SHERIFFS AMENDMENT BILL (B2-98)
1. Thank you for the opportunity to comment on this Bill
2. Clause 15 of the Bill creates a new offence when a person impersonates etc. etc. a sheriff. The proviso in this Section excludes "any legal practitioner or his or her employees..." Section 3(b) of the Magistrates' Courts Amendment Act, 1997 (Act 81 of 1997) empowers attorneys and candidate attorneys to serve certain documents. Perhaps it will be a good idea to bring Clause 15 of the Sheriffs Amendment Bill in line with Section 3 (b).
