Mr KS Mubu (DA) to ask the Minister of International Relations and Cooperation:

1. Whether all offices / sites / entities of the department adheres to the Occupational Health and Safety Act; if not (a) why not, (b) which facilities failed to adhere to the Act, (c) where are they situated, (d) what aspects of the Act did each facility not comply with and (e) what action was taken in each regard?,

2. How often should each facility be inspected and when last was each facility inspected?

REPLY

1. Yes, In terms of International Law, the Occupational Health and Safety Act is not enforceable at our missions abroad. Missions must follow health and safety rules and regulations applicable in the host country.

2. Facilities are inspected by both the Department and the Private Party operating the facility on a monthly basis. A detailed inspection took place during the fist two weeks of September 2009, prior to the commencement of relocation into the new premises. An independent Certifier was furthermore appointed to certify the buildings' compliance with Occupational Health and Safety, prior to relocation.

REPLY

(1) Yes, there are plans to develop and implement a policy based on the National Vetting Strategy by the end of the financial year (2009/10).

(2) Yes, only at executive level through NIA. However the department is in the process of putting mechanisms in place to ensure that pre-employment screening of potential employees for criminal records is done to specific identified posts.

(4) In terms of records based on the info provided on application forms, the department does not have any employees with criminal records.

REPLY:

(1) The Department of Higher Education and Training is not fully functional as yet and make use of resources of the Department of Education. Except for, Ministerial Staff and the Director-General no official appointments have been made in the Department of Higher Education and Training.

2. A policy providing guidelines for the appointment of persons with criminal records is currently under development and will be functional as soon as the Department starts to advertise and fill posts.

(3) Not applicable at the moment.

1589. Mr S Motau (DA) to ask the Minister of Energy:

1. Whether any steps are being taken to reduce electricity theft and illegal connection of electricity; if not, why not; if so, what are the details?

2. Whether there is any cooperation between the department, Eskom and the municipalities to reduce and prevent electricity theft; if not, why not; if so, what are the relevant details?

Response

1. Yes, Eskom has an intensive energy losses management programme (ELMP) in place to deal with non-technical losses such as electricity theft and illegal connections.

The strategy aims to:

· arrest the energy losses trend

· establish acceptable level at which losses should be managed as an inherent risk of the business

· manage the trend to that acceptable level

· improve current energy loss management practices

· ensure operational sustainability at an acceptable level of energy losses

o Eskom conducts revenue protection audits, where customer metering installations are inspected to detect theft or faults. Where faults are found the meter is replaced and where tampering (theft) is detected the customer is disconnected and will only be reconnected after a tamper fee and reconnection fee is paid. The tamper fee is increased for customers who are found to have tampered with their meter more than once.

o In addition, Eskom has an annual target in place to audit 33% of all Large Power Users and 20% of all other stakeholders each year. Where illegal connections are detected, they are removed because these do not only pose a revenue loss risk; they are also a safety hazard.

o Eskom has and continues to invest in a public communications campaign which is aimed at driving behavioural change. This also influences the voluntary behaviour of consumers to use electricity legally and by mobilising citizens to report and prevent illegal connections. This builds and maintains good relationships with key stakeholders to enable Eskom to implement and drive the Energy Losses Management programme within communities.

2. Yes Eskom is working very closely with the municipalities and other stakeholders such as the AMEU, SARPA (South African Revenue Protection Association), and Energy Efficiency NERT to reduce energy losses.

This is done as a combined stakeholder engagement process in terms of dialogue and negotiations.

In addition Eskom is working closely with the Department of Energy and Department of Water and Environment on the Operation Gcina Amanzi - a project to address the issues of basic services such as water and electricity.

REPLY

Correctional Services events are essentially meant to mark critical milestones in the delivery of services and to communicate these service delivery achievements in order to inform, educate and mobilise the public and stakeholders to join hands. Yearly the Department has a series of events that include standing milestones like – opening of new / revamped facilities, observed days, interface with the public and stakeholders (izimbizo) and launch of various services. In 2009 the intensity, scope and expenditure on events were significantly scaled down because of austerity measures instituted to address financial challenges. A major example is the flagship Corrections Week Campaign which costed up to R2.4million in 2007, but had no budget for a single advertisement (radio, TV or newspaper) nor posters / banners in 2009. Other examples include the cancellation of the National Aids Day event, stakeholder's conference, offender choir competition and national Corrections Excellence Awards. This response focuses only on national events and is not exhaustive as providing every detail would require significant investment of time.

REPLY

(1)(a)(i)(ii) The Department of Correctional Services' Post Advertisement and Recruitment Policy was formally approved and implemented as from 15 October 2003. The Department also provides guidelines for the appointment of persons with a criminal record within the Departmental A-Order. In terms of this policy candidates are informed when applying for a post that reference checking will take place. Candidates with criminal records must state the nature of the criminal offence. No person can be appointed with criminal record unless the offence has been disclosed and subsequently condoned by the National Commissioner. The nature of the offence and incarceration must not compromise the department and be in contradiction with the relevant functions of the post and day to day operations of the Department. The Department is in a process of reviewing and realigning all policies including this policy. A reviewed policy will be presented to the Minister for approval in 2010.

(b) A copy of the policy can be obtained from the Office of the Commissioner: Cape Town.

(2) Please refer to the answer in (1)(a) above.

(3) Yes, the Department does pre-employment screening of potential employees in line with the Minister of the Department of Public Service and Administration's directive according to Public Service Regulation 2001, Chapter 1, part VII D.8(a). This deals with the verification of a candidate's information prior to appointment or filling of a post. The directive took effect on 1 January 2008 in all Government Departments.

Personal Suitability Checks are conducted on all recommended candidates prior to appointment and the verification comprises of the following: Criminal Record checks, previous employment verifications in terms of reference checks, Qualification/study verification, Financial/asset record checks; and, Citizenship verification.

Any negative information (such as Criminal records) received back from NIA, will be documented and forwarded to the Commissioner for consideration and condonation.

(4) The officials employed in the Department with criminal offences are from salary level 3 up to salary level 15 and also covers across the spectrum of the different Occupational Classes of Correctional Services.

(1) Whether his department developed and adopted a policy providing guidelines for the appointment of persons with a criminal record; if so, (a) when was the policy (i) developed and (ii) adopted and (b) where can a copy of the policy be obtained; if not,

(2) whether his department has any plans in place to develop and adopt such a policy; if not, why not; if so, what are the relevant details;

(3) whether his department does any pre-employment screening of potential employees for criminal records; if not, why not; if so, what are the relevant details;

(4) whether any employees with criminal records are currently employed by his department; if so, (a) how many and (b) what is their (i) job level and (ii) occupational category?

REPLY:

(1) The Department has not developed and adopted a policy providing guidelines for the appointment of persons with a criminal record.

(2) The Department intends to develop a Property Check Policy that will complement the Recruitment and Selection Policy, and this will also address the issue of criminal and credit records, among others. This policy will be aligned with any directives provided by the Department of Public Service and Administration in this regard.

(3) The Department conducts prescreening for all potential Senior Management Services (SMS) members. This pre-screening involves a security clearance by the National Intelligence Agency (NIA). For non-sms members the Department relies on the information required on the Z83 form with respect to declaration of criminal records. In addition, during interviews, all interviewees are asked to declare issues such as outstanding disciplinary hearings and criminal records.

(4) (a) According to the screenings done by NIA on SMS members, the Department has one staff member with a criminal record.

(b) The person is (i) at level 13 and (ii) the occupational category is director.

REPLY:

In order to reply to this question, requesting information dating back to 2006, requires extensive research of not only the financial reports but also all supporting documents to analyse the approvals of all events hosted, the individual approvals of travel and accommodation, as well as the individual invitation to all guests to all events.

(1) No. The Department of Basic Education does not, as yet, have a policy providing guidelines for the appointment of persons with a criminal record.

(2) A policy providing guidelines for the appointment of persons with criminal records is currently under development and will be functional as soon as the Departments has satisfied itself with the legal aspects around it.

2 550. Mss AT Lovemore (DA) to ask the Minister of Water and Environmental Affairs:


(1) With reference to her reply to question 323 on 18 September 2009, which wastewater treatment works are operating without departmental authorisation;

(2) what measures are in place to ensure that discharges have no negative impact on the receiving environment;

(3) what action is taken when works continue to operate in spite of (a) not complying with infrastructural requirements and (b) not having adequate capacity to process the waste water volume and load;

(4) what action is taken in cases where the municipality has demonstrated an incapacity to compile the required application and authorization documents? NW1956E

REPLY:

(I) The Waste Water Treatment Works (WWTW) operating without authorizations are attached. Please Click here Annexure1.

(2) My Department has set monitoring points upstream and downstream from all discharge sites and monitors them on a monthly basis. All Water Users are required to submit the monitoring results monthly however; My Department conducts regular monitoring to ensure protection of Water Resources. All Waste Water Treatment Works have to comply with the effluent discharge standards as set in Government Notice (GN) 991 of I8 May 1984.

(3)(a) The owners of Waste Water Treatment Works (WWTW) are advised about the infrastructural requirements, such as layout and design and optimal operation and maintenance of the treatment works.

(3)(b) My Department advises owners of the WWTW to upgrade the system or to construct another bigger facility that will be able to handle more volume, load and quantity.

(4) My Department does assist all municipalities which do not have capacity to compile Water Use applications and authorisation documents.
