Report of the Select Committee on Security and Constitutional Development on the Private Security Industry Regulation Amendment Bill, [B27D-2012] (National Assembly – sec 75), dated 4 March 2014:

The Select Committee on Security and Constitutional Development, having considered the subject of the Private Security Industry Regulation Amendment Bill, [B27D-2012] (National Assembly – sec 75), referred to it, reports that it has agreed to the Bill without proposed amendments.

 

Democratic Alliance view on the Bill

 

The Report was not unanimously adopted and consensus was not reached with regard to clause 20(2)(c) of the Bill.

 

The Democratic Alliance held the view that clause 20(2)(c) of the Bill, which limits foreign ownership in the private security industry,  was unconstitutional and would negatively affect South Africa’s foreign investment. The Democratic Alliance further held that this clause would be contradictory to South Africa’s international trade agreements, and would specifically contravene the World Trade Organisation’s General Agreement on Tariffs in Services.
