DR DARIO MILO OF WEBBER WENTZEL'S PROPOSAL ON BEHALF OF AVUSA LIMITED IN ACCORDANCE WITH ITS SUBMISSIONS BEFORE THE SELECT COMMITTEE ON SECURITY AND CONSTITUTIONAL AFFAIRS DATED 25 MARCH 2008

PROPOSED AMENDMENTS TO THE JUDICIAL SERVICE COMMISSION AMENDMENT BILL 2007

1. Delete the existing sections 9(3), 29{ 1 ), 29(2) and 38{ 4).

2. Insert into Chapter 4 a new section 39(1) (after the existing section 38) as follows:

"Members of the public, including members of the media, may attend:

(a) any formal hearings of the Chairperson, or a member of the Committee designated by the Chairperson, as contemplated in section 17(5);

(b) hearings of the Tribunal envisaged in Part 2 of Chapter 3; and

(c) appeals heard by the Committee in terms of section 18, to the extent that the Committee considers oral submissions by any party."

3. Insert into Chapter 4 a new section 39(2) (after section 39(1)} as follows:

"The Chairperson or member designated by the Chairperson, the Tribunal, or the Committee referred to in section 39(1) above, as the case may be, may in exceptional circumstances, decide not to permit access to hearings or appeals, or any part thereof, to the public, or to impose any reporting restrictions on any person who attends such hearings or appeals, as may be reasonable and jus tifiable in an open and democratic society."
