1. Liquor Bill [B 131B-98]
Eastern Cape, Gauteng, Mpumalanga, Kwazulu-Natal, North West and Free State had indicated that they support the process that was followed when the Bill was remitted. Northern Cape did not have a response yet at the time of the committee meeting. Western Cape indicated that more time was needed to fully consider the President's reservations.

Furthermore, it would now be up to the Constitutional Court to decide on the constitutionality of the bill.

2. Harmful Business Practices Amendment Bill [B 138B-98]
The Committee proceeded to consider the above mentioned bill. Motion of Desirability, agreed to.

Clause 2, on page 6, in line 10, after "Minister" to insert: 'in an open and transparent manner,
Clause 3, agreed to.
Clause 4, agreed to.
Clause 5' agreed to.
Clause 6, on page 10, from line 13, to omit subsections (4A) and (4B).

Clause 9, on page 12, in line 42, after "bearer" to insert", serving public representative"; On page 12, after line 52, to insert the following paragraphs:
(g) is of unsound mind; or
(h) is a member of a competent authority
On page 12, in line 54, after "interest" to insert or an interest of his or her spouse, immediate family member, business partner or associate or employer
On page 12, after line 54, to insert the following subsection:
(3F) If at any stage during the hearing of an appeal, one of the members of the special court dies or becomes otherwise incapable of acting, the hearing shall be adjourned and commenced de novo before a newly constituted special court
On page 14, in line 17, to omit all the words after the second "court" up to and including "alone" in line 20 and to substitute:
but the president alone shall decide any question of law, and whether any matter constitutes a question of law or a question of fact, and for that purpose he or she shall sit alone

Harmful Business Practices Amendment Bill [B 138B-98], agreed to with amendments [B 138C-98].

3. Comprehensive Nuclear Test-Ban Treaty (CTBT)
Mr Mcqueen gave a briefing on the above mentioned treaty.

Negotiations on this treaty commenced in 1994. South Africa was the initiator of the negotiations by calling for a treaty to halt the production of nuclear weapons of mass
destruction. Five stations that are able to detect nuclear explosions are in South Africa. The Seismic monitoring system would detect any nuclear explosion taking place under ground. The Hydrocoustic network would detect any nuclear explosion taking place under water. Other systems will pick up xenon gas that is emitted in a nuclear explosion. The signatories to the treaty have investigation powers when there is reason to believe that a country is involved in nuclear testing.

The Committee approved the treaty.
