REPLY:

(a)(b)(i&ii) The Department and its entities did not sponsor any event or promotion by the New Age Newspaper. However we (including some entities) bought tables for the Department's 2012113 post budget vote media briefing, hosted by The New Age.

(aa) It was for the 2012113 Budget Vote Breakfast briefing to stakeholders
(bb)The event was held on 4 May 2012
(cc)The Department spent an amount of R128 352.60, and the three entities spent R21 392.10
(dd)The purpose was to brief the Department's stakeholders and the SA nation at large about our strategic focus for the 201212013 budget allocation.
(ee)The funds were derived from the Department and respective entities' Communication and Public Relations budget
(ff)The expected outcome was to afford stakeholders and the SA nation an opportunity to interact with the Minister and Deputy Minister on the 2012113 Budget. This would allow the Ministry and the Department to get views and inputs from stakeholders regarding how to meet their expectations and work
together to grow the sector.
(gg)As indicated above, this was not a sponsorship. However the benefits of this interaction were that the Department's stakeholders and the SA citizens provided feedback and requested both the Ministry and Department to consider their inputs when deciding on how the budget would be used.

What assessment has he made of the implications for his department of the Census 2011 statistics indicating that the use of the English language is increasing at the expense of the other 10 official languages?

REPLY:

1 Statistics indicating increase in the use of the English language confirm common perceptions about the language. Its choice as the language of wider communication indicates what individual and group users' value. Within the framework of human rights, especially in matters of cultural practice and language, no one can prescribe values without infringing upon others' rights to choice. Be that as it may, the Minister of Arts and Culture's assessment of the situation allowed him to judge that, within his competency and jurisdiction, he could speed up the language legislation to regulate the use of all 11 official languages in national government departments, public entities and enterprises. On 2 October 2012, the President of South Africa assented to the Language Act and published it in the Government Gazette No
35742. He is yet to declare when it comes into operation.


Meanwhile, the Minister of Arts and Culture is finalizing the Regulations to guide the national departments, public entities and enterprises in crafting their language policies. He has also submitted to Cabinet the South African Languages Practitioners' Council Bill. Cabinet approved this Bill on 17 July 2012. If it is enacted, the profession of language practitioners will be regulated thus protected so that government is assured that all 11 official languages receive equitable attention.

Whether, with reference to his reply to question 1423 on 3 October 201 1, investigation by the Special Investigating Unit (SIU) into the unauthorized expenditure amounts of R42 million have been finalized, if not, what is the position in this regard, if so, what are the relevant details?

REPLY:

The investigations by the Special Investigating Unit (SIU) into the unauthorized expenditure amounts of R42 million have been finalized.


The Auditor-General also advised the department to effect the recommendations of the SIU in the 2012/13 financial year. The department has adhered to the recommendations made by the SIU, that official who were implicated to provide written explanations why disciplinary action should not be instituted against them.

The department has requested in writing that the unauthorized expenditure be condoned without funds because the funds were utilized for the purpose of the vote in another programme, what made it unauthorized was due to the fact that National Treasury's approval was not obtained. The register for unauthorized expenditure has been updated and the disclosure of the unauthorized expenditure will be amended upon approval of the condonation by the Parliament via National Treasury.

The reason for this is that at the time when the Department and entities bought advertising space from the New Age, the newspaper was not affiliated to an independent institution such as the Audit Bureau of Circulation (ABC).

4. No independent studies of said advertisements were conducted to ascertain whether they were effective within the relevant target market. The reason for this is that when we undertake an analysis of the effectiveness of a campaign we do not focus on one target market or one medium - be it newspaper, radio or television. Different media complement one another to deliver the desired result and media diversity is our best practice.

    1. Yes, Robben lsland Museum has a Disaster Management Plan. Fixed and (a) immovable assets on Robben Island, its satellites offices, and the University of the Western Cape are stored in accordance with the generally accepted museulogical standards.
    2. Both the movable and the immovable assets of (i) the lsland, (ii) its satellites (iii) and the University of the Western Cape -Robben lsland Mayibuye Archives have been documented. The museum has an asset register for all its assets.

    The museum is currently in the process of digitizing its collection so as to ensure that the risk of loss due to natural disaster is minimized.

    With reference to his reply to question 1000 on 10 June 2011attached, what is the status of the National Archives and Records Service? NW3610E

    REPLY

    The National Archives and Records Service of South Africa has launched two projects to enable the institution to create more space to allow for the transfer of records from Governmental Bodies.

    The premises vacated by the National Library at 239 Madiba Street, Pretoria, have been allocated for use by the National Archives. The Department of Arts and Culture in conjunction with the National Department of Public Works is in the process of renovating the buildings and partial site hand-over to a contractor took place on 09 October 2012. It is envisaged that the whole project will be completed by early 2015. The project is worth R104 436 954.00.

    At the completion of the 2 projects about 15 000 linear metres of shelve space will have been created and this would allow the National Archives to accept the transfer of records from Governmental Bodies again.

    The Public Private Partnership (PPP) Project was put on hold in order to allow the medium term objectives (the above mentioned projects) to be implemented with immediate effect.

    The two Departments have already identified areas of cooperation and have worked together in preparation for the hosting of the International Conference to mark the 40th Anniversary of the UNESCO World Heritage Convention under the theme "World Heritage and Sustainable Development: the Role of Local Communities". Furthermore, the two Departments are working together on the development of the National Heritage Monument, a proposed project which will celebrate and commemorate the anti-Apartheid struggle.

    REPLY:

    (a)(i). Yes, In accordance with section 4(2) of the Act, the Minister appoints a suitably qualified person or panel of persons to hold a public inquiry and that person or panel determines the procedure for the public inquiry, which procedure must include a public hearing and comply with the procedures to be followed in connection with public inquiries, as prescribed.

    (ii). In line with the determined procedure, persons affected by the administrative action are given reasonable time to make representations. Same can either be oral or in writing.

    (iii). The appointed person or panel compiles a written report on the inquiry and give reasons for any administrative action taken or recommended and as soon as possible thereafter publishes in English and in at least one of the other official languages in the Gazette, a notice containing a concise summary of any report and the particulars of the places and times at which the report may be inspected and copied. Persons affected by the administrative action are further given adequate notice of any right of review or internal appeal, where applicable.

    (iv). Persons whose rights have been materially and adversely affected by an administrative action are further drawn to the attention of section 5 of the Act which provides for the giving of written reasons within 90 days after the date on which the person became aware of the action or might reasonably have become aware of the action.

    Government has adopted 12 outcomes with a view to measure performance and accountable delivery.

    The President signed performance agreements with all Cabinet Ministers. In this performance agreements, Ministers were requested to establish and participate in Implementation Forums for each of the twelve outcomes.

    The Implementation Forums have developed delivery agreements for the Outcomes.

    All departments, agencies and spheres of government that are involved in the direct delivery required to achieve an outcome, are party to the agreement.

    In June 2012, Government released the Mid Term Review, which focuses on the government's progress against the delivery agreements for the twelve outcomes and we hereby refer the honorable member to this document which gives a comprehensive account on progress in the areas of national priorities, such as education, crime and corruption, jobs and rural development.

    Special Investigation Unit (SIU) that was commissioned to conduct the investigations recommended that no disciplinary action be taken against officials accountable of alleged irregular expenditure. The SIU rationale was that officials implicated were no longer working for the department and had no serious financial misconduct to warrant criminal/fraudulent charges.

    Generally the funding provided by the department was to assist SARA to achieve its goals of helping the youth to have a better opportunity in the sector which would begin to impact positively on the sector, providing skills development. job creation and employment for young Technicians in the Live Events field, mainly music concerts and theatre shows, thus creating employment for the youth.

    The funding assisted SARA to participate in major international Live Events Production and Technical Services markets, festivals and conferences, thus exposing some of the youth to participate in skills enriching exchange programmes abroad. Training & International Exchange:-Holland, Norway and Denmark. Participation at major International markets & sector EXPOS: -
    PLASA SHOW, PROLIGHT SOUND MESSE, and ROSKILDE FESTIVAL


    2. As a means of monitoring, the Department signed a Memorandum of Understanding (MOU) in which SARA should submit periodic progress reports and financial audited statements. In addition:

  • A site and organisational inspection was conducted by the Departments on SARA.
  • SARA forwards the Department with consistent correspondence on its interactions in the sector which gives the departments insight on SARA's impact in the sector.
  • Letters of appreciation from students who participated and benefitted positively from SARA's programmes locally and internationally as well as international correspondence have been forwarded to the Department from similar sector stakeholders who are pledging support and acknowledge the value of the interventions made by SARA

    The overall findings from the above reports and monitoring interactions with SARA show a number of positive elements including amongst others that:-

    • SARA has a great potential to provide development for youth wanting to pursue career in the Live Events Production and Management sector.
    • SARA needs organisation restructuring (a section 21company for the skills development company and a separate commercial company/wing to capitalise on private sector/cooperate and professional work which will subsidise the section 21.
    • The building in which SARA is currently operating is dilapidated, a health hazard and that proper renovations costs will be too high and would be better off purchasing a new building.

    1(a) (i) During 2008 Downtown Music Hub was not operational

    (ii) In 2009 the studio was used up to 88 artists for recording purposes

    (iii) In 2010 the number of artists who were able to utilise the studio for recording purpose came to 130.

    (iv) During 2011, a total of 143 artists made use of the studio for recording purpose

    (b) Since 1 January 2012 to July 2012 the studio has already been used by 76 artists for recording purpose.

    2. The Downtown studios is easily accessible to any artist as it is located in downtown Johannesburg where a vast number of impoverished people live It is in close proximity td taxi ranks so public transport issues 'are not a major problem for those who wish to access the facilities.

    The majority of the people using 'the facility are from disadvantaged backgrounds, a number of them are walk-ins who do not have any representation and are attracted by lower rates and facilities;. Almost 90% to 95% of the people that utilised the studios are from disadvantaged backgrounds.

    3 Downtown is known as a home to ail artists and most business is as a result of word of mouth the marketing given the rates and approach to development of artists. Its clientele is 'predominantly from disadvantaged communities and there are a number of them from rural communities, particularly those. Who record traditional Zulu music. They are not attracted by complicated marketing campaigns but by the reputation of the studios and its. accessibility, in close proximity to taxi ranks, hence public transport issues are not a major problem.

    A study has not been conducted, but the Downtown Music Hub has developed a business plan that proposes support for development of focused high quality South African local music content. This business plan has noted "production quality" to be at the centre of any recording. Downtown Music Hub will offer a facility and platform from which prospective musicians can record, develop, package, market and distribute music to the South African market.

    Downtown Music Hub is not intending to declare a competitive price war with existing facilities such as the SABC or private sector, because that is not what it is established for, it is the aim of Downtown Music Hub to have a well thought pricing strategy that enables it to sell products at competitive prices alone as the national competitors are able to secure better deals with

    performing artists. Downtown Music Hub's customer service offering is designed to offer its products at an enhanced margin. This allows both the customer and the organisation to benefit.

    The mandate of the Downtown Music Hub is to create access and economic opportunities for the music role players, develop musicians, manufacturing and distribution facilities and re-align the competitive advantage of the local music sector products in global markets.

    (i) The Downtown Music Hub business plan has made the following findings: that there are barriers of entry to the industry and this relates to capital investment which limit new entrance, it has also made the observation that there is a plethora of small home-based music production studios and due to availability of recording equipment in small recording studios the production of music would seem to be in abundance, but this is still limited to a few individuals.

    (ii) Then to create a balance the Downtown Music Hub business plan has made the following recommendations that it must concentrate in developing the studio to becoming a state of the art digitally driven facility. It must create access to the music value chain particularly recording opportunities for South African artists, it should ensure growth of South African indigenous music, it should embrace the use of technology as the driver and enabler for industry growth and development, and therefore should focus on high-end post production, human-capital development, in both rural and urban and be at the centre of youth empowerment.

    a. The strategy will be implemented over a three year cycle starting from the 2013/2014 financial year.

    b. Our vision is to develop the Hub into a local content music production centre that will produce high quality content for the market place. According to the Hub's business plan, special attention will be given to addressing issues of the marginalised in the business of music.

    2(a). Yes the turnaround strategy will enable the Hub to; break even, hence there is great demand for services especially from previously marginalised groups.

    2(b). The Hub business plan does provide high level of viability in terms of the projected balance sheet and therefore I have no doubt that the Hub will be a sustainable business in the music environment.

    With reference to the planned Social Cohesion Summit by his department which will be held in Gauteng on 13-15 July 2012 (a) what (i) is the complete budget breakdown for the event; (ii) are all the details leading up to the preparation of the event; (iii) are the intended outcomes; and (b) how will this event facilitate community participation?

    (a)(i) The total budget for the summit amounts to R6,070 million, to cater for broad categories such as research work, report writing, transcribing, transport and accommodation of delegates as well as meals.

    (ii) The results of the Nation in the Making document, placed firmly social cohesion to be on top of the government agenda. The Department of Arts and Culture was mandated to lead in the sphere. An implementation vision framework that focused on two pillars, namely, dialogue and community mobilization was approved.

    In realizing the above, the Department then convened a social cohesion colloquium in 2009 which recommended that a draft strategy on social cohesion be developed as well as convening a national summit on social cohesion. As a build up to the summit in 2011, the Department convened community conversations in all the nine provinces with the following objectives;

    • How to harness our culture and racial diversity for greater social cohesion
    • How to collectively promote such positive values as human solidarity, self –reliance human dignity and respect;
    • How to reconcile the many socio-cultural divides that continue to retard progress in the social cohesion project;
    • To create a platform for all sectors of South African society to engage in a national dialogue to discuss social cohesion;
    • To get consensus on the type of socially inclusive South Africa that its citizens desire to build;
    • Provide a platform for catalytic role to promote and strengthen social capital and Public Participation as well as resilience


    The Department engaged the service of Mapungubwe Institute for Strategic Reflection, (MISTRA) to assist with the development of a draft social cohesion strategy. The draft strategy has been developed and undergone stakeholder consultation through the roll out of community conversations in all the nine provinces for grassroots inputs.

    The draft document was presented to the Social Sector Cluster and the Governance and Administration Cluster. The draft document was approved by Cabinet on July 13.

    (iii) The intended outcomes of the summit.

    • A comprehensive report of the recommendations of the National Summit will be prepared by the Department of Arts and Culture and an action plan developed for their implementation.
    • A widely supported Program of Action for continuous community mobilization and implementation schedule of social cohesion activities
    • Establishment of a national social cohesion "Think Tank and Advisory body.
    • A National Implementation & Co-ordination Committee comprising representatives of stakeholders at the summit will be established to co-ordinate the implementation of resolutions of the Summit.
    • A Provincial and Local Government implementation co-coordinating committee which will ensure that resolutions of the Summit find implementation at local government and provincial levels will also be established as part of the discussions of the 'way forward.
    • A schedule of key activities and dates for inter-committee meetings will be agreed upon
    • A social compact in the form of the summit declaration

    (b) Community participation is the key element of the summit starting from the build up through the community conversations and contributing to the draft social cohesion strategy. The Department has ensured that during the conversations inclusivity is encouraged through the participation of all key community groups and to include among other, Youth, Women, People with Disabilities, the Elderly and marginalized groupings. The Department is making sure that all these groupings from all the provinces are represented at the summit to ensure that their voice is heard. There will be on-going, post summit feedback and review on community programme implementation.
