1. (a)(b)(a)(b) There are no new Remand Detention Centres being built. However, eleven (11) existing centres have been identified to accommodate remand detainees across the country and the migration of Awaiting Trial Detainees to the identified eleven (11) centres has been completed with the exception of Potchefstroom Correctional Centre.

1.Whether the occupancy rate of Kokstad Maximum Correctional Centre is 100% or higher; if not, (a) what is the occupancy rate, (b) what is the reason for this; if so, (c) what is the exact occupancy rate? NW 2676

REPLY

(1)(a) No – the centre is currently at 34.93 % occupied.

(b)The Centre has approved cell accommodation (bed space) for 1440 offenders and with unlock on the morning of 29 October 2009 the physical total was 503 offenders. This represents an occupancy level of 34,93 %.It should be taken into consideration that although Ebongweni Correctional Centre has approved bed space for 1440 offenders, it will in reality only be able to accommodate approximately 1000 offenders at any given time due to the unique operational procedures and "behaviour modification programme" (offenders are only admitted in the Admission/ Assessment Phase from where they can advance to the Intervention Phase depending on their behavior and cooperation). The fact that there might be space in the Intervention Phase does not necessarily mean that there is bed space available for new admissions in the Admissions/ Assessment Phase. If one considers the reasons for the low occupancy level it effectively implies that the currently utilized bed space is in reality what is available and that the centre is therefore in terms of available bed space actually closer to 90 % occupied. (90 % of usable cells are presently occupied).

Ebongweni Correctional Centre has numerous structure defects such as air conditioners/ ventilation systems in cells out of order; Hot water systems (industrial geysers and heat pumps) not fully operational; serious plumbing defects in cells and ablution facilities as well as on the main line to the sewer works. The extreme weather conditions in Kokstad necessitate these facilities to be in 100 % working condition at all times in order to maintain conducive and humane incarceration conditions. There are for example no opening windows in the cells and all fresh air into the cells, housing units is 100 % dependant on the functioning of the air conditioning/ ventilation system.The Department of Correctional Services has been interacting with the Department of Public Works on both Regional and National levels in order to establish a Mechanical & Electrical as well as a Building & Civil RAMPS (Repair and Maintenance Programme) to address these structural defects and to maintain the very sophisticated and sensitive systems.Although some interim arrangements are being made with DPW to repair / maintain the current occupied areas on a day to day basis the larger area of unoccupied cells are not yet addressed and require the two (2) outstanding RAMPS as a matter of urgency to be activated or the possible intervention of higher authorities.

1. Whether any action will be taken against Mr Schabir Shaik, for violating his parole conditions by playing golf on a Wednesday, which is a violation of his parole conditions; if not, why not; if so, what are the details?

2 Whether the decision and recommendation by the Medical parole board to grant Mr Shabir Shaik medical parole, be forwarded to the Correctional Supervision and Review Parole Board for a review of the decision; if not, why not; if so, what are the details? NW2675E

REPLY

1 Mr Shaik was authorized time from 10h30 to 12h30 on a Wednesday to attend physiotherapy. No formal request was made by Mr Shaik to participate in any kind of sport. The Department has not received any formal complaints alleging a violation by Mr Shaik of his parole conditions.

With regard to the newspaper article of Mercury dated 22 October 2009, no request to play golf or any other request was submitted by Mr Shaik.

Mr Shaik reported on 22 October 2009 at 10h22 to the Community Corrections for his compulsory office consultation. The newspaper article was brought to his attention and an explanation was requested from him. Mr Shaik submitted a statement in this regard wherein he refuted the allegation.

Departmental Procedure requires a written submission from a complainant in order for the matter to be further investigated and if it is evident that the offender violated, the following steps may be taken in terms of Social Reintegration Policy bearing in mind the severity of the offence:

· Written warning

· Final written warning

· Warrant of arrest

Section 70 of the Correctional Services Act, 1998 (Act No. 111 of 1998), sets out the procedures to follow in instances where there has been non-compliance by a parolee with his or her parole conditions. In terms of the Act, the National Commissioner must investigate any alleged non-compliance and based on the nature and seriousness of the non-compliance a parolee may be reprimanded or be instructed to appear before the Parole Board which imposed the community corrections or a warrant may be issued for the person's arrest. Such a person will then be brought before a court which shall decide whether he or she must remain in detention or whether to refer such a person to the Parole Board to amend his or her conditions of parole. The power to investigate non-compliance with parole conditions has been delegated to the branch dealing with community corrections within a specific region.

2 We have no evidence that the Doctors erred in their recommendation, nor that the Correctional Supervision and Parole Board (CSPB) erred in their decision. Should such evidence be provided, the Minister, National Commissioner or Inspecting Judge can refer it to the Parole Review Board (PRB).

(2) (a) The South African social Security Agency (SASSA placed advertisements in newspapers and magazines. The advertisements were in respect of tenders, vacant posts (recruitment) and creating public awareness about policy developments / legislative amendments to the Social Assistance Act of 2004, in relation to age equalization, lowering the eligibility age of men for old age pension to 60 years, progressively phasing in the legislative amendment and the extension of the age eligibility for the Child Support Grant from 14 to 15 years.

(i) The total amount of advertisements that appeared in the print media are as follows: Human Capital Management total of 128, Supply Chain Management total of 36 and Communications and Marketing a total of 4 as specified in Annexure A.

No advertisements were broadcasted on either the radio or television. SASSA was, however, on several occasions invited to partake on SABC and radio educational programmes, without any financial implications.

(b) The cost of each advertisement is specified in the attached Annexure A.

(c) The purpose of placing advertisements varies in relation to the issue/s as listed in the attached Annexure A, albeit.

Recruitment – Advertising was done in respect of vacant posts for the purpose of ensuring that as far as possible a broad pool of potential applicants is reached and providing equal opportunity for employment within the Public Service as required by legislation. In addition the objective was to optimally capacitate SASSA in terms of its critical service delivery areas. In this manner, SASSA could ensure continuity of service delivery and the execution of its mandate.

Social grant awareness – The advertisements linked to social grants were educational and specifically aimed at creating public awareness about the services rendered by the South African Social Security Agency, recent policy development specifically the age equalization, progressively lowering the eligibility of men for old age pension to the age of 60 years and the extension of the child support grant from 14 to 15 years of age.

Tenders – The advertising of tenders was in sync with government's general procurement guidelines and SASSA's own Supply Chain Management Policy. The objective was to ensure greater exposure to potential bidders and ensuring that potential bidders have reasonable access to procurement opportunities.

REPLY:

l(a) During the 2008109 financial year, the DST spent a total of R10, 7 million on advertising against a total budget of R10, 9 million. This total amount spent amounts to 4% of the total operational spending of the Department for the 2008109 financial year. Of the R10,7 million spent, 6% was paid for recruitment advertisements (R623 thousand); 6% was paid for tenders advertisements (R623 thousand); 9% was paid for advertising relating to gifts and promotional items (R949 thousand); and lastly 79% was spent on advertising relating to marketing expenditure (R8,5 million).

During the current year, as at 31 October 2009, the Department has spent a total of R3, 4 million on advertising against the total budget of R5, 6 million.

Of this R3,4 million, 5% was spent on tenders advertisements (R171 thousand); 7% was spent on advertising relating to gifts and promotional items (R221 thousand); 15% was spent on recruitment advertisements (R510 thousand); and 73% was spent on advertising relating to marketing expenditure (R2,5 million).

1(b) PUBLIC ENTITIES

The Human Science Research Council (HSRC)

The HSRC spent R1, 516,686.16 in 2008109 and R782, 923.27 in the 2009110 financial year (See annexure A for detailed information).

The Council for industrial and Scientific Research (CSIR) Expenditure for the CSIR in the 2008109 financial year was R920 090.97, which is inclusive of ail advertisements placed In the media for recruitment, marketing, tender notices and some online marketing. No radio and television ads were placed during this period.

In the 2009110, the CSIR expenditure from April - October 2009 is R563 288.72.

The Tshumisano Trust

The Trust's expenditure on advertising for the 200812009 financial year amounted to R75 183 00 out of a R80 000 00 budget. in the last financial year to date, the actual budget was R70 000 and R68 000 has so been spent for advertising.

The Africa Institute of South Africa (AISA)

The institute budgeted R340 288 and spent R200 000 in the 2008109 financial year and has so spent R64 476 out of a R108 338 budget this financial year.

(1) Whether his Department or an agency of his department such as the Public Services Sector and Education and Training Authority (Pseta), has granted a tender of service to a service provider last year; if not, what is the position in this regard, if so, (a) for what type of service, (b) to which service provider, (c) what was the tender period and (d) what was the amount of the tender;

(2) (a)(i) which service provider have received the 25 highest amounts and (ii) what are the amounts in numerical order and (b) how many tenders were awarded to the same service provider in the (i) 2007-08 and (ii) 2008-09 financial year;

(3) (a) what is the composition of the internal tender committee, (b) what are the names of the internal tender committee members and (c) how many tender committee members declared interests in any service provider during the process;

REPLY:

(1) The Department of Public Service and Administration has awarded a total number of 11 tenders to service providers rendering services to the department in the last year. There was, however, no tenders awarded by Pseta as most of the procurement requests fell below the tender threshold of R500 000 per request thereby procured through quotation process.

(2) (a) (i) No service providers have received the 25 highest amounts.

(ii) There are no amounts involved, as there were no service providers who received the 25 highest amounts

(b) (i) No tenders were awarded to the same service providers

during 2007-08

(ii) No tenders were awarded to the same service providers during 2008-09

(3) (a) The Department has two internal tender committees, which are the

Bid Evaluation Committee and Bid Adjudication Committee. The Bid Evaluation Committee is not a fixed committee, the composition of the committee is amended in terms of needs of the Department, whereas, the Bid Adjudication Committee is a fixed and permanent committee that is cross functional of members from different directorates within the Department. It is therefore not easy to report on members of the Bid Evaluation Committee as it changes from one functionality or need to another.

(c) No Bid Evaluation and Bid Adjudication Committee members have declared interests in any service provider during the process.

4. None of the committee members recused themselves during tender processing meaning none of the members had any conflict of interests to declare.

5. Yes, all relevant regulations are constantly being adhered to in the prevention of corruption however there's always room for improvement. And in addition, we will soon be launching the Public Service Integrity Management Framework to address these issues.

REPLY

The Economic Development Department (EDD) has budgeted R600, 000 for advertising, mainly for recruitment and tender advertisements. No disbursements have been made and no advertisements have been placed.
