Reply:
(1)(a). The former Registrar of Labour Relations is not reinstated to his full task because the Labour Court decision has been appealed to the Labour Appeals Court.
(b). There is no need for the Deputy Registrar to be reinstated because her status has never been revoked at any point.
(2)has she complied with the court action regarding the Registrar of Labour Relations; if not, (a) why not and (b) what are the further relevant details in this regard; if so, what are the relevant details;
Minister of Labour replied:
(2)(a). Because the Labour Court decision is suspended pending the outcome of the appeal lodged with the Labour Appeal Court.

How does she intend to improve the processing rate of (a) corporate and (b) individual (i) work permit and (ii) general visa applications which is at only 53% in some cases according to her department’s 2014-15 annual report?
Reply:
The Department made an assessment on a number of factors that were contributing to delays in processing of recommendations to the Department of Home Affairs on corporate and individual work visa applications. The Department is not responsible for recommending approval of general visas to the Department of Home Affairs.
To improve the processing of corporate and individual work visas applications we have put the following measures in place:
• We have advised and secured approval from Department of Home Affairs that Sports, Arts, Culture and Religious applications will no longer be processed by the Department of Labour as from 01st April 2015.
• We have publicized guidelines on our website for corporate and individual work visa applicants to check requirements before they submit applications to the department.
• We trained staff in our Labour Centres not to accept any applications that are incomplete or are not corporate or individual work visa related.
• Applications submitted by employers found to be non-compliant with our labour laws will be negatively recommended immediately on receipt of inspector’s report.
• We set a target of 30 working days within which we are going to process applications.
• As from 06th June 2016 we intend testing and piloting a new on-line system for the submission of applications.
• At Head Office, the adjudication committee meets every Friday of the week to review and finalize documentation received from Provincial Offices and to make a final recommendation to the Department of Home Affairs.

The officials that accompanied the Deputy Minister were from the following Branches: International Relations, Public Employment Services, Compensation Fund, Unemployment Insurance Fund and Deputy Minister’s Office. The Department has tabled its 2014/2015 Annual Report to Parliament, the Honourable member may get a copy from the Clerk of Papers.
The focal areas for cooperation were inter alia:
Youth employment approaches; Strategic issues relating to Employment Services provisions; Models for Compensation to injured workers; unemployment Insurance benefits; Job Creation initiatives and Technical exchange programmes.
The details of the Memorandum of Understanding are the same as the areas on which the two Countries shared experiences as mentioned above.

Has her department taken a decision on whether a national minimum wage will be put into place or not; if not, why not, if so, what are the relevant details?
Reply:
The Labour Relations Indaba convened by the Deputy President under the auspices of the National Economic Development and Labour Council (NEDLAC) adopted a Declaration on 4th November 2014. The Declaration contained a number of principles that the constituencies, including government, agreed would guide the work that has been taking place in NEDLAC since then.
One of the principles agreed to was to engage on the modalities of introducing a national minimum wage in South Africa. The election manifesto of the ruling party, the African National Congress, also pledges to investigate the modalities for the introduction of a national minimum wage as one of the key mechanisms to reduce income inequality.
The Department of Labour does therefore not have to take a decision on whether to introduce a national minimum wage. This is both a decision of the current administration and one that has been agreed with our social partners.
It is in relation to the modalities of a national minimum wage, including the level at which it is to be set, that the Department is now working towards a recommendation that will be made to the rest of government.

The Government has policies and programmes on economic empowerment which all Departments should implement, the Department of Labour policies and programmes are derived from those of National Government. With regards to Ministry of women, there is no collaboration at this stage.

Whether, she has found that the statement of the Chief Director of Labour Relations, Mr Thembinkosi Mkalipi, that if there is evidence that there are serious job losses due to the amendments of the Labour Relations Act, 66 of 191945, her department will have to look at the matter, although he is not sure whether that will fly politically, (a) constitutes political interference and (b) will contribute to the destruction of job creation; if not, why not in each case ; if so, will she make a statement on the matter?
Reply:
Prior to the introduction of legislation and legislative amendments, the Department assess the socio-economic impact of legislation, including its impact on jobs and the labour market. This was done in respect of the amendments to the Labour Relations Act through a regulatory impact assessment conducted in 2010.

Reply:
The discussions around a national minimum wage are currently taking place at NEDLAC where social partners are negotiating the modalities of the national minimum wage. In addition, a number of research projects are currently underway to inform this debate. It would therefore be premature to speculate on the level or modalities of this proposed national minimum wage.

The Annual Report of the Department that I tabled during September 2015 provides information on the expenses incurred by the Department including travelling and accommodation both locally and abroad by all our officials. The Auditor General audited all this information. The Annual Financial Statements format did not however allow us to provide a breakdown of this information in the manner that the Honourable member requires.

MINISTER OF LABOURS RESPONSE:
No, I will not consider abolishing Affirmative Action (AA), in the Public Service as the Affirmative Action is not a Public Service Sectoral Determination but a National dispensation. If the Public Service is broadly representative, that should be an inspiration to other sectors and not the reason to abolish the policy.
The preamble of the Constitution sums up the constitutional rationale of the need for Affirmative Action.

The Deputy Minister of Labour, Honourable SP Holomisa led a delegation consisting of eight (8) senior officials of the Department of Labour to China, once during 2014-15 financial year.
The visit to China was to finalise focal areas of cooperation in terms of the signed Memorandum Of Understanding with China.

Reply:
The claim has been processed and a total temporary disablement (TTD) of 75% amounting to R69 278.91 has been approved and authorised for payment. The Compensation Fund is busy capturing the permanent disablement (PD) pension of 60% which he will receive for the rest of his life. The client’s pension will be paid in arrears from the date of stabilisation.
In addition the Compensation Fund has accepted liability meaning all medical costs associated to this claim will be borne by the Fund.

I have no plans to set up a forum of the nature suggested by the Hon Member. Matters relating to supply of skilled labour in the country are dealt with in the National Skills Authority established in terms of the Skills Development Act and the Human Resources Development Council and chaired by the Deputy President.

Reply:
- The Department conducts regular advocacy campaigns with employers to discuss the services we offer and to assist them to comply with our Labour Laws and we will continue to conduct such meetings.
- During the 2014/15 financial year, the 128 Labour Centers conducted more than 500 advocacy campaigns across the country with employers and work seekers on opportunity work seekers and employment opportunity registration, counselling, recruitment and selection and placement sessions.
- In instances where a registered work seeker is matched to an employment opportunity, a referral letter is sent to the employer wherein they are requested to advise the Department on the placement status of the candidates. And we are aware that some of them are very busy to respond to such letters.
The Department intends to reduce administrative burden on employers through integration of our Employment Services and Unemployment Insurance Fund systems and developing new placement tracking tools to verify the placement status of the referred candidates.
2. The Department is involved in various Employment initiatives.
- The Unemployment Insurance Fund through its Labour Activation Programmes has partnered with the various SETAs to successfully train and place unemployed work seekers as both artisans and skilled employees in various job opportunities.
- The UIF also provides funding to the Industrial Development Co-operation (IDC) for the purposes of stimulating employment opportunities.
- Productivity South Africa assist various businesses with turnaround solutions that contribute to prevention of job losses and or improving efficiencies that can stimulate further job opportunities.
- We also provide funding to assist companies to embark on Training Lay-Off schemes to avoid retrenchments in those instances wherein companies are restructuring.
- We provide employment to people with disabilities through the 12 (Sheltered Employment Factories) Supported Employment Enterprises and also provide subsidies to workshops for the blind and deaf, and disability organisations that assist us in placement of such people in formal employment.

Reply:
- When Labour inspectors find that an employee does not have a valid work permit, the matter will be reported to Home Affairs who has jurisdiction over such matters.
- The Department of Labour does not have a legal mandate or powers to remove such employees from the workplace but will refer the matter to Home Affairs to take further action.

Reply:
(a) Yes. We have put together a plan that aims to address the basic bottlenecks in service delivery and sound financial management. It entails focusing on improving the financial administration, improving the levels of customer service in the Fund, addressing human resource constraints in the Fund.
(b) This is to be achieved by addressing the system deficiencies that prevent performance of basic financial management functions, improving access to benefits for clients though a number of initiatives which include easing the process of access to chronic medication, filling the critical vacancies required in the adjudication of claims and addressing all systems problems that contribute to slow rate of processing claims.

(a) The Department of Labour does not have a planning model for the inspection of valid work permits as this is a legislative responsibility of the Department of the Home Affairs and South African Police.
(b) In its normal work aligned with granting of work permits the Department of Labour mere conducts inspections at work places to determine compliance with prescribed conditions of employment. Furthermore the Department notifies the Department of Home Affairs should it discover employees without valid work permits.
