POLICY FRAMEWORK FOR FULL-TIME COUNCILLORS

AND

FORMULAE FOR NUMBER OF COUNCILLORS

A. BACKGROUND

  1. In terms of section 18(3) of the Local Government: Municipal Structures Act, the number of councillors in a municipal council must be determined by the MEC for local government in the province concerned.

2. In terms of section 20 of the Act, an MEC’s determination must be in accordance with a formula which must be based on the number of registered voters on each municipalities segment of the national common voters roll.

  1. Furthermore, in terms of section 18(4) of the Act, the MEC must determine which councillors may be designated as full-time. An MEC’s determination must be in accordance with a policy framework determined by yourself.
  2. A proposed policy framework for full-time councillors as well as different options of formulae for the determination of the number of councillors for Category A, B and C municipalities was forwarded to the nine MECs responsible for local government, SALGA and it’s nine provincial affiliates for comment. A copy of the circulated document is at annexure "A".
  3. A summary of all the comments received up to 13 March 2000 is outlined hereunder –

Western Cape

  • With regard to Category A municipalities, it is suggested that full-time councillors should be extended to include a member of council who is a chairperson of a committee, but not a member of an executive committee
  • With regards to Category B municipalities, the following is preferred –
  • Speakers of municipalities – with 50 seats or more
  • Members of an EXCO of municipalities; Executive mayors of municipalities; and Members of Mayoral committees of municipalities – with 40 seats or more
  • With regards to Category C municipalities, it is suggested that Speakers be appointed on a part-time basis

 

KWANALOGA

KwaZulu-Natal

  • Since the restructuring process is to decrease the number of councillors, it is proposed that the determination of full-time councillors be dependent on the requirements of the council
  • The proposal for Category B and C municipalities was accepted, however, certain municipalities suggested that all ward councillors be full-time, and that Speakers should be part-time as the councils will only be required to meet on a quarterly basis
  • Concerned that the number of wards will be determined by the number of registered voters, and would prefer a determination based on the number of persons per ward. However, should an amendment of the Structures Act not be affected, Option 1 proposed by the Department for the determination of councillors in Category A municipalities, is preferred
  • Regional councils have expressed the view that, considering the functions and powers of District Councils in terms of the Structures Act and the wide geographic areas to be covered, the "ceiling" for the number of councillors should be higher

KwaZulu Natal

  • Supports the proposal for Category A municipalities
  • With regards to Category B municipalities, supports the maximum cut-offs for each office, namely –
  • 1 Speaker per 30 councillors or more
  • EXCOs and Executive Mayor Committees per 50 councillors or more
  • Executive Mayor per 50 councillors or more
  • Supports the proposed option 1
  • Supports the proposed maximum number of councillors for Category C
  • Concerned about the use of the National Voters Roll that was used for the June 1999 general elections

African National Congress

Western Cape

  • Supports the principle of full-time councillors
  • Proposes that in Category B and C municipalities –
  • There must be speakers for all municipalities
  • The speaker must be full-time if there are more than 20 councillors
  • Municipalities with a council of 20 and more members may have an EXCO
  • Municipalities with a council of 20 and more members may have an Executive Mayor
  • All members of the EXCO and Mayoral Committee should be full-time members
  • Of the opinion that the relevant council should have the final say in deciding on the system

LOGAM

Mpumalanga

  • Supports the proposed option 2 for Category B municipalities

SALGA

Head Office (Pretoria)

  • Supports the proposed framework for full-time councillors, and suggests that ward councillors are also made full-time
  • Proposes different formulae for the different Categories of municipalities

  1. POLICY FRAMEWORK FOR FULL-TIME COUNCILLORS

  1. Having regard to the comments received in respect of the proposed policy framework for full-time councillors, it is clear that there is general support for the proposal that the Speaker (in certain circumstances), Members of Executive Committees, Executive Mayors, Members of Mayoral Committees and the Chairpersons of Sub-Councils be appointed on a full-time basis.

2. A number of comments that were received requested that provision be made for all ward councillors to be designated as full-time members of councils. If all ward councillors are designated as full-time, this would result in half the councillors being full-time, and which will result in severe financial implications for all municipalities.

3. As far as the Speaker is concerned, the full-time status of this Office should be considered in light of the fact that the only function assigned to this Office is Chairperson of the Council, as well as the fact that councils are obliged to meet only four times a year.

4. The following policy framework for full-time councillors is proposed:

The MEC responsible for local government in a province may determine that councillors who have been elected or appointed to the following Offices in terms of the Municipal Structures Act may be designated as full-time –

  1. FORMULAE FOR NUMBER OF COUNCILLORS

  1. Having regard to the comments received in respect of the formulae for determining the number of councillors, the majority of the stakeholders expressed a preference in respect of the second option as set out in annexure "A". The Department of Traditional and Local Government Affairs in KwaZulu-Natal pointed out that the proposals contained in the circulated document were not formulae as envisaged in section 20 of the Act, but were models for determining the number of councillors.

2. Proper formulae have now been developed for each category of municipality, and which are set out hereunder.

CATEGORY A MUNICIPALITIES

As most stakeholders supported option 2 proposed by the Department, a maximum number of 220 councillors was applied for 1.6 million voters. The latter figure is greater than the biggest metropolitan area, namely Johannesburg, with 1.557 million registered voters.

The lower point on the scale is 300 000 voters, which equates to 90 councillors.

Graphically illustrated, the formula would be represented thus –

This means that in the Johannesburg metropolitan area –

y = (x ÷ 10 000) + 60

Where "y" represents the number of councillors, and "x" represents the number of registered voters in the metropolis.

Applying the formula –

The number of councillors = (1 555 790 ÷ 10 000) + 48

= 156 + 60

= 216

Therefore, the number of councillors for the Johannesburg metropolitan area would be 216.

Applying the formula to the other metropolitan areas, yields the following results:

The existing number of seats occupied at metropolitan level is 1 296, and a decrease of 302 seats would be obtained if the formula is applied.

CATEGORY B MUNICIPALITIES

It should be noted that Category B municipalities range from a minimum of 2 114 registered voters (NP364), to a maximum of 328 459 registered voters (EC125). A total of 23 municipalities have less than 7 500 registered voters, while 217 municipalities have registered voters that range between 7 501 and 100 000, and 26 municipalities that have registered voters that range between 100 001 and 328459.

In developing a formula for this category of municipality, a maximum number of councillors, 90 as per the Act, was applied for 350 000 voters or more. The latter figure is slightly greater than the largest B municipality and will amply cater for an increase in the number of registered voters should this increase during the forthcoming registration process.

Although the Act stipulates a minimum of 3 councillors, a minimum number of 5 councillors was applied for 7 500 or less voters. A maximum of 60 councillors was applied for 100 000 voters.

Between 100 001 and 350 000 voters, a minimum of 60 councillors and a maximum of 90 councillors was applied respectively.

In effect, Category B municipalities would therefore apply 1 of 3 formulae, depending on the number of registered voters in that municipality. The formulae are –

y = 5 - for municipalities that have less than 7 501 registered voters;

y = (x ÷ 1 682) + 1 - for municipalities that have between 7 501 and 100 000 registered voters; and

y = (x ÷ 8 333) + 48 - for municipalities that have more than 100 000 registered voters.

Where "y" represents the number of councillors, and "x" represents the number of registered voters in the relevant municipality.

Graphically illustrated, the formulae would be depicted thus –

This means that in DC 38 in the North West Province, which is made up of NW381 to NW386 –

NW385 will have y = 5 councillors because it has 3 800 registered voters, and in terms of section 22(4) of the Act it will have no wards as the number of councillors are less than 7;

NW386 will have y = (x ÷ 1 682) + 1 councillors because it has 51 309 registered voters i.e.

The number of councillors = (51 309 ÷ 1 682) + 1

= 31 + 1

= 32

Therefore, the number of councillors for NW386 would be 32; and

NW383 will have y = (x ÷ 8 333) + 48 councillors because it has 134 669 registered voters i.e.

The number of councillors = (134 669 ÷ 8 333) + 48

= 16 + 48

= 64

Therefore, the number of councillors for NW383 would be 64.

Option 2 of the model submitted for comment resulted in 7 675 councillors while the existing number of seats occupied at Category B level is 8 407. After applying the formulae to all the Category B municipalities, it has been determined that a total of 6 451 councillors will be generated.

CATEGORY C MUNICIPALITIES

46 Category C municipalities have been proposed by the Municipal Demarcation Board, and they range from a minimum of 24 328 registered voters (DC5), to a maximum of 712 207 registered voters (DC12).

Bearing the above in mind, and having regard to item 15(3) of Schedule 2, formulae for this Category of municipality was developed by allocating a minimum of 12 councillors for 24 000 voters, and a maximum of 40 councillors for 100 000 voters.

Between 100 001 and 720 000 voters, a minimum of 40 councillors and a maximum of 70 councillors was applied respectively - the Act stipulates a minimum of 3 and a maximum of 90 councillors for this category of municipality.

In effect, Category C municipalities would therefore apply 1 of 2 formulae, depending on the number of registered voters in that municipality. The formulae are –

y = (x ÷ 9 500) + 9 - for municipalities that have less than 100 001 registered voters; and

y = (x ÷ 12 000) + 12 - for municipalities that have between more than 100 000 registered voters.

Where "y" represents the number of councillors, and "x" represents the number of registered voters in the relevant municipality.

Graphically illustrated, the formulae would be depicted thus -

This means that, in the Western Cape Province, which is made up of DC1 to DC5 –

DC1 will have y = (x ÷ 9 500) + 9 councillors because it has 99 250 registered voters i.e.

The number of councillors = (99 250 ÷ 9 500) + 9

= 10 + 9

= 19

DC2 will have y = (x ÷ 12 000) + 12 councillors because it has 257 755 registered voters i.e.

The number of councillors = (257 755 ÷ 12 000) + 12

= 21 + 12

= 33

DC3 will have y = (x ÷ 9 500) + 9 councillors because it has 77 235 registered voters i.e.

The number of councillors = (77 235 ÷ 9 500) + 9

= 8 + 9

= 17

DC4 will have y = (x ÷ 12 000) + 12 councillors because it has 180 310 registered voters i.e.

The number of councillors = (180 310 ÷ 12 000) + 12

= 15 + 12

= 27

 

 

 

DC5 will have y = (x ÷ 9 500) + 9 councillors because it has 24 328 registered voters i.e.

The number of councillors = (24 328 ÷ 9 500) + 9

= 3 + 9

= 12

DC4 is made up of WC041 to WC048 – a total of 8 Category B local councils, and the table below indicates the number of voters and the number of councillors that each local council will have after applying the relevant formula that have been developed.

In terms of section 23 of the Act, the number of councillors representing local municipalities and district management areas (DMAs) must be equal to 60% of the number of councillors determined for the municipality in terms of the formula determined in terms of section 20 (fractions to be disregarded), before any increase in terms of section 20(5), plus the increase.

This means that in DC4, 16 seats (i.e. 60% of 27 seats) must be allocated to councillors representing local councils and DMAs.

The number of seats allocated to the respective local councils and DMAs is done in accordance with Part 2 of Schedule 2. This is done by dividing A (the total number of registered voters on the DC – 180310) by B (the number of seats determined in terms of section 23(2)(a) – 16), PLUS 1.

Computing this – (A ÷ B) + 1 = (180 310 ÷ 16) + 1

= 11 269.375 + 1

= 11 270 (disregarding the fraction)

11 270 will therefore be the quota of registered voters that each local council or DMA must have in order to be entitled to a seat on a DC. Each local council and each DMA is entitled to a number of seats on the DC determined by dividing the total number of voters registered on the segment of the national common voters’ roll for that local council or DMA by the quota of votes for a seat on the DC.

If the above calculation yields a fraction of the figure 1, the council or DMA must be awarded one seat and must not participate in any further calculation or award. If a surplus is obtained, that surplus must compete with similar surpluses of any other council or DMA, and any seats not awarded in terms of the above provisions, must be awarded in sequence of the highest surplus.

The number of proportionally elected councillors is done in accordance with Part 1 of Schedule 2 by voters registered on that municipality’s segment of the national common voters roll, to proportionally represent the parties that contested the election in that district municipality.

In this case, 11 seats (assuming that an increase was not effected in terms of section 20(5) must be proportionally allocated to the contesting parties.

The proposal that was submitted for comment resulted in 1 230 councillors, and the existing number of seats occupied at Category C level is 2 180. After applying the formulae to the Category C municipalities, it has been determined that a total of 1 364 councillors will be generated.

  1. Attached at annexures "B" and "C" are schedules that indicate the number of councillors that will be determined for each of the newly established Category B and C municipalities respectively.

  1. RECOMMENDATION

In order to provide impetus to sections 18(4) and 20 of the Local Government: Municipal Structures Act, it is recommended that the Schedules be approved for publication in the Government Gazette.

 



APPLICATION OF THE FORMULAE FOR THE DETERMINATION OF THE NO. OF COUNCILLORS FOR MUNICIPALITIES

On 5 April 2000 the Minister for Provincial and Local Government, vide Government Gazette No. 21065, determined the following formulae for the determination of the number of councillors for each of the newly demarcated municipalities –

CATEGORY A MUNICIPALITIES

y = (x ÷ 10 000) + 60

CATEGORY B MUNICIPALITIES

 

y = 5 - for municipalities that have less than 7 501 registered voters;

y = (x ÷ 1 682) + 1 - for municipalities that have between 7 501 and 100 000 registered voters; and

y = (x ÷ 8 333) + 48 - for municipalities that have more than 100 000 registered voters.

 

CATEGORY C MUNICIPALITIES

 

y = (x ÷ 9 500)+9 - for municipalities that have less than 100 001 registered voters; and

y = (x ÷ 12 000)+12 - for municipalities that have between more than 100 000 registered voters.

Where "y" represents the number of councillors, and "x" represents the number of registered voters in the relevant municipality.

After applying the formulae to the relevant municipalities, and taking into account the number of registered voters for each of the newly demarcated areas as at 31 March 2000, the tables that follow indicates the number of councillors that are determined for each municipality. It should be noted that MEC’s may deviate from these determinations, but only in terms of the provisions of section 20 of the Structures Act.
