completed in October 2014.

On 4 September 2013, the Department conducted a workshop for national government departments, national public entities and national public enterprises in preparation for the implementation of the Use of Official Language Act, Act 12 of 2012.

The Regulations to the Use of Official Languages Act 12 of 2012 were published for comments in May 2013. A further consultative workshop was also held on the 4th September 2013. 3 how is his department ensuring that no artists use their political affiliations in order to be regularly selected to perform at government events?

REPLY:

1. Events organised by my department provide a diverse range of discipline ,genres and styles offering, depending on the occasion. While my department cannot answer for how other government departments approach the matter, we strive to provide young and up-and-coming artist the opportunity to showcase their talent at such events. Young artists identified to perform, do not receive the same remuneration as established artists.

Working in partnership with provincial and local government to identify upcoming artists, the department adopt similar remuneration scales to those used in the provinces and local government structures although a small increase is generally levied on the benchmark scale in recognition of the importance of performance on a national stage.

2. The DAC live performances are varied in their scope and nature and as such it is unlikely that one DAC live performance opportunity will feature the same established artists consistently. The service providers and music promoters appointed by the department to assist in the hosting of these events are structured to rotate artists as much as possible to create equal opportunity and fair play.

3. My department does not include artists in the programme of any event on the basis of political affiliation.

Yes, some of my staff members performed work outside their normal working hours during the said period and that approval was granted by the DG after consideration of the application to do such work, and as such there was no transgression of the departmental policy on work outside normal working hours.

REPLY:

The declaration and programme of action of the National Social Cohesion Summit, held at Kliptown, Walter Sisulu Square in July 2013 intends to address the hindrances of social cohesion of which amongst others, sexual violence against women and children is one of them. Specifically Resolution 5 of the Summit intends to accelerate changes in improving the quality of life of all people, with special attention to the needs of youth, women, children and people with disability.

We have established the Chief Directorate: Social Cohesion and Target Groups the Chief Directorate creates and support programmes on 16 Days of Activism of no violence against Women and Children national campaign as well as Community Conversations. The Chief Directorate also works with civil society bodies such Moral Regeneration Movement and the Art Therapy Centre to address these issues.

In addition Outcome 14 on Social Cohesion led by the Department will ensure that programmes are put in place to address the issues of sexual violence against women and children.

(a). To date the total cost incurred from using private boat suppliers to ferry visitors to Robben Island amounted to R259 7344.99.

(b)(i). The individual cost of repairs for Sikhululekile in 2011-2012 amounted to R1 924 931.72 and R3 294 866.76 in the 2012-2013 financial year

In the current economic climate, the allocations received from the National Treasury have limited increases year on year especially for the 2013114 financial year. Consequently, the allocations to our museums had to be done in such a way that it ensures its maximum effectiveness over the broad spectrum of their legislative and other responsibilities. The income revenue of Robben lsland Museum is significantly higher than any other museum associated with the Department, with a further potential to increase this revenue. As such their proportional allocation for operational expenditure for 2013114 was marginally lower than other museums. The Department however will compensate for this by allocating a significant budget for the maintenance and refurbishment of the lsland which directly relates to Robben lsland Museum's status as a World Heritage Site. This in turn will also relieve the pressures on their operational budget and further increase their revenue potential by make the lsland a more desirable tourist destination.

(1) The Use of Official Languages Act 12 of 2012 contains a provision providing that the Act comes into operation on a date the President proclaims in the Government Gazette.
The date is yet to be announced pending finalization of the promulgation of the Regulations following the public comments that, I must first consider. The process to call for public comments is underway.


When the Act comes into operation it will be implemented by Government departments, each according to their own state of readiness.

Specific mention and discussion of Chapter 15 of NDP (Nation Building and Social Cohesion) and Social Cohesion Summit Report was undertaken to ensure aligned implementation. These and other discussions were integrated into the Annual performance Plan for 2013114 for implementation, monitoring and reporting.

The Presidency has engaged my department (and all other departments) regarding the "Preparatory Work Towards the 2014-2019 Medium Term Strategic Framework (MTSF)". Therefore my Department will be working closely with the NPC and DPME in the Presidency as well as with National Treasury in translating the National Development Plan and ensuring the alignment of DAC Strategic Plan and Annual Performance Plans with the NDP

(a) The Department participated in a New Age/Morning Live Breakfast Briefing, hosted to unpack the DAC's 201212013 Budget Vote. The Department did not buy tickets as such, but did purchase tables to the event which were used to invite key stakeholders, to interact with the Department on its plans for the year ahead. The platform also provided an opportunity for the DAC and its stakeholders to explain to South Africans (via the SABC Morning Live TV audience) what its priorities were for the year.

(b) The event was held on 4 May 2012. An amount of R128 352.60 was spent.
