REPLY

No. The Department of Rural Development and Land Reform has forty one (41) Land Reform offices at provincial and district level. Five offices (5) are housed in state-owned buildings and thirty six (36) offices are housed in privately owned buildings (leased buildings). Ten (10) of the forty one (41) offices have adequate security measures in the form of security guarding services, Closed Circuit Television (CCTV) cameras and access control systems. All Land Reform offices have security guarding services, which in itself, cannot be considered adequate.

(1) (a) The target is 5000 for the 2011-2012 financial year.

(b) More than 50% of the 5000 have been recruited.

(c) We are advertising in rural areas using pamphlets and we are advertising through community radio stations.

(2) No. The National Rural Youth Services Corps (NARYSEC) is registered as a programme at the National Youth Development Agency (NYDA) and they advise on a technical and strategic level.

(1) (a) How much (i) did a certain company (name furnished) pay for the land from which the West Bank residents of East London were forcibly removed in 1995, (ii) did his department pay for alternative land to accommodate this community and (iii) was allocated by his department to the Buffalo City Metro to install services on this alternative land, (b) who was the implementing agent on this land and (c) what are the services that have been installed on this alternative land to date;

(2)whether the amount that was allocated for the installation of services was sufficient to complete such installations; if not, how much is needed to complete these installations; if so, by when is it envisaged that all the services will be installed;

(3) whether he intends compensating and settling the West bank residents in cash; if not, why not; if so, what are the relevant details? NW4446E

(a) (i) The company referred to paid R1 for the acquisition of the land from the State in 1955.

(ii) R355 500 for 71.1 hectares.

(iii) No funds were allocated by the Department to the Buffalo City Metro for the installation of services as this is the responsibility of the municipality in terms of the Settlement Agreement.

THE MINISTER OF RURAL DEVELOPMENT AND LAND REFORM:

(a)-(b) Since the main focus of the Recapitalisation and Development Programme (RADP) thus far has been on infrastructure development and creating a sense of production discipline with emerging farmers, it is still too early to measure the success and impact of the mentorship programme in respect of commercial viability and productivity.

Please refer to Annexure A for details of all farms under strategic partnerships and mentorship in terms of the RADP.

THE MINISTER OF RURAL DEVELOPMENT AND LAND REFORM:

(1) (a)-(b) Yes.

(c)(i) Yes. Two officials have been charged for alleged corruption relating to the selling of official information / documents from the Deeds Office.

(ii) Yes. Five officials have been charged for alleged fraud. Three cases relate to listing people as beneficiaries in land related claims, whilst they do not qualify. One case relates to a fraudulent drivers licence and one case relates to fraud by making an irregular booking for a car rental and altering the tax invoice received from the travel agent.

(2) (a)-(b) Yes.

(i) (aa)-(bb) Four cases have been finalised; three cases have not been finalised.

(ii) (aa)-(bb) Fraudulent listing of beneficiaries: both officials were dismissed and both cases were finalised within six months;

- fraudulent drivers licence: final written warning; case finalised within four months; and

- fraudulent booking for car rental: dismissal; case finalised within two months.

(3) No. Due to its limited capacity, the Department of Rural Development and Land Reform is currently using the Special Investigations Unit (SIU) to conduct investigations. However, the Department of Rural Development and Land Reform is addressing its internal capacity.

REPLY:

(1)(a) and (b)(i)-(ii) Yes. Government is constantly exploring innovative and sustainable models of sustainable human settlements, particularly in rural areas where agriculture forms the cornerstone of economic development.

(2) The DRDLR has no objections to exploring the model further as it appears to address the issues of social cohesion and development. However, it would be important to further engage the proponents of this model to ensure alignment with the CRDP.

THE MINISTER OF RURAL DEVELOPMENT AND LAND REFORM:

(1) The allegations of fraud and corruption leveled against the erstwhile Eastern Cape Land Claims Commissioner were investigated and the findings of the investigation were that there was no tangible evidence of fraud and corruption. The Forensic Auditors could not subpoena bank records of the officials and therefore this investigation has been prioritised for handover to the Special Investigating Unit for further investigation.

(2) No official was charged as the investigation did not yield any tangible evidence of fraud and corruption against anyone.

THE MINISTER OF RURAL DEVELOPMENT AND LAND REFORM:

(1) Yes, four land claims were lodged in respect of Portion 79 of the farm Palmietfontein in Polokwane.

(a) & (b) On the 11th September 1988, by the Mothapo Traditional Authority;

On the 26th October 1995, by the Mothapo Tribe;

On the 05th June 1995, by the Maboi community; and

On the 20th October 1988, by the Motokolo community.

(c) The claimants are the Mothapo Traditional Authority, Mothapo Tribe, Maboi community, Motokolo community. The claims appear to be competing, and are all still being researched.

(2) The Commission on Restitution of Land Rights does not have information on whether the current landowner was informed of the claims. The claims are still being researched and have not yet been accepted by the Commission nor published in the Government Gazette.
