The official is on suspension. He was suspended on 08 June 2018, the disciplinary hearing is scheduled for 28-29 June 2018.

(a) What is the status of the investigation by the Special Investigating Unit (SIU) into expenditure on student parties by the Tshwane South Technical and Vocational Education and Training College and (b) on what date will the findings of the investigation be made public?
Reply:
The Special Investigating Unit (SIU) has informed me that the allegation, as referred to by the Honourable Member, does not from part of the Schedule to Proclamation No. R. 5 of 2018 (published in Government Gazette No. 41433 of 9 February 2018) (the Proclamation). The Schedule to the Proclamation which was referred to the SIU for investigation is attached as Annexure A for ease of reference.
The allegations as set out in the Proclamation are currently being investigated by the SIU. Once the investigation is finalised, the SIU must, in terms of section of 4 of the Special Investigating Units and Special Tribunals Act, 1996 (Act 74 of 1996) (the SIU Act), report on the outcome of the investigation. Section 4 of the SIU Act further provides for interim reporting mechanisms regarding investigations in that the SIU must at least twice a year report to Parliament on investigations that were referred to the SIU.

(a) What number of cases relating to the Prevention and Combating of Corrupt Activities Act, Act 12 of 2004, as amended, have been referred to the (i) SA Police Service (SAPS) and (ii) Directorate for Priority Crime Investigation (DPCI) by (aa) his department and (bb) each entity reporting to him for further investigation since the Act was assented to and (b) what number of the specified cases have (i) been investigated by SAPS and DPCI, (ii) been followed up by the respective accounting officers and (iii) resulted in a conviction in each specified financial year since 2004?
Reply:
(aa) According to information kept by the Forensic Audit Unit (FAU), the statistics being provided are from 2005 until 2018. However, only few records for the years 2005 – 2009 could be retrieved and provided. The statistics for the year 2007 and 2010 could not be retrieved at all.
The FAU then provided the statistics for the years 2011 – 2018 with the exception of those cases that were referred to the South African Police Service (SAPS) and those that were referred to the Directorate for Priority Crime Investigation (DPCI). All the statistics for the years 2005 - 2009 were largely stated as only being referred to the SAPS.
The presentation of the statistics was done in four categories to indicate (i) successful prosecution (ii) Withdrawn and closed by either the SAPS or DPCI (iii) Feedback not being provided by (in most cases the SAPS) despite several efforts trying to contact them and (iv) Investigation is still in progress and further update was never provided.
It must be noted that there has been and still is a problem as far as the communication between the SAPS and those directorates in the Department of Justice & Constitutional Development to obtain the feedback on all the matters/cases referred to the SAPS. It appeared to be a bit effective between the DPCI and the directorates of the Department to provide feedback on the matters/cases referred to the DPCI.

The Honourable Member should kindly note that all the category of cases that are being reflected as “investigation still in progress” on the above table, is due to unavailability of case dockets in certain instances and also the fact that the key officers could not be located within the Law Enforcement Agencies. These cases are still kept open even though they are more than three (3) years old, due to the fact that the Law Enforcement Agencies are of the view that evidence may still come to light.
(bb) The entities reporting to me have reported as follows:
A. National Prosecuting Authority: Questions (a)(i); (ii); and (b)(i) are not applicable to the NPA.

What (a) is the total number of incidents of sexual harassment that were reported to the human resources offices of entities reporting to him in (i) 2016 and (ii) 2017 and (b) are the details of each incident that took place; (2) was each incident investigated; if not, why not in each case; if so, what were the outcomes of the investigation in each case?

Department of Justice and Constitutional Development
1. (a) The total number of incidents of sexual harassment that have been reported in the Department of Justice and Constitutional Development, are as follows:
(i) In each of the past two financial years:
(aa) 2016/17 : Two (2) cases were reported; and
(bb) 2017/18 : Three (3) cases were reported.
(b) The details of each incident that took place are as follows:
(i) Regarding the two (2) cases reported in 2016/17: In one case, the incident involved negative sexual comments and in the second case, the incident involved gestures deemed as unwanted sexual advances.
(ii) Regarding the three (3) cases reported in 2017/2018: In one case, the incident involved negative sexual description of a female colleague, in the second case, the incident involved gestures deemed as unwanted sexual advances and the last case involved statements deemed sexually negative to a colleague.
2. Regarding the investigation and outcomes of each incident, I have been informed as follows:
(a) Regarding the two (2) cases which were reported in 2016/17 financial year, the two (2) cases were investigated and disciplinary hearings were conducted. In the one case, the employee was found guilty and a sanction of suspension without pay was imposed. In the other case, the matter was withdrawn by the Department as there was insufficient evidence.
(b) Regarding the three cases which were reported in 2017/18 financial year, the three (3) cases were investigated. Two cases were withdrawn, with a bilateral settlement relating to one case; the second matter was withdrawn by the Department as there was insufficient evidence and the last case is still pending finalization (not concluded).
(ii) The entities have reported as follows:
A. Legal Aid South Africa:
1. (a) Total number of sexual harassment incidents reported at Legal Aid SA is as follows:
(aa) 2016: zero (0) incidents reported to Human Resources (HR); and
(bb) 2017: one (1) incident reported to HR.
(b) The details regarding the one (1) incident reported in 2017/18 are that the incident involved gestures deemed as unwanted sexual advances.
(2) Regarding the investigation and outcomes of each incident, I have been informed as follows:
Regarding the one case which was reported in 2017/18 financial year, the grievance was thoroughly investigated. The outcome of the investigation confirmed the complaint and that there were sufficient grounds for a formal disciplinary hearing. The employee was afforded an opportunity to make representations as to why he should not be suspended, pending a disciplinary hearing. In response, the employee resigned with immediate effect from the employment of Legal Aid SA. This matter was thus closed internally.
B. National Prosecuting Authority:
1. (aa) 2016: One (1) incident of sexual harassment was reported. However, in paragraph (2) below, the NPA reported on an outcome made in 2016 of an incident that occured in a prior year (2014).
(bb) 2017: One (1) incident was reported.
2. In October 2016, an official from the Office for Witness Protection (OWP) was dismissed for sexual harassment. While the incident took place in 2014 and was investigated and the disciplinary hearing commenced in 2015, the appeal process was finalised in September 2016.
Additional information for 2016:
Allegations of sexual harassment against a prosecutor were reported to Employee Relations in June 2016. The allegations were investigated and it was found that the prosecutor had a case to answer. Formal disciplinary action was recommended, however the NPA did not proceed with formal disciplinary action as the complainant formally withdrew the allegation of sexual harassment against the prosecutor on 7 October 2016. The NPA was informed by her attorney that the allegation has been formally withdrawn and a copy of the formal withdrawal of the allegation was sent to the NPA. The NPA responded to the complainant’s attorney on 14 October 2016 that in light of the formal withdrawal of the allegation against the prosecutor, the NPA will not proceed with disciplinary action against the official.
2017:
The incident of sexual harassment in the Director of Public Prosecutions: Free State region was reported to Labour Relations in October 2017. The matter was investigated and it was found that a District Court Prosecutor made himself guilty of sexual harassment. The complainant reported the matter, however did not want to participate as a witness in a disciplinary hearing. Due to the fact that the complainant was unwilling to testify in the disciplinary hearing, progressive disciplinary action was taken against the offending official. He was served with a Final Written Warning on 31 January 2018. He appealed the Final Written Warning. The Appeal Authority dismissed the appeal and the matter was finalised on 23 February 2018.
C. Special Investigating Unit:
No incidents of sexual harassment were reported in the SIU in 2016 and 2017.

Whether Judge (Details furnished) of the Gauteng North High Court is still a serving judge in any capacity; if so, (a) where is the judge serving currently and (b) what are the dates of the judge’s period of service; if not, why not; (2) what is the reason for Judge (Details furnished) retirement; (3) whether Judge (details furnished) retirement had a bearing on illness; if so, (a) what was the nature of the illness, (b) when was the illness diagnosed and (c) when is the illness deemed to have developed; (4) Has he found that Judge (details furnished) illness had an effect on the work and court judgments of the judge; how?
Reply:
1. No, the stated Judge is no longer serving as a Judge of the Gauteng Division of the High Court.
2. The Judge was discharged from active service in August 2015 in terms of section 3(2)(a) of the Judges’ Remuneration and Conditions of Employment Act, 2001 (Act No 47 of 2001) after completing 15 years and having attained the age of 70 on 11 February 2015.
3. The Judge was not well at the time of his retirement but his discharge from active service was due to the attainment of the retirement age of 70 years and completion of 15 years active service as prescribed in section 3 and 4 of the Judges’ Remuneration and Conditions of Employment Act, 2001.
The questions relating to (b) and (c) can only be answered by the Judge medical practitioner.
4. In view of the fact that the judicial authority is vested in the courts that are independent, I would suggest that the Honourable Member approach the Chief Justice regarding the work and judgments of the judge.

(a) What total amount of land owned by his department and the entities reporting to him in each province is (i) vacant and (ii) unused or has no purpose and (b) what is the (i) location and (ii) size of each specified plot of land; (2) (a) how much of the land owned by his department and the entities reporting to him has been leased out for private use and (b) what is the (i) Rand value of each lease and (ii)(aa) location and (bb) size of each piece of land?
Reply:
1. Neither the Department of Justice and Constitutional Development and the Office of Chief Justice nor related entities such as the National Prosecuting Authority, and Special Investigating Unit own any land. All immovable assets belonging to the State resort under the custodianship of the national Department of Public Works, and is governed by the Government Immovable Asset Management Act, 2007 (Act No 19 of 2007) and the State Land Disposal Act, 1961 (Act No 48 of 1961).
However, I have been informed that Legal Aid South Africa does not own any vacant and unused land but owns seven (7) pieces of land where there are properties that are used as local offices as per my reply to question 988.
2. Falls away.
- The Department of Correctional Services and the entities does not own any land. All the land and buildings that the department and these entities are using belongs to the National Department of Public Works, as the custodian of all state immovable assets.

b) I have been informed that the Department of Justice and Constitutional Development has not conducted general lifestyle audits in relation to senior management. We have limited our policies and procedures to vetting processes and identification of risk, based on declarations of interest.
In terms of statistics relating to incidents of fraud and corruption, it seems that the risk exposure to the Department is not at senior management level but rather at middle management and lower levels and in specific in specialised environments.
The Department is in the process of reviewing its fraud and anti-corruption strategy and will consider such for inclusion in these specific environments.
c) The entities have reported as follows:
(i) National Prosecuting Authority: No lifestyle audits have been conducted in the NPA in the past three (3) financial years. Currently, there are no plans in place to conduct lifestyle audits.
(ii) Legal Aid South Africa: No, the Chief Executive Officer of Legal Aid South Africa as the executive head has not been subjected to a lifestyle audit for the past three (3) years.
However, the Internal Audit Department of Legal Aid South Africa conducted lifestyle audits for the past three financial years based on an assessment of potential risks from employees who are in direct interaction with clients or are handling financial transactions of the organization. The audits cover the following categories of staff, namely: Legal Practitioners; Paralegals and Administration Managers. In the 2018/19 financial year, a lifestyle audit is planned of all persons involved in procurement at national and provincial level, and will include members of the Bid Adjudication Committee and Bid Evaluation Committee.
(iii) Special Investigating Unit: Prior to the appointment of the Head of the Special Investigating Unit, Advocate JL Mothibi was subjected to a Vetting Process by the State Security Agency before he resumed his duty on the 1 May 2016.

Reply:
The docket Clanwilliam CAS 114/05/2015 and supporting documents have been received and studied by advocates from my office. The documents indicate that there were three similar accidents, two of which were fatal. Queries were directed to the investigation officer to obtain further information, in the form of dockets and/or inquests, regarding these other accidents so that a final decision may be made upon consideration of all the relevant evidence.
I am awaiting the completion of these further investigations.

(1) What is the (a) nature and (b) current status of the settlement agreement, Resolution 1/2016, which was entered into between the Department of Correctional Services and trade unions in November 2016; (2) (a) what payments (i) have been made and (ii) are scheduled to be made to beneficiaries in terms of the specified resolution and (b) in each case, what is the (i) date and (ii) total amount in Rand of the payments; (3) (a) by what date does he expect to have fulfilled all the terms of the specified agreement and (b) what are the relevant details of his plans in this regard?
Reply:
(1) (a) The nature of the Settlement Agreement is to address the outstanding matters connected with the Correctional Officials Occupational Specific Dispensation (OSD) 2nd Phase experience recognition for the production salary levels 03 to 08 that emanated from General Public Services Bargaining Council (GPSSBC) Resolution 2 of 2009.
(b) The collective agreement allows for a multi-year implementation of back pay amounts. The Department has already paid 17% of the back pay amount owed to fourteen thousand two hundred and ninety (14290) qualifying correctional officials, and 6% back amounts to twelve thousand three hundred and sixty five (12365) qualifying correctional officials respectively. With regard to the six thousand three hundred and six (6306) qualifying correctional officials who terminated services, the Department has initiated an audit to determine the debt owed to them in relation to the OSD Departmental Bargaining Chamber settlement agreement. To date a total of three thousand two hundred and seven cases (3207) have been audited and submitted for payment. The agreed 4% payments which are due in the 2018/2019 financial year for both serving and terminated officials are scheduled for payment during the 2nd quarter starting July 2018 of the current financial year.
(2) (a):
(i) The 17% owed to qualify officials plus 6% of the staggered payment have been paid.
(ii) 4% payments are scheduled to be made to serving officials during the 2nd quarter of the current financial year (2018/2019)
27% (17% + 6%+ 4%) payments are scheduled to be made to ex officials during the 2nd quarter of the current financial year (2018/2019)
(2) (b):
(i) The 17% payments were made during June 2017 and October 2017.
6% payments were made during February 2018.
4% to serving officials as well as 27% to ex-officials are scheduled to be paid during the 2nd quarter of the current financial year (2018/2019).
(ii) R57, 463 574.00 already paid to serving officials.
An estimated amount of R71 million is to be paid to both serving and ex-officials (4% for serving officials and 27% to ex-officials back log).
(3) (a) as agreed in the Settlement Agreement it is expected to conclude this matter not later than 31st March 2020.
(b) Utilization of a task team to oversee payments centrally on a continuous basis and assist/ guide regions with all relevant administrative processes to conclude the remaining 3% payments in the 2019/2020 financial year.

What number of cases between state legal advisors acting as representatives of the State on all three levels of government and the public were (a) settled and (b) brought into question as arrangements made without sufficient power of attorney since 1 January 2010; (2) (a) what number of cases were settled in (i) his department and (ii) each provincial department in total respectively since 1 January 2010 and (b) what was the total amount for each year from 2010?
Reply:
1. I wish to request the Honourable Member of Parliament to please clarify what specific information, the MP requires in this regard. The Office of the Chief State Law Adviser provides legal opinions to the National Executive and National Departments, as to the constitutionality and legality of draft Bills and international legal agreements. The Offices of the various State Attorneys act as Attorney of Record for the National Executive as well as National Government Departments.
If the terminology of “state legal advisors” is interpreted as “state attorney”, I am further informed that if the interpretation of the question is to mean “where the state attorney settled the matter without a power of attorney from the client Department”, that the Offices of the State Attorney do not keep such detailed statistics as these matters are kept in general with the statistics of settled matters. If the information is to be sought now, the Office of the Acting Chief Litigation Officer would have to request the various State Attorneys’ Offices to search their files individually as far back as 2010, which would mean an enormous amount of human resources and time would have to be expended in the search, as some of the files have already been closed and archived.
2. (a) (i) I am informed that the Department of Justice and Constitutional Development (DoJ&CD) does not have a readily available database from 2010 until the current financial year in respect to the number of cases settled by the DoJ&CD. However, the information on the amounts claimed and settled is provided in Table B below.
(ii) Table A below provides details of the total number of cases that were settled for each provincial department during the 2015/16, 2016/17 and 2017/18 financial years:

Whether he has been informed that Advocate (details furnished) continues to serve as the Interim Board Chairperson of the Passenger Rail Agency of South Africa (Prasa) after being appointed as a Judge of the High Court; if not, what is the position in this regard; if so, what are the relevant details; (2) Whether he has found that Advocate (details furnished) service on the Interim Board of Prasa constitutes a breach of the Judicial Code of Conduct?
Reply:
1. I have been advised that the Judge was appointed as the Chairperson of the Interim Board of the Passenger Rail Agency of South Africa (PRASA) in October 2017 prior to her appointment by the then President of the Republic of South Africa as a Judge of the Gauteng Division of the High Court. Her appointment as a Judge was effective from 01 January 2018 but due to her position as the Chairperson of the Interim Board of PRASA, the Judge did not assume her position as a Judge of the Gauteng Division of the High Court. She requested the Judge President of the Gauteng Division of the High Court, to request me to approach the President with a request that her appointment date be deferred to 1 April 2018. Whilst she was the Chairperson of the Interim Board of PRASA, the Judge never sat nor carried any judicial functions. I have been informed that she has subsequently resigned as Chairperson of the Interim PRASA Board with effect from 16 March 2018.
2. It is not within my purview to determine whether a conduct of a Judge constitutes a breach of the Code of Judicial Conduct. The responsibility to determine whether a Judge has committed a breach of the Code of Judicial Conduct is vested upon the Judicial Conduct Committee established in terms of section 8 of the Judicial Service Commission Act, 1994 (Act no 9 of 1994) (JSC Act). Additionally, Article 2 of that Code of Judicial Conduct is clear as it provides that ‘any wilful or gross negligent breach of the Code is a ground upon which a complaint against a Judge may be lodged in terms of section 14(4)(b) of the JSC Act’. This simply means that if any determination has to be made about the conduct of the Judge, a complaint that complies with the provisions of section 14 of the JSC Act, must first be lodged with the Judicial Conduct Committee setting out the grounds upon which the complaint is based. There is currently no complaint lodged with the Judicial Conduct Committee about Judge’s conduct.

a) The Department of Justice and Constitutional Development (DoJ&CD) does not own any land or property. However it uses state owned properties that are under the custodianship of the National Department of Public Works.
In the effort of executing its mandate of administration of justice, the DoJ&CD’s Courts make use of physical assets in the form of courts and office buildings. The Department is accommodated in 672 state-owned properties and is leasing only 120 buildings mainly offices throughout the country. In an effort to strike a balance, the composition of the Departments portfolio lies within an acceptable ratio of 80% state owned and 20% leased building.

(a) What number of offenders are listed in the National Register for Sex Offenders (NRSO) in 2018, (b) have all of the specified offenders been properly evaluated according to the requirements for placement on the NRSO, (c) what number of staff members are allocated for the maintenance of the NRSO and (d) which provincial education departments have requested access to the NRSO in the past two years for the purpose of vetting educators before employment?
Reply:
a) From 1 January 2018 to 27 March 2018, there are 487 convictions recorded in the National Register for Sex Offenders (NRSO). However, to date, the total number of convictions recorded in the NRSO is 28 670.
b) The number of convictions recorded from 1 January 2018 to 27 March 2018 have been properly evaluated according to the required standards. The Department is in the process of reviewing all cases that were pending prior to 1 January 2018 at the Office of the Registrar to confirm the final court order.
As part of the review, the Department has also finalised the development of the new NRSO electronic system which will, upon implementation, lead to the achievement of the following functions:
- Ability to issue Vetting & Removal Certificates;
- Ability to scan the document’s Mandatory Fields Required from inception of processes;
- Ability to communicate more effectively via the system between the office of the National Registrar for Sex Offenders and the courts;
- Secure more reliable data synchronized with stakeholder Departments and stay in Sync via an integrated solution; and

Reply:
1. Section 8 of the Superior Courts Act, 2013 (Act No. 10 of 2013) accords the Chief Justice certain powers with regard to the performance of judicial functions, and these powers flow directly from the constitutional reforms brought about by the Constitution Seventeenth Amendment passed by this august House in 2012 section 165(6) of which provides, and I quote:
“165(6) The Chief Justice is the head of the judiciary and exercises responsibility over the establishment and monitoring of norms and standards for the exercise of the judicial functions of all courts.” (Close quote)
In exercising the powers conferred under the Constitution the Chief Justice is authorised by section 8 of the Superior Courts Act to issue written protocols or directives, or give guidance or advice, to judicial officers, among others, regarding any matter affecting the dignity, accessibility, effectiveness, efficiency or functioning of the courts.
The issue of language is not only an emotive have regard to our history where English and Afrikaans were the only languages that enjoyed official recognition and status, but is also an access issue which I believe would fall under the ambit of section 8 of the Superior Courts Act.
2. The Chief Justice informed me of the decision of the Heads of Court regarding this matter during my meeting with Heads of Court which was held on the same day that the Chief Justice made a public pronouncement on the matter, namely, 29 September 2017.
3. The Constitution is very clear on the matter of languages. Not only does 6 gives accords equal status to all official languages, but also enjoins the Pan South African Language Board (PANSALB) in particular to take measures to promote the development of our indigenous African languages.
It is important to put the pronouncement by the Chief Justice in the proper context. This pronouncement does not imply that Afrikaans and other languages will disappear from the courts’ radar. Any person is free to present his or her case in any of official language that he or she understand in which case interpretation is provided if the language happens to be any language other than English. What is conveyed is that the transcript of the record will, for practical reasons be in English.
4. As I have already indicated, the pronouncement of the decision of the Heads of Court was made at the meetings of Heads of Court and the Judicial Service Commission of September and October respectively. The Chief Justice is not required to inform the Department of such decisions.
5. From our records the decision or directive pertaining to the issue has not been published in the Government Gazette. I am aware that there are discussions underway regarding the implementation of the decision at the various courts. I am aware, for example of the directive issued by Judge President Hlophe of the Western Cape Division which I believe is a subject of discussion at the Provincial Efficiency Enhancement Committee convened by the Judge President of Division in a province. These on-going discussion relate to the capacity to implement the decision. If this is a kind of decision or directive that must be published in the Gazette it would be ideal to do so after careful consideration and taking into account the capacity of our interpretation services.

(a) (i) (ii) (b) (i)-(v) The Ministerial Handbook provides guidelines on the appointment of the staff in the Private Office. It equally provides the recommended salary levels of each post. The salary levels are adjusted on an annual basis as prescribed in the Public Service Regulations.
The Office of the Minister has a full staff complement as defined in the Ministerial Handbook. In line with the Protection of Personal Information Act (PoPi) and the Basic Conditions of Employment Act am unable to provide the members with such confidential information in the manner it is requested.
I however draw the honourable members to the department’s Annual Report wherein the organogram of the department provides the information required. Should it be insufficient, the department will make the personal files of the officials available for further scrutiny by the Auditor General as prescribed by the Act.

a) It is unclear what is meant by “trust funds”. The Branch Masters, within the Department of Justice and Constitutional Development, administer the registration of “trusts” in terms of Trust Property Control Act 57 of 1988, which legislation does not cover trusts funds. Accordingly, the Department of Justice and Constitutional Development will not know the number of “trust funds” registered for the period referred to in the questions.
b) – (e) Responses to these questions, which were depended on question (a) above, is that the Department of Justice and Constitutional Development has no information requested because of answer in (a) hereinabove.

Reply:
I wish to inform the Honourable Member that female genital mutilation is currently not defined in terms of the South African common or statutory law as a criminal offence.
The Department of Justice and Constitutional Development, as well as the National Prosecuting Authority therefore do not have any such charges and convictions on its statistical databases. An accused person may however, be criminally charged with an offence, for example, of assault with the intent to cause grievous bodily harm, if female genital mutilation was inflicted. Such cases would however not be reflected separately in the statistical data bases.

Reply:
a) (i) and (ii) The National Prosecuting Authority (NPA) has informed me that the NPA only records conviction rates of verdict cases on all murder prosecutions, and a further breakdown according to the types of murder as well as child abuse, is not available. NPA is therefore not able to provide the information in the detail requested.
I have further been informed that the Department of Justice and Constitutional Development`s (DoJ&CD) Integrated Case Management System (ICMS) does not at present, provide for victims details yet, and therefore the Department would not be able to specify if a criminal charge of murder is linked to a victim such as a child. Efforts are however in place to address this gap. Thus far, a data collection tool for the details of all crime victims, including children, has been drafted, and is now being taken through the stakeholder- consultation process.
The Department can therefore unfortunately not respond in respect to data on child murder charges but in the future the Department will be able to report on it from the Integrated Justice System (IJS) transversal system data.
The Honorable member is therefore advised to request this information from the South African Police Service, in terms of criminal matters.
In terms of Children’s Court-matters involving child abuse and neglect, data on matters relating to child abuse, was not collected previously (for the 2014/15 to 2016/17 financial year. With the roll-out of the Integrated Case Management System (ICMS) this year, the Department is able to provide mid-year statistics for 2017/18 as shown below.

To give effect to South Africa’s obligation to the UN Protocol on Trafficking in Persons, the Prevention and Combating of Trafficking Act 2013 (Act No. 7 of 2013) was passed in July 2013. The Act seeks to fulfil four main objectives, namely to:
- Provide for an offence of Trafficking in Persons (TIP) and other offences associated with trafficking in persons;
- Prevent and combat TIP within and across the borders of the Republic;
- Provide for measures to protect and assist victims of TIP; and
- Provide for the establishment of the Inter-sectoral Committee on Prevention and Combating of TIP.
The Prevention and Combatting of Trafficking in Persons Act came into operation in August 2015. Prior to the enactment of Act, trafficking in persons for sexual purposes was criminalised through other pieces of legislation such as the Sexual Offences Act and trafficking in children through the Children’s Act.
For ease of reference and in order to provide a more detailed response, below is a schedule with a summary of cases dealt with under section 4(1) of the Prevention and Combating of Trafficking in Persons Act, 2013 (Act No. 7 of 2013).

Whether (a) his department and/or (b) entities reporting to him procured services from a certain company (Travel with Flair); if so, (i) what services were procured in each case and (ii) what is the total amount that was paid to the specified company in each case; (2) whether the specified company provided services related to international travel to (a) his department and/or (b) entities reporting to him; if so, (i) what is the name of each person who travelled, (ii) what was the travel route and (iii) what is the total amount that was paid for each person accompanying him?
Reply:
(1)(a)The Department of Justice and Constitutional Development had, through a competitive bidding process, appointed the Travel Management Company (TMC) named Travel with Flair to provide travelling and related services.
(i)The following link table depicts service volumes that were processed by the TMC on behalf of the Department for the period April 2016 to March 2017:

(ii)The total value of services paid to various hospitality industry players through Travel with Flair was R202 826 036. It should be noted that the National Treasury negotiated and implemented rates with all TMCs. The Department is therefore strictly in compliance with the National Treasury guideline on rates and charges applicable to the travel management industry.
2 (a) Yes, the specified company did provide services related to international travel.
(i)(ii) and (iii)The attached Excel spreadsheet contains the names of the officials who travelled, the route details and the amounts paid for each person.

Response received from Legal Aid South Africa:
The Legal Aid South Africa has a contract with Travel With Flair for the provision of travel management services. The contract was awarded through an open tender process having considered functionality and cost of bids received. In terms of the contract, Travel With Flair invoices Legal Aid South Africa for all travel services procured on their behalf and these invoices are settled within 30 days. Travel With Flair charges Legal Aid South Africa a monthly management fee for their services.

1. The NPA had a contract with Travel with Flair (TWF) during the period May 2009 to November 2011. In this regard,
(i) The NPA procured travel management services (air flights, accommodation, car rental and shuttle services)
(ii) The total amount paid to TWF during the contract period was R 78 375 960.52, detailed as follows:
R 34 915 174,72 – 2009/10 financial year;
R 27 517 371.09 – 2010/11 financial year;
R 15 943 414,71 – 2011/12 financial year
2. The Service Level Agreement entered into with TWF included services related to international travel.
(i) The total amounts paid to TWF during the contract period for international travel on behalf of NPA officials amounts to R 5 323 373.65, detailed as follows:
R 2 577 591,87 – 2009/10 financial year;
R 1 499 002.88 – 2010/11 financial year;
R 1 246 778.90 – 2011/12 financial year

Alberts, Mr ADW to ask the Minister of Justice and Correctional Services
(a) On what date will his department begin with the judicial inquiry into the death of a certain person (name and details furnished), (b) what are the names of the (i) presiding officer and (ii) other members of the specified inquiry, (c) what are the intended time lines for the completion of the inquiry and (d) what steps will his department take following the completion of the inquiry?
Reply:
I have been informed by the Director of the Public Prosecution for the Western Cape as follows:
a) The statements, documents and information have been submitted to the inquest Magistrate by the Prosecutor in terms of Section 5(1) of the Inquests Act.
Therefore, no date is yet available for the inquest to be held as the inquest Magistrate is still perusing the documents.
b) The matter has not been allocated to a specific presiding officer, and any assessors that might be necessary have not yet been appointed.
c) The police investigation has been completed. However, it is unknown whether the presiding officer will have further queries regarding any evidence. Should the presiding officer raise further queries, they will be attended to as quickly as possible.
d) Once any further investigation that may be necessary has been completed, the presiding officer will determine whether a formal inquest must be held (i.e. one at which viva voce evidence will be heard in court) and whether assessors should be appointed.

What are the details including the ranks of service providers and/or contractors from which (a) his department and (b) the entities reporting to him procured services in the past five years; (2) what (a) service was provided by each service provider and/or contractor and (b) amount was each service provider and/or contractor paid; (3) (a) how many of these service providers are black-owned entities, (b) what contract was each of the black-owned service providers awarded and (c) how much was each black-owned service provider paid?
Reply:
The Department of Justice and Constitutional Development (DoJ&CD) has provided a high-level response to the questions above. A list of all major contracts awarded to BEE level 1 to 3 is included for sake of interest. Due to the volume of procurement, a full list of procurement during this period is not provided.
The DoJ&CD utilised the following method and rationale in arriving at the statistical conclusions populated below:
(i) the data is based on contracts above R500k concluded with service providers using a SCM process; and
(ii) the BEE levels of service providers are, as at time of contract award as the level status may have been amended post the implementation of the new preferential procurement regulation of 2017.
Part (C) of the question cannot be addressed due to the fact that the regulations were only amended with effect from 1 April 2017 that allows for a different allocation and adjudication process that support specifically black-owned entities. For the previous years, the BEE levels addressed ownership as well as investment in redress activities.
An estimated total amount of R6.2 billion worth of contracts had been awarded by the DoJ&CD to various suppliers/service providers since 2006.

Whether the decision of the Chief Justice that in future English will be the official language of record in terms of section 8(5)(b) of the Superior Courts Act, Act 10 of 2013, was published in the Government Gazette; if not, why it was not considered necessary to do so; if so, in which Government Gazette; (2) whether he is aware of the decision of the Pan South African Language Board (PanSALB) published in Government Gazette No. 24121 of 29 November 2002 in respect of board decision 99 of 2002; if so, what steps his department has taken concerning the specified PanSALB decision; if not, (3) whether he will familiarise himself with the PanSALB decision and will take the necessary steps in this regard; (4) whether he will consider establishing legal certainty and affirming the separation of powers by making an amendment to subsection 8(3)(b) of the Superior Courts Act, Act 10 of 2013, which places a clear limitation on the competencies of the Chief Justice to take decisions regarding the language of record in courts?
Reply:
1.The decision of the Chief Justice that, in future, English will be the official language of record was not published in the Government Gazette.
I am not in a position to respond on behalf of the Chief Justice as to why it was considered not necessary to publish it in the Government Gazette, if it was considered as a decision falling under section 8(3) of the Superior Courts Act, 2013.
2. I am aware of the the decision of the Pan South African Language Board (PanSALB) published in Government Gazette No. 24121 of 29 November 2002, in respect of Board Notice 99 of 2002;
The Department of Justice and Constitutional Development is in the process of developing a policy on the interpretation service which includes provisions on the language of court proceedings (langauge use), as well as a possible position on the language of record for the courts. This policy will inform legislative reform to determine the language of record for the courts, as well as the language of court proceedings.
3. and (4) See response in point (2) above on legislative reform. Additionally, any legislative proposal must consider and uphold the principle of separation of powers between the executive and the judiciary.

By what date will the proposed Prohibition of Forced Marriages and Child Marriages Bill be introduced in the National Assembly?
Reply:
The South African Law Reform Commission (SALRC) is conducting research into the practice of ukuthwala. As part of this research, the SALRC published a revised discussion paper containing preliminary proposals for law reform, as well as a draft Bill titled “Prohibition of Forced Marriages and Child Marriages Bill” in October 2015.
I am informed that the final report is at an advanced stage of completion and will serve before the Commission in December 2017 for approval. The report will thereafter be submitted to me for consideration. After considering the report and its recommendations, I will thereafter be in a position to indicate when or what form of legislation ought to be introduced in the National Assembly.
As the Honourable Member should be aware, in terms of Sec 4(2)(b) of the Prevention and Combatting of Trafficking in Persons Act (Act 7 of 2013), any person who concludes a forced marriage with another person for the purposes of the exploitation of that person in any form or manner is guilty of an offence.

What measures has his department put in place to mitigate the impact of cyber-attacks in the country?
Reply:
In terms of the National Cybersecurity Policy Framework (NCPF) for South Africa, the Department of Justice and Constitutional Development is obliged to review the cybersecurity laws of the Republic to ensure that these laws are aligned with the NCPF, and provide for a coherent and integrated cybersecurity legal framework for the Republic. In accordance with the mandate of the Department, the Cybercrimes and Cybersecurity Bill (the Bill) was developed and introduced in Parliament as Bill 6 -2017 after a protracted consultation process. The Bill aims, amongst others, to put measures in place to deal with cybersecurity, capacity building and, as a subdivision of cybersecurity, also with cybercrimes.
Chapter 11 of the Bill provides for the declaration of essential information infrastructures as critical information infrastructures and provide for the implementation of special measures, amongst others, to regulate minimum security standards relating to:
- the classification of data held by the critical information infrastructure;
- the protection of, the storing of, and archiving of data held by the critical information infrastructure;
- cybersecurity incident management by the critical information infrastructure;
- disaster contingency and recovery measures which must be put in place by the critical information infrastructure;
- minimum physical and technical security measures that must be implemented in order to protect the critical information infrastructure; and
- other relevant matters that are necessary or expedient in order to promote cybersecurity in respect of the critical information infrastructure.
Cyber attacks are criminalized by various offences provided for in Chapter 2 of the Bill. Clause 11 of the Bill provides for specific offences that can be committed in respect of critical information infrastructures that are punishable with appropriate and proportional sentences.
The Bill further amends the Protection of Constitutional Democracy against Terrorist and Related Activities Act, 2004 (Act 33 of 2004), in order to criminalize cyber- terrorist activities. Amendments are also affected to the Disaster Management Act, 2002 (Act 57 of 2002), to specifically make that Act applicable to disasters that may involve critical information infrastructures.
The Department also actively participates in initiatives of the interim Cyber Response Committee, which consists of various Departments, that is tasked to implement the NCPF. The NCPF makes provision for the development and implementation of various initiatives and measures by different Departments that are aimed at securing South Africa’s Information Communication Technologies.

The Department of Justice and Constitutional Development is not responsible for enforcing civil court judgements. The Ekurhuleni Metro Municipality successfully applied for an order against the respondent and inquiries need to be made to the Ekurhuleni Metro Municipality as to why they are not enforcing it.

Whether any progress has been made by the National Director of Public Prosecutions in dealing with the final report that was prepared by a certain person (name furnished), into the collapse of African Bank, (details furnished); if not, why not; if so, what are the relevant details?
Reply:
The South African Reserve Bank referred its report into the collapse of African Bank to the National Director of Public Prosecutions (NDPP) on 17 May 2016. The NDPP requested the Head of the Specialised Commercial Crime Unit (SCCU) to attend to the matter as it fell within the mandate of the SCCU.
In March 2017, in response to Parliamentary Question No. 200, the National Prosecuting Authority (NPA) advised that the report was in its final stages of preparation. The prosecutor allocated the matter finalised a comprehensive report wherein he sets out that criminal investigations related to fraud, the Banks Act 94 of 1990 and Companies Act 71 of 2008 were warranted. He therefore recommended that the matter be referred to the South African Police Service for investigation and that a prosecutor be allocated to guide the investigations in the matter. Currently, the matter is under investigation by the Serious Economic Offences Unit of the Directorate for Priority Crime Investigation (DPCI).

a) No training was conducted for officials to handle mental health inmates to date.
b) Special training in handling crisis management – the training was conducted as follows:
(i) Emergency Support Teams officials were trained in 2014/15
79 Emergency Support Teams officials were trained in 2015/16
270 Emergency Support Teams officials were trained in 2016/17
(ii) 59 Emergency Support Teams officials are currently undergoing training 2017/18 (The training commenced on 23 October and will end 24 November 2017)

Whether he is aware of case 556/8/2017 involving a certain person (name furnished) who has allegedly murdered his son by assaulting him; if not, will his department investigate the specified case; if so, (a) why was the initial charge of assault dropped by the magistrate’s court and (b) why did the state not pursue the case considering that it was one of serious child abuse?
Reply:
a) The National Prosecuting Authority has informed me that the person who laid the charge of assault against the accused later submitted a further statement and withdrew the charges. The child was in her custody at the time of making the withdrawal statement. The State relied on this statement and withdrew the charges against the accused.
b) The NPA have informed me that in hindsight, the charges should not have been withdrawn. The charge of assault with intent to do grievous bodily harm will be added to the charge murder against the accused. This matter is on the court roll at the Johannesburg Magistrate’s Court.

What is the reason provided by the Master of the High Court in Cape Town for refusing to grant the Ndabeni Land Claim Trust their Letter of Authority despite being instructed to do so by the court?
Reply:
I have been advised that the Master is not in a position to appoint Trustees, and the reasons for not issuing the letters of authority are as follows:
a) The judgment and order have been taken on appeal, hence the operation and execution of the latter have been suspended; and
b) The application by the Trustees Elect in terms of Section 18 (3) of the Superior Courts Act 10 of 2013, to allow the order to be operational and executable pending the outcome of the appeal, was dismissed by the Full Bench of the Western Cape High Court.

(a) What processes and systems has his department put in place to ensure maximum public participation and commentary on the South African Law Reform Commission Report on Sexual Offences: Adult Prostitution, (b) what are the details of how public participation will take place and (c) what are the timelines for public participation and commentary on the report?
Reply:
(a) and (b) The Report on Adult Prostitution (Project 107) of the South African Law Reform Commission (the Report) was released into the public domain on 26 May 2017. The public and interested parties may consider and comment on the Report. The Department of Justice and Constitutional Development is embarking on the consultation process with internal governmental stakeholders on the legislative and non-legislative interventions due to the cross cutting impact of the recommendations. This internal process will consider the recommendations in a holistic and coordinated manner. A public participation process will be followed to facilitate debate and input from members of the public.
(c) The Department has indicated that this process of internal consultation will begin in October 2017. This process will be extensive as it must delve into all aspects of the implementation of the non-legislative recommendations. I will thereafter receive a report from the Department which will enable me to make a decision on the introduction of legislation.
