Mathys, Ms L to ask the Minister of Public Enterprises
Whether (a) she or (b) the Deputy Minister made use of a chartered private jet during the period 1 January 2013 up to the latest specified date for which information is available; if so, what (i) were the reasons for using a chartered private jet, (ii) was the travel route in each case and (iii) did the use of the jet cost her department in each case
Reply:
(b) The previous Deputy Minister, Mr Bulelani Gratitude Magwanishe used a chartered flight during 17 -19 February 2013 together with Deputy Ministers of Rural Development and Land Reform and Minerals Resources and other 17 passengers.
(i) The reason was to engage with community members at Richtersveld on matters relating to the implementation of the 2007 Deed of Settlement. Alexander Bay is in an area that is difficult to get to and the only means of transport to get there are to either drive for distances of more than 600 kilometres in any direction inside South African Borders or fly via Namibia. Given the tight timeframes and the need for the Deputy Ministers to be in Cape Town for Parliament on Tuesday 19 February 2013, it was decided that a charter flight was the most prudent way to travel.
(ii) From Cape Town International to Alexander Bay and back.

Reply:
This response is according to information received from the SOC:
1. Transnet is NOT building a new railway line from Medupi Power Station but is building a 860m take off line into Resgen Mine from Transnet’s Thabazimbi – Lephalale Main Line. Once the take off line is completed, a new 38km railway line into Resgen Mine will be constructed by Resgen Mine in their private capacity.
(b)(i) Yes, with regards to the take-off line into Resgen, Transnet’s RME department conducted two meetings on 17 January 2018 and 14 February 2018 facilitated by the Local Municipality. On 17 January 2018, RME Management met with the Local Municipality Manager and others (details can be provided from municipality). At this meeting Transnet Management presented the Human Capital policies and procedures. They also discussed the work scope and human resources requirements for the take-off line.
(b)(ii) It was agreed that CVs will be handed-in at the Municipality for the local authorities to verify that it is Lephalale people applying and not “outsiders”. Subsequent to a follow-up meeting on 14 February 2018, the Mayor gave a go-ahead and the recruitment process started. Transnet has interviewed all the potential candidates and is now ready to issue Fixed Term Contracts for a month’s duration to all successful candidates.
(2) The local community will benefit from the employment opportunities created as follows:
- 42 x General Workers,
- 2 x Safety Reps,
- 2 x Flagmen,
- 1x Machine Operator.
(3) The specified community is not in any danger of being removed from the Steenbokpan;
(4)(a) Transnet is busy with the preparatory works, i.e. ballast offloading, tamping and regulating.
(b) The construction work will commence as soon as the local community members are given their Fixed Term Contracts, as per 2 above.

(b) (ii) Psychiatric hospitals or the Care and rehabilitation centres do not employ “care workers” as the care, treatment and rehabilitation services are provided by registered health practitioners such as professional nurses, medical practitioners, and the allied practitioners such as occupational therapists, physiotherapists, psychologists, speech therapists and social workers, etc.

Figg, Mr MJ to ask the Minister of Public Works
(1) Whether, with reference to each case of unutilised land referred to in the reply to question 2752 on 6 November 2017, the land (a) is or has been subject to any land claims or land reform programmes and (b) is located in an (i) urban, (ii) peri-urban or (iii) rural area; (2) why has the land remained unutilised in each case?
Reply:
1. (a) The Department of Public Works has been informed by the Department of Rural Development and Land Reform of land parcels within its portfolio that are earmarked for the resolution of land claims. The detailed list of properties under the Department’s custodianship earmarked for land claims is attached as Annexure A.
(b) (i), (ii) and (iii) The location of these properties is indicated in the list of properties attached.
(2) The land parcels have remained vacant, in the main, for the same reasons that vacancy exists in the bigger portfolio under the custodianship of the National Department of Public Works (NDPW). In this regard, and among other things:
- the land in the portfolio is reserved to address future accommodation needs of national User departments, noting that well situated land is a scarce resource; and
- the land in the portfolio is also kept in trust to address other key Government objectives, such as human settlements and land reform programmes in alignment with the requirements of the relevant departments running these programmes;
Notwithstanding the above, the NDPW seeks to let out all unutilised land with the objective of raising income to cover rates and taxes costs and to ensure the properties are secured through use.

Mazzone, Ms NW to ask the Minister of Public Enterprises
(1)What are the reasons that the head office of Alexkor SOC Ltd is situated in Johannesburg when it is a marine diamond company based in Alexander Bay in the Northern Cape; (2) whether Alexkor’s offices in Johannesburg and Alexander Bay duplicate any corporate services; if so, (a) what are the relevant details, (b) why are these corporate services being duplicated and (c) on what statutory grounds are these services being duplicated; (3) whether he has found that Alexkor SOC Ltd is financially secure and will have sufficient funds to continue its operations in the future; (4) whether any marine mining vessels have (a) been grounded and/or (b) not been granted permission to continue work for Alexkor SOC Ltd in each of the past three financial years and since 1 April 2017; if so, (i) why and (ii) what are the further relevant details in each case?
Reply:
Response is based on information received from Alexkor
|
Alexkor, as a result of the Deed of Settlement (DoS) entered into with the Richtersveld Community (RC) has been left with its only asset being the marine diamond mining rights in the Richtersveld.
The marine and land diamond mining have been pooled into an uni-corporated structure called the Pooling and Sharing Joint Venture (PSJV). This is the structure that owns and operates the mine on the Richtersveld.
Thus, Alexkor does not at present have any mining operations. Therefore Johannesburg is the best location while it is seeking opportunities to establish its own operations. The ease of access to mining houses and finance houses makes the location ideal, and this applies to other mining companies located in the city but with operations across the continent.
|
|
||
|
|
|||
2. |
(a) |
No corporate functions are being duplicated.
Although the PSJV is a self-contained entity in Alexander Bay, it is governed by its own Board consisting of three NEDs from both Boards of Alexkor and the RMC (three interim NEDs appointed by the Court on behalf of the RMC), and has its own employees. It is a Joint Venture and is not incorporated, neither is it bound by the provisions of the Public Finance Management Act (“PFMA”). Alexkor is therefore required to maintain a Head Office in Johannesburg to fulfil all the statutory requirements of a State-Owned Company. |
||
|
(b) and |
|||
|
(c) |
|||
|
|
|||
3. |
While Alexkor sole source of income is its share of the proceeds from the PSJV, it will continue to struggle to make ends meet as the PSJV has had challenges with a deep sea mining vessel being damaged and withdrawn from service and the land mining operation not yielding sustainable diamond volumes. At this stage, interest from cash holding is meeting the shortfall; however, a long term solution is being sought including acquisition of mining assets and value addition on current Richtersveld diamond production. |
|||
|
|
|
||
4. |
(a) |
|
The Minister of Public Enterprises has instituted a forensic investigation into, amongst others, the termination of three (3) shallow water mining contractors. The Department will be able to provide further details at the conclusion of the investigation. |

Hunsinger, Dr CH to ask the Minister of Transport
(a) On what date does he intend to implement the Road Freight Strategy approved by Cabinet on 24 May 2017 and (b) why has the specified strategy not yet been implemented?
Reply:
a) The Department of Transport is in the process of developing an Integrated Implementation Plan to heighten the roles and responsibilities of all relevant implementing agencies. This is due to the fact that implementation relies largely on different departments such as DPE, NATIONAL TREASURY, the DTI, TRANSNET, Provinces and Municipalities and the Private sector generally. We have ascertained the different needs of provinces and municipalities towards implementation, areas of collaboration with the private sector have also been established.
To this end, the DOT has begun the process towards implementation, notably, the provincial road shows, industry planning meetings, bilateral with DPE and TRANSNET to ascertain rail state of readiness to take on the rail friendly commodities that will be migrating to rail from road. We note the enthusiasm from Transnet on the road to rail migration. We have also been in discussion with RTMC and NPA on the utilisation of Weigh-In-Motion (WIM) for prosecution. The legislation division is working on the charges that need to be affected for this to come to fruition.
We have also had discussions with Cross Border Road Transport Agency to determine their regulatory system, its imminent expansion and how integration can be sought.
The implementation of the RFS is DOT co-ordinated, whilst the actual implementation lies with various agencies, State Owned Companies, Departments, other spheres of government and the Private sector.
b) The strategy is being implemented gradually, and the Integrated Implementation Plan (IIP) will further qualify the different responsibilities and responsible persons from the noted implementing agencies (Reference to (a)).

Carter, Ms D to ask the Minister of Justice and Correctional Services
Whether marriage officers employed by the Department of Justice solemnise same-sex marriages in terms of the Civil Union Act, Act 17 of 2006; if so, what is the total number of officers who have been exempted in terms of section 6 of the specified Act from solemnising same-sex marriages?
Reply:
I wish to inform the Honourable Member that the Department of Justice and Constitutional Development does not employ marriage officers.
In terms of the applicable legislation (The Marriage Act and the Civil Union Act), every magistrate shall by virtue of his or her office be a marriage officer for the district or area for which he or she holds office. Magistrates are therefore ex officio marriage officers. Magistrates solemnise same- sex marriages as and when required to do so. All judicial officers are in terms of section 174(8) of the Constitution of the Republic of South Africa, 1996, required to take an oath or affirm that they will uphold and protect the Constitution. I am not aware of any magistrate requesting an ‘exemption’.
In terms of section 6 of the Civil Union Act the responsible Minister for marriage officers to lodge and objection on the grounds of conscience, religion and belief to solemnising a civil union between persons of the same sex is the Minister of Home Affairs. I would therefore suggest that the Honourable Member approach the Minister of Home Affairs in this regard.

Nolutshungu, Ms N to ask the Minister of Transport
Whether his department has done any upgrading of public transport facilities and services to and from healthcare facilities since 1 January 2012; if not, what is the position in this regard; if so, what (a) is the (i) name and (ii) location of each healthcare facility that has seen the specified upgrade and (b) are the relevant details of each specified upgrade?
Reply:
The three spheres of Government share responsibilities for different aspects of public transport operations and infrastructure. From a national perspective the Department through the Passenger Rail Agency will be rolling out upgraded rail infrastructure and services in line with the recapitalisation programme of Metrorail. In several cities, rail lines provide connections to health care facilties especially in city CBDs and in township hubs. The Department will confirm the specific operational upgrades in due course once the rail corridor based infrastructure and service improvements are completed from 2018/19 onwards.
With regard to road based public transport, the Department has been funding 13 cities through the Public Transport Network Grant to improve the quality of services. Four cities are currently operating a Phase 1 service and another five cities will either pilot or launch services in 2018/19.
In several cities these upgraded services such as Rea Vaya in Johannesburg and My Citi in Cape Town served major health care facilties such as the Phase 1a and b or Rea Vaya which link Soweto with Rahima Moosa, Chris Hani Baragwanath, Charlotte Maxeke Hospitals etc. The My Citi N2 Express serves Lentegeur Hospital in Mitchells Plain Cape Town. In Tshwane the current A re Yeng pilot phase connects to Steve Biko Academic Hospital.
Upcoming projects in 2018/19 will serve the Tembisa Hospital in Ekurhuleni with the Harambee BRT. By 2021/22 the Department expects all 13 cities to be operating at least one major township to CBD trunk route that will serve the major health facilities on both these ends.

We went further to meet with the Ba-Phalaborwa Local Municipality on 20 March 2018 to reconcile the debt, upon which we found there is still an outstanding amount of R13 203 678.45, of which R7 748 925.96 was paid on 22 March 2018 and the balance of R5 454 752.49 belongs to properties, which are not under the custodianship of the National Department of Public Works.
b) The Department of Public Works pays invoices as and when they are received. However, there are times when a reconciliation needs to be done in order to verify the debt, resulting in some delays in payment.
c) All verified invoices were paid on 22 March 2018.
