What are the reasons that it took so inordinately long for the Special Investigating Unit to be issued with a proclamation to investigate the massive scandal of non-delivery and wanton corruption involving the payment of R8.3 billion to Denel Land Systems?

Reply:

The Special Investigating Unit (SIU) submitted a motivation for a Proclamation to investigate allegations in respect of certain affairs of Denel SOC Limited (“Denel”) and business divisions in which Denel is a majority shareholder to the Department of Justice and Constitutional Development (DOJ) on 14 November 2018.

The DOJ processed the request which was approved by the President and Proclamation No. R.32 of 2019 (“the Proclamation”) was published in the Government Gazette No. 42562 dated 5 July 2019.

On 11 July 2019, the SIU submitted a motivation for the amendment of the Proclamation to include an additional matter for investigation which was processed and Proclamation No. R.57 of 2019 was published in the Government Gazette No. 42828 dated 8 November 2019.

The investigation included investigation into unlawful, irregular or unapproved measures or practices in relation to the misappropriation of proprietary and intellectual property rights in Denel’s Air-to-Air missiles, Stand-off Weapons, Surface Target Missiles, Air Defence and Unmanned Aerial Vehicle systems.

The issuing of the Proclamation and the amendment of the Proclamation was finalised and published within the timeframes required to consider and publish SIU Proclamations.
