Is there a backlog with respect to any of his department’s (a) essential, (b) major and/or (c) other projects; if so, (i) which projects are affected and (ii) what are the full reasons for the delay in each case?

Reply:

1. Yes, the Department has identified and programmed backlog in the area of construction infrastructure projects deemed essential to be cleared year on year basis.

2. Definition of backlog:

Backlog in terms of infrastructure projects is defined as a number of projects that remained on planning phase for a period exceeding two years after issuing of procurement instruction and construction projects on construction phase for a period exceeding two years of construction period.

3. Essential and/or Major

The department has no classification of projects. It works according to prioritisation from client departments. Statistics of backlog are as follows:

3.1 Projects on planning stage for 2016/17

  • Planned Maintenance = 432
  • DPW Capital = 172
  • Client Capital = 530

Total = 1134 (Annual target was 15% of 1134)

(a) Performance reported in 2016/17 was 159 representing 14% of 1134. That implies that 94% of the annual target was achieved.

(b) Annual target for 2017/18 remain 15% (146) of the 975 remaining backlog in line with availability of budget from clients for the construction phase.

3.2 Projects on Construction Phase for 2017/18

  • Planned Maintenance = 24
  • DPW Capital = 3
  • Client Capital = 17

Total = 44

4. The annual target for 2017/18 is 75% (32) of 44 backlog projects identified and programmed.

5. Backlog projects in construction phase is caused by under-performance of contractors appointed for execution of the work, heritage compliance requirements, litigation processes, contract disputes and subsequent cancellations. Normal process of sourcing the replacement contractor had to be followed without deviation. In terms of CIDB regulation the department can only initiate the appointment of a replacement contractor after six months of cancellation. This waiting period contributes to backlog statistics.

6. These challenges will be addressed by the infrastructure delivery management system (IDMS) which the department is in the process of institutionalising and establishment of pre-approved panels of contractors and consultants.

7. Please find attached hereto a list of projects identified as infrastructure backlog of projects in construction phase for 2017/18 and projects that were on planning phase in 2016/17 and full reasons for the delay in each case.

What is the total number of police stations in the country that have closed-circuit television (CCTV) cameras installed in their Community Service Centres; (2) by what date will all police stations have CCTV cameras installed in their Community Service Centres?

Reply:

1. Over the years, on an ad-hoc basis according to individual needs, at least 88 police stations had Closed-Circuit Television (CCTV) cameras installed in their Community Service Centres (CSC), of which 12 are operational and 76 have reached the end of their lifespan and need to be replaced.

(2) The recently drafted Security Protocols at Police Stations Action Plan, addresses the issue of CCTV in the CSC’s. Depending on the budget allocation, as well as awarding of the CCTV contract, it is envisaged that there will be sites prioritised for implementation annually, from 2018 until 2024. Prioritisation of police stations will be made in consultation with provincial commissioners.

Reply:

1. According to our database, we do not have any records of land claim lodged on the farm Haakdoornkuil 323 KR and the Office of the Regional Land Claims Commissioner: Limpopo received a land claim lodged by Kekana Matsobane Petrus on behalf of Motekwana Community on the farm Klipfontein 322 KR.

The said land claim was received on the 20th of November 2014, such land claims are not being processed due to the outcome of the Constitutional Court ordered that the claims that were lodged between 1 July 2014 and 27 July 2016 are validly lodged, but it interdicted the Commission from processing those claims until the Commission has finalised the claims lodged by 31 December 1998 or until Parliament passes a new law providing for the re-opening of lodgement of land claims. Parliament was given until 27 July 2018 to pass such a law.

Reply:

1. Yes, the department keeps repositories of data on municipal performance, capacity, viability and sustainability

(a) Various units in the department contribute to the repositories, based on their specific areas of responsibility, e.g. financial information, public participation, MIG spending, service delivery protests, and the appointment of section 56 employees.

(b) (i) information is consolidated into excel spreadsheets;

    (ii) annually as it becomes available.

2. No, the information is not accessible to the general public through an open application programming interface;

(a) The department is still working on designs for such an open interface and is collaborating with National Treasury, DPME and StatsSA in the reporting reforms project to reduce the reporting burden of municipalities in this regard.

(a) A total of 775 PLAS land parcels were leased since inception. From the total of PLAS land parcels leased (775), 730 land parcels have lease agreements with the option to purchase.

1. Any resolution taken by the Funds for payment of an ad hoc bonus in line with the Rules of the Funds will be considered for approval. There is no provision in the Rules of the Transnet Second Defined Benefit Fund and Transport Pension Fund (”the Funds”), that limits the number of bonuses payable. Ad hoc bonus payments are subject only to affordability, as certified by the Funds’ actuary. The payment of an ad hoc bonus is initiated by the Funds.

2. All requests from the Funds for approval of any ad hoc bonus payment are considered in a timely manner.

The specified person reached the age of 60, on 12 November 2016, but was employed on a contractual basis, for a period of seven years, following his appointment, on 10 September 2015, as the National Head of the Directorate of Priority Crime Investigation (DPCI), by the former Minister of Police.

a) The Commander of the Family Violence, Child Protection and Sexual Offences Unit (FCS), including four other members were dismissed in December 2016. Subsequently, Lieutenant Colonel Tantsi has been appointed as the Acting Unit Commander. The post will shortly be advertised, for the appointment of a permanent unit commander.

  • In August 2012, the personnel strength of the FCS Unit comprised 16 members, while in August 2017, it comprised 15 members.

b) The comparative staff allocation at Khayelitsha Police Station is as follows:

  • August 2012, the police station was allocated 310 members.
  • August 2017, the police station was allocated 324 members.

c) The policy that was approved by the South African Police Service (SAPS), in 2003, “Release of Crime Statistics: Department of Safety and Security” directs that crime statistics will be released annually. The policy states that, “A fully analysed and contextualised report on recorded crime in South Africa, including inter alia, the national, provincial and area statistics, will only be released and placed on the SAPS’s website, annually (once a year). Prior to its public release, the report will be presented to Cabinet, to inform the latter about its contents. Cabinet will then approve the release of the crime statistics to the public.

However, in 2016, the SAPS approached Cabinet to obtain approval for the release of crime statistics, on a quarterly basis. The process which is followed when releasing quarterly crime statistics, remains the same, i.e. Cabinet approves of the crime statistics to the public.

The SAPS does not intend to release monthly crime statistics, as this would have to be approved by Cabinet.

d) The clearance phase for the Makhaza (Khayelitsha) site, has been completed. The planning and design phase will be completed in the 2018/2019 financial year. Construction will commence and should be finalised within the 2022/2023 financial year.

e) The number of backlog case entries (exhibits), registered but not yet finalised, exceeding the prescribed timeframe at the end of August 2017, nationally is 1 872 of 43 251 entries.

It needs to be noted that, blood alcohol and other relevant toxicology-related analyses, are performed by the Department of Health and are therefore, not included in the above statistics.

There is no shortage of DNA reagent kits, for analysing DNA samples. However, there is currently a shortage of DNA buccal sample collection kits, which are used to collect buccal samples from persons arrested and charged for schedule eight offences, in accordance with the DNA Act.

(2) and (3) The Forensic Science Laboratory had one functional Genetic Sample Processing System (GSPS), which was installed in 2006, for DNA analysis in the Biology Section, Arcadia. The GSPS reached the end of its life cycle, several years ago and is no longer utilised. The GSPS equipment was decommissioned, due to old technology and unavailability of maintenance/service by service providers. The GSPS has been replaced with semi-automated DNA analysis equipment, to analyse crime scene and buccal samples. The semi-automated equipment is proving to be very effective and is significantly more cost effective than the GSPS.

The department and its group of entities procured a variety of goods and services over the past 5 years, ranging from leasing accommodation, consultant services, travel and transport, ICT related goods and services etc. The quantum of these individual transactions run into the thousands on an annual basis, for example the department alone processed an approximate 6,805 transactions during the last 12 months. The same can be said for the entities.

Goods and services are classified in accordance with its SCOA classification or on the nature of the goods and services procured. This information is reported in the Statement of Financial Performance in the Annual Financial Statements of the department and the entities.

Goods and services are procured using the Preferential Procurement Policy Framework Act and Regulations. The Regulations prescribe the preference points that can be claimed in accordance with the BEE status level of the supplier. This approach is a scorecard approach rather than purely an ownership approach.

Prior to 1 April 2016, goods and services were procured from suppliers registered on the departments own supplier database. With effect from 1 April 2016, National Treasury has implemented the Central Supplier Database (CSD) that has made it compulsory for government entities to use only suppliers registered on this database. The CSD maintains data on expenditure categories and supplier information.

The Municipalities which are affected are, Moretele, Cederberg, Mahikeng, Theewaterskloof, Ekurhuleni, Westrand, Mamusa, Randfontein, Amahlathi, Ngwathe, Modimolle, City of Cape Town and Greater Tubatse.

The councillors will be paid immediately upon resolving their tax challenges with SARS and submit a proof thereof.

(a) The Department of Environmental Affairs did not approve the environmental impact assessment in this instance, as it is not the Competent Authority for this type of activity/ies under the current regulatory regime. If the application was lodged under the 2014 Environmental Impact Assessment Regulations, the application may have been processed and approved by the Department of Mineral Resources, in which case the Department of Environmental Affairs would become the appeal authority.

(b) Given that the Department of Environmental Affairs was not the issuing authority in this instance, it cannot comment on “whether the principle of public participation has been applied to give the surrounding communities a chance to voice their opinions and input and assist the executive in making the decision”. However, the surrounding communities may appeal a decision granted by the Competent Authority to the Minister of Environmental Affairs if they are dissatisfied with

(a) What system is currently in place pertaining to patient file management in (i) public hospitals and (ii) clinics and (b) how does this system work?

Reply:

(a) (i) Each Provincial Department of Health has a Patient Records Management system that includes the management of Patient Files in public hospitals. Most public hospitals are using a paper-based patient file management system with the file number linked to the Patients Date of date of birth.

(ii) As from 2015 the National Department of Health in partnership with Provincial Departments of Health has implemented a system to standardise the patient file management system and patient administration in 540 primary health care facilities in the NHI Pilot Districts. Provincial Departments of Health are in the process of expanding this to primary health care facilities external to the NHI Pilot Districts.

(iii) The System consists of the following components:

1. Rationalise the number of Reception areas in the facility to one reception area;

2. Installation of Bulk Steel Filing Cabinets that can lock and are compliant with the minimum standards for the safe storage of documentation and allow for the fast retrieval of files;

3. The Department of Health has developed an electronic software that allows for a computer-generated Patient Folder number that is Facility Specific, gives the indication of where the Folder should be filed and retrieved in or from the bulk filing cabinet and allows for the Uniform Implementation of the Patient File Management System in the different PHC Facilities;

4. The Department, through an 18-month process of consultation and testing, has developed a Standardised Patient Folder in the form of a Booklet for Patients using PHC facilities. Separate standardised Patient Folders for Male, Female and Children has been developed and has been implemented at facilities.

Reply:

SAA does not have a direct contract with New Age Newspaper for the supply of newspapers. However, SAA has a month-to-month contract with Press Support, which provides for the supply of a variety of readership material including the New Age newspaper to our passengers.

(a) The contract with Press Support in respect of the New Age newspaper costs R165 690 per month excluding VAT. The New Age newspaper supply costs covers Johannesburg, Durban and Cape Town stations.

(b)(i) The contract with Press Support was signed in April 2009.

(b)(ii) This is a month-to-month contract and SAA may terminate the agreement by giving a one months’ notice with no penalties.

(c) The contract provides for general inflationary increase in March/April of every year.

With reference to the under expenditure of R759,7 million in respect of his department’s Programme 4 in the first quarter of the 2017-18 financial year, why have no appropriate and effective steps been implemented by his department to ensure that its target setting and budget forecasting are in alignment with each other, given that his department must be aware of the lengthy verification process involved in the establishment of who the rightful owners of land are; (2) what steps, if any, have been put in place to streamline the process to ensure that prospective claimants are not left waiting needlessly when a budget for the settling of claimant’s claims is available but unspent; (3) what (a) percentage of the lengthy verification process of establishing who the rightful owners of the land are is caused by the lack of urgency, capacity or application on the part of his department’s staff and (b) steps are in place to eradicate such unnecessary delays?

Reply:

1. With the implementation of the new BAS version delays in the processing of payments were experienced. All entities not registered on the National Treasury central database system were not converted to the new BAS version. Suppliers and claimants had to resubmit their banking details in order to process payments. These issues have been resolved and payments are now flowing.

2. Monthly review of expenditure and projections are in place to ensure a streamlined process. Regular meetings with provincial offices to determine the status of projects and the settlement of claims are in place.

3. (a) The Restitution Business is broad and labour intensive. The verification process requires extensive consultation with claimants who at times leave in different areas far apart from each other. Households have also multiplied since the time of dispossession and the verification has to be done in collaboration and in agreement with the community representatives. This process is also intended to prevent fraud in the process.

 (b) The Commission is also engaged through a process of review of its business processes with the intent to find more efficient and effective ways to settle claims.

(a) What are the root causes of the quadrupling of Eskom’s cost of electricity generation since 2007 which translates to an increase of 400% and (b) has she found that this has negatively affected the development and growth prospects of the country, in view of the fact that Eskom generates as much as 95% of the country’s electricity supply and, therefore, plays a critical role in our wellbeing and economic development?

Reply:

(a)

The average Eskom electricity price in 2007/8 financial year was 19.4c/kWh and in 2017/18 financial year it is around 85c/kWh. In nominal terms it represents an increase of 339% over the 10 years. The annual rate of inflation over this period averaged around 5.9%, therefore in real terms the current average price reflects an increase of 148% over the ten years.

It was widely reported in the media ten years and more ago, that Eskom’s price at that stage did not reflect the long run sustainable price. In essence the price mostly reflected fuel and operating/maintenance cost, with very little provision for the cost of the assets. This was mainly due to two reasons: firstly, a 24-year period of annual decreases in real terms in the price of electricity, taking it to a level that was the lowest in the world by a significant margin.

Secondly, the fact that the newest existing assets at that time were already around 16 years old and the average age of the assets much older. Therefore, the cost components of depreciation and cost of capital were inherently low – however at that stage Eskom’s average price had over the 24 years drifted down to a level that did not even reflect the full cost of that relatively low capital.

It is recognised that in the long run the capital-intensive nature of electricity generation and transmission implies that the capital cost usually comprises more than 50% of the total cost of electricity; however in 2007 it was very much lower than that. In addition, with the commencement of the build programme, it became evident that international prices for new power plant had nearly doubled in real terms over the preceding ten years. Hence media reports at the time quoted independent electricity experts that Eskom’s average price will have to treble over the next ten years, to enable Eskom to access the capital required for the new investments – therefore, for Eskom to be able to raise the debt and thereafter to honour the debt commitments in terms of repayment of debt principal and payment of debt interest.

At an average of 85c/kWh including transmission and distribution, Eskom’s current price translates to around 6.3c/kWh in US$ terms – far lower than any comparable international price for a coal-based system, including transmission and distribution, which generally starts at around 9.5c/kWh and higher. Eskom’s average price is therefore still quite competitive internationally and would still be so even after the requested increases, which are required because Eskom’s current 85c/kWh still does not fully reflect a level of prudent and efficient cost, as confirmed by any credible international comparison.

Clearly, electricity intensive industries would prefer lower prices. However if the price is below any credible international reference based on efficient cost, then it implies someone else would have to pay the difference. In the short term the annual revenue shortfall could be temporarily made up with additional borrowing, however in the longer term someone would have to pay to enable such borrowed capital to be repaid, including the interest. Economic theory and modelling conducted by independent specialist economic consultancies have confirmed numerous times that the overall economy would be worse off in terms of growth and job creation if the approach is followed to provide electricity at below its true efficient cost, with the shortfall being made up by the central fiscus thus by taxpayers.

No. Having engaged with the Departments leading in economic policy, planning and assessment; electricity is one of the various factors that potentially have adverse downstream impact on economic development. However, a thorough assessment into the wellbeing and development of the economy requires that a comprehensive assessment be done by the relevant Department(s) and must consider the impact of rising labor costs, electricity, lack of investment, and the structure of the economy among other factors.

b) All land acquired to secure tenure for farm dwellers in terms of Section 4 of the Extension of Security of Tenure Act (Act No. 62 of 1997) and settlement of labour tenants in terms of Section 16 and 17 of the Land Reform (Labour Tenants) Act (Act No. 3 of 1996).
