TO WHOM IT MAY CONCERN
This is to certify that the Department of Justice and Constitutional Development is aware of the above proposal to obtain permission of the National Assembly in terms of Rule 236 to amend section 66 of the Magistrates' Courts Act, 1944 (Act No 32 of 1944).
The Department is at the moment considering the initiation of legislation to amend the said Magistrates' Courts Act. The proposal of the above Member of Parliament is being covered by the Department's draft proposals and therefore, it need not be promoted separately, as the intention is to bring the said section 66 into line with the Constitutional Court's judgment in Jaftha v Schoeman & Others.
