b) Yes, the Department of Correctional Services has adopted a guiding document on utilization of offenders in meaningful work activities, such as painting, fixing of leaking pipes, toilets, showers and taps in order to bring to a conclusion any incomplete tasks resulted from the lack of external resources.

Yes. The National database consists of Regional Service Delivery Implementation Plans and the Regions use their quarterly reports for progress. The Regional Implementation Plans represent a consolidation of Management Area Service Delivery Implementation Plans. The Quarterly Reports are available of the Management Information Centre.

The Service Delivery Improvement Plan of Correctional Services Department consists of 4 Key Services:

- To improve telephone & switchboard etiquette at all service points

- Manage the payment of bail & fines at correctional centres

- Improve scheduling of visitations to offenders

- Access of service providers and other stakeholders into correctional centres

The framework for implementation is provided by the Department of Public Service and Administration, and is based on the 8 Batho Pele Principles, reflecting the current standard as well as a desired standard. Each of the Regions has formulated their own implementation plans according to their regional specific needs and the report quarterly. The collective spread sheet information form a database of the service delivery improvement plans. The processes are fully operational and are on-going.

Department of Correctional Service Delivery Improvement Plan forms an integral part of the Service Delivery Charter that was launched by the Minister of Correctional Services in March 2010.

Whether the investigation into the escape of the nine inmates from the Westville Medium A Correctional Centre has been completed and finalised as reported in her department's annual report (details furnished); if not, why not; if so, what are the relevant details?

Yes. The investigation was completed on the 16th April 2010.

The investigation found negligence of officials in ensuring that existing security policies and procedures are adhered to.

Disciplinary steps were instituted against 16 officials.

Whether, with reference to her department's annual report for the 2009-10 financial year, an integrated security framework is in place guaranteeing that prisoner escape would be almost impossible; if not, why not; if so, what are the relevant details?

Yes. The implementation of the integrated strategy is aimed at the continuous reduction in escapes and other security risks. Current focus areas include:

· The effective supervision of staff and inmates by managers, not only to ensure adherence to procedures but also to give guidance to staff.

· The strict adherence to security procedures by staff.

· Consequent and disciplinary measures against negligent staff members

· The effective and pro active management of security information in liaison with partner departments in the Criminal Justice System.

· The optimal use of security equipment and systems.

· The transfer of high risk inmates to more secure facilities.

To further strengthen security at correctional centres over the December 2010 festive season the Department has introduced Operation Vala to ensure the safety and security of all staff, inmates and service providers. Special task teams at regions and national has been established to oversee security operations over this period.

The final report of the Ministerial Task Team will be available by end December 2010. However, Minister will in the future make a statement on the findings and solutions to the challenges identified by the team as there are meetings on a month-to-month basis to provide reports.

1. Yes. The new leadership has been appointed. A Centre Level Performance Review will be conducted with effect from January 2011, which will review business processes at centre level and the required process depends on both Regional and National level.

2. (a) The department has embarked on the mid-year review session. The approach to the review is

to align planning, resourcing and reporting processes. The envisaged final products of the

review is the 2011/12-2015/16 Strategic Plan and Annual Performance Plan aligned to:

- 2011/12 Human Resource Strategic Plan

- 2011/12 Master Information Systems Plan (MISP)

- 2011/12 -2015/16 Technology Strategic Plan

- 2011/12 -2013/14 Procurement Plan

The Video Remand project is led by the Department of Justice and Constitutional Development (DoJCD) and other role players involved are Department of Correctional Services (DCS) and the National Department of Public Works (NDPW). Twenty two (22) Correctional Centres have been identified and linked to 47 courts.

What steps has she taken to rectify the situation that led to her department receiving a qualified audit report for the 2009/ 10 financial year?

The department's efforts to deal with the complexities and the depth of the asset management challenges are on course in an effort to achieve a clean audit report, sooner than later by implementing the following measures:

· Submission of supporting documents to Head Office on a monthly basis which has improved the reconciliation of the asset register

· Monthly asset spot checks are conducted by all centres to ensure that all assets are accounted for in the asset register

· Annual asset verification for the financial year 2010/11 will also be conducted to ensure that all assets are accounted for on the asset register

· The department is in the process of appointing 496 interns to be deployed at all Correctional Centres to assist with asset management, with the proposal of allocating the according to Regions as follows;

- Head Office 18

- Gauteng Region 104

- Limpopo, Mpumalanga and North West Region 48

- Eastern Cape Region 81

- Kwa-Zulu Natal Region 84

- Western Cape Region 64

- Free State and Northern Cape Region 97

· Their key performance areas will be:

- Management of the asset register

- Checking the correctness of the location of assets

- Rectification of discrepancies found during asset verification

- Conducting spot checks and compile reports

- Conducting inventory count

- Ensure that assets are bar-coded

· Correction of misallocations of asset categories and values on asset register as identified from monthly asset reconciliations – head office team (consisting of Deputy Director Logistical Systems Management and Training, Assistant Director Logistical Policy formulation and SPAO Asset Management) visited all Regions during the period 28 July 2010 to 10 September 2010 and assisted with actual rectifications on asset register and also conducted on-the-job training. Follow-up analysis of movements on the asset register is conducted by Head Office on a monthly basis and identified discrepancies are brought to the attention of affected Regions for rectification.

· The LOGIS adjustments of the opening balance on tangible movable assets will be finalized after discussions with National Treasury.

· A team led by CFO will visit Regions on month-to-month basis to monitor progress and ensure the implementation of action plan.

· On quarterly basis, the Auditor General performs high level audit to monitor progress

· Quarterly meetings are held with the Minister, Auditor General, National Commissioner and the CFO to evaluate progress.

The National Commissioner was appointed on the annual salary level of Director Generals, which he was already on whilst at Government Printing Works. A discussion between Minister of Correctional Services and National Commissioner took place and an agreement was reached on the salary level. Consultation with the Minister of Public Service and Administration occurred and feed-back was then provided to Cabinet.

Mr J Selfe (DA) to ask the Minister of Correctional Services:

(1) Whether a certain person (name furnished) applied to be examined and treated by a private medical practitioner; if so, when;

(2) whether he was granted his right in terms of section 12(3) of the Correctional Services Act, Act 111 of 1998; if not, (a) why not, (b) why was it necessary for a certain person (name also furnished) to approach the courts to obtain this private medical care and (c) what was the proximate cause for his receiving medical treatment in the first place; if so, what are the relevant details?

(1) Yes. A certain person (name furnished) did apply to be examined and treated by a private medical practitioner.

(2) (a), (b), (c)

Yes the person was granted his right i.r.o. Section 12(3) of the Correctional Services Act, no 111 of 1998. The department does not know what necessitated the person to approach the courts.

However; the person was reluctant to sign the relevant form as he did not agree with Section 3 of the form. After a visit by his member of the family on Sunday; the court was then approached to apply for an interdict for the person to consult his private doctor.

He initially injured his leg against an iron bed and developed a wound which later became septic.

Mr J Selfe (DA) to ask the Minister of Correctional Services:

(1) Whether any formal complaints have been lodged against her department or departmental

officials for wrongful treatment of a certain inmate (name furnished) at Pollsmoor Correctional Centre; if so, (a) what is the nature of the complaint and (b) which officials have been implicated;

(2) whether any action has been taken as a result of the complaint; if not, why not; if so, what are the relevant details;

(3) whether the said inmate was admitted to an intensive hospital care unit in January 2010; if so, (a) what injuries did he sustain and (b) what was the duration of his treatment in hospital;

(4) whether any department officials have been implicated in any way for causing these injuries; if so, what action has been taken against these officials?

(1) and (2) (3) (4) I have received a report that as part of responding to this question that no formal complaint was lodged hence no action. No departmental official has been implicated as there was no investigation.

I have however now given a directive that a new investigation be conducted, despite the absence of a complaint. I am particularly concerned that an incident as serious as this was just simply left unattended and without a proper investigation conducted. A full report will be submitted to my office before the end of November, the details of which will be submitted to Parliament.

(1) Whether the correctional supervision and parole board (CSPB) for the Mdantsane Correctional Centre is functioning; if not, why not; if so, who (a) is its chairperson and (b) are its other members;

(3) how many (a) offenders in the Mdantsane Correctional Centre have appeared before the board since 1 April 2009 and (b) of these were recommended for release on parole?

expensive property in the Western Cape, she or her department has any plans to relocate the

facility to an area where the price of property is lower and the alienation of the current property

would generate revenue that would facilitate the construction of new, more suitable facilities; if not,

why not; if so, (i) when will such relocation process (aa) begin and (bb) be completed, (ii) when will

each such stage (aa) begin and (bb) be completed and (iii) what are the further relevant details?

However, there some access control points which are partially operational as some elements were decommissioned on 01st April 2009 (i.e. turnstile gates, magnetic gate and biometric finger print reader. Other elements such as CCTV monitoring cameras, metal detectors and video recording facilities are fully operational.

2. The access control points have by-pass emergency exit gates for situations such as fires.

(1) (2) (3) (4) (5) Last year I requested a review of the policy guiding the procurement of new facilities through the PPP model. This was with a view of ensuring in the main that a variation of the bids be made to allow for the state to maintain control of the operational responsibility of its core business namely custodial services, offender security, offender management and rehabilitation.

Since then communication has been sent to the bidders regarding the compulsory variation of bids. This process was is at a stage of delicate negotiation with the bidders to finalise an agreement of the variation as well as the bid expiry period. It is for this reason that details relating to the process cannot be given at this stage as this may compromise our position during the negotiations.

I will however be ready to respond to provide details to Parliament once this process has been completed.

(a) Offenders with sentences up to two years incarceration must be considered possible placement under correctional supervision/ day parole/ parole upon completion of the minimum incarceration period. In this regard, the National Commissioner (this authority was delegated to Heads of Correctional Centres) must base the decision regarding placement on a report submitted by Case Management Committee in terms of Section 42(2) of the Correctional Services Act, 1998 ( Act no: 111 of 1998). Offenders in this sentence category are subject to the same considerations as offenders serving determinate sentences longer than two years incarceration, which means that such offenders may not be placed on parole until such sentenced offender has served either the non-parole period stipulated by the court, or if no non-parole period was stipulated, half of the sentence.

(b) In terms of Section 75(7) of the Correctional Services Act, 1998; Heads of Centres have delegated authority to place under correctional supervision and day parole or grant parole to a sentenced offender serving a sentence of incarceration for 24 months or less and prescribe conditions. Such Heads also have the authority to cancel correctional supervision or day parole or parole and alter the conditions for community corrections applicable to such person.

(c) In accordance with Section 73(6)(a) of the Correctional Services Act, 1998; a sentenced offender serving a determinate sentence may not be placed on parole until such sentenced offender has served either the non-parole period stipulated by the court, or if no non-parole was stipulated, half of the sentence.

(a) The current water shortage occurred due to the low municipal supply dam water levels.

These measures include;

· Departmental of Correctional Services has deployed water trucks from other correctional centres, which are utilized to fetch water from Grahamstown and the railway hydrant

· Water tanks have been installed in the kitchen, to provide water for the daily preparing of food. The centre received a 5000 litre water tank and one small water pump from the Public Works Department

(b) Offenders have been transferred to Middledrift, Middleburg, Somerset East, Fort Beaufort and King Williams Town Correctional Centres.

(c) Offenders will remain until they are due for placement on parole or expiry dates.

(1) Yes. The investigation was conducted on 17 June 2010 and finalized 30 June 2010. The findings indicated negligence of some officials and managers in applying existing security measures played a role in the escape of the two inmates.

(2) The disciplinary action has been taken against the officials and is in process of finalization.

(3) Yes there was an escape (a) February 2000 (b) one escape (c) security measures were then intensified.

(4) Only one inmate was re-arrested. The other two have not been re-arrested. The escape and detail of other escapees was reported to the South African Police Services and there has not been any re-arrests yet.
