HEALTH PROFESSIONS AMENDMENT BILL B10-D
Corrections on identified errors in the B10 - D version of the Bill


The following errors need to be corrected and endorsed by the Portfolio Committee on Health in the final version of the Bill before same is presented to the National Assembly:

1.    On page 2 under Objects of the Bill.

1.1 Line 13 must be deleted as it pertains to section 49(1) of the Principal Act which is now retained as per NCOP amendments.

2.    On page 6 line 19.

       2.1 The phrase "after paragraph (h)" must be deleted as paragraph (g) cannot come after paragraph (h).

3.    On page 8.

3.1 Line 7 - comma is missing between the words "appeal committee" and "the".

3.2 Line 18 - the word "also" is missing between the words "may" and "delegate", and this makes the section read tautological.

3.3 Line 31 - the heading "[Financing of Council]" must come before the heading "Corporate finance and Governance" as the former is being substituted by the latter.

4.    On page 14 line 46.

4.1 The word "technikon" must be deleted as these institutions no longer exist.

5.    On page 18.

5.2 Line 36 - the word "may" must come after the word "council" for consistency throughout the text.

6.    On page 22 line 20.

6.1 The word "technikon" must be deleted as these institutions no longer exist.

7.    On page 24.

7.1 Line 37 - the word "musf' must be substituted with the word "may" to avoid taking away the discretion of the magistrate or judge in issuing search warrant.

7.2 Line 56 - the word "of' between the words "magistrate" and "judge" must be substituted with the word "or".

7.3 Line 57 - the word "is" between the words "or" and "such" must be substituted with the word "if'.

8.    On page 25.

8.1 Lines 16 - 50 must be deleted as same is substituted by line 14 on page 24 to line 15 on page 25.

9.    On page 32 line 25.

9.1 The word "two" must be substituted with the word "four" to avoid a situation where the professional conduct committee may be left with only the legal assessor and a public representative to continue with a professional conduct inquiry. See amendment in section 15(5)(fA).

10. On page 33.

10.1 Line 31 to 50 to be replaced with the following:

Substitution of section 62 of Act 56 of 1974, as substituted by section 62 of Act 89 of 1997

53. The following section is hereby substituted for section 62 of the principal Act:

"Levying of annual fees on certain registered persons

62. (1) The Minister may, on the recommendation of the council, at any time by notice in the Gazette authorize [a professional board] the council to prescribe a fee to be paid annually to the [professional board] council by the registered persons concerned: Provided that in prescribing such fee the [professional board] council may differentiate between persons according to whether they have been registered before or after a date specified in the notice and may vary such fee according to whether it is paid before or after a specific date. and the profession and registration category in which they hold registration.

11.1 The words "and commencement' must be added immediately after the words "short title".
