Minutes of Committee Meetings dated 4 July 2006 and 21 August 2006
SUMMARY
Sport and Recreation South Africa briefed the Committee on the two Bills
making special provision for the staging of the 2010 Soccer World Cup in South
Africa.
Members raised questions about fan zones, exclusive use areas, designated areas
and the role of traditional leaders. Both Bills were subsequently approved
unanimously and without amendment.
MINUTES
Provincial mandates on Second 2010 FIFA World Cup South Africa Special Measures
Bill (Section 76)
The Chairperson welcomed all Members and in particular the special
delegates from the Eastern Cape and KwaZulu-Natal (KZN) for their loyal
participation.
He requested each province to declare the status of their final mandates. All
provinces supported the Bill without any amendments. However, the Chairperson
noted that he had received an unsigned mandated (in favour of the Bill) from
Mpumalanga and was not certain about its status.
Mr M Sulliman (ANC, Northern Cape) advanced that it should be accepted because
it was a question of formality that would later be ratified.
Mr T Setona (ANC, Free State) opposed this view. He said that the province’s
position should be noted but it cannot be assumed that it was a mandate.
Furthermore, he cautioned against ignoring the rules of the legislatures.
The Chairperson concurred with the latter view and resolved that a majority of
provinces supported the Bill (8 in total) and read out a motion of
desirability. This was agreed to unanimously.
Sport and Recreation South Africa (SRSA) briefing
Adv G Boschoff (SRSA Legal Advisor) briefed the Committee about the Bills and
explained all the complex issues.
The Chairperson reminded Members that the Bills had already been extensively
deliberated and that no amendments would be entertained. He however invited
Members to ask questions and make comments.
Discussion
Second 2010 FIFA World Cup South Africa Special Measures Bill (B16-2006)
Ms F Mazibuko (ANC, Gauteng) sought an explanation regarding the creation
of fan zones.
The Chairperson explained that its purpose was to provide those who could not
afford tickets an opportunity to participate and share in the World Cup
experience. He mentioned that the German organisers were very successful in
this regard.
Referring to rumours, Ms Mazibuko questioned whether ordinary people would
be allowed to sell their merchandise at the events.
The Chairperson answered that this was a FIFA protected event. He offered that
only those that had accreditation would be permitted to sell and advertise in
the designated areas. Lastly, he commented that outside these designated areas,
anybody could engage in any activity.
Mr L Suka (ANC, Eastern Cape) sought clarity concerning Clause 4(4)(a).
Advocate Boschoff stated that the provision was intended to ensure transparency
and proper procedure in the event that any person wanted to conduct business in
the country 6 months after the World Cup.
Mr Suka enquired about the meaning of ‘stakeholder’ in Clause 5(1)(a).
Advocate Boschoff advised that this referred to a vendor that is located in a
designated area. He affirmed that these vendors would be properly consulted
before any decisions are taken.
Mr Suka persisted wanting to know what would happen to immovable items in
designated areas.
Advocate Boschoff confirmed that Stadium Use Agreements would be signed to
ensure that the stadiums are clean (free of non-sponsor advertising) for a
certain period and that the name of stadiums had to be changed.
The Chairperson added that advertisers paid vast amounts of money for this
privilege and that such measures were needed to avoid ambush marketing.
Mr Sulliman queried whether the protected areas included airspace.
The Chairperson responded that this issue had already been dealt with.
Ms J Vilakazi (IFP, KZN) notified the Committee that traditional leaders wanted
to be involved in the process. She urged the organisers to consult them.
Mr Setona replied that traditional leaders operated in a prescribed and limited
jurisdiction. He suggested that their demands went beyond their jurisdiction.
The Chairperson commented that nothing prevented the National House of
Traditional Leaders from making presentations to this Committee or to the Local
Organising Committee (LOC)
Members unanimously adopted the Second 2010 FIFA World Cup South Africa Special
Measures Bill.
2010 FIFA World Cup South Africa Special Measures Bill (B13-2006)
This Bill was universally endorsed whereafter the Chairperson read out
a motion of desirability.
