The meeting was not quorate. A general discussion ensued about the various proposed bills and process. The main discussion centred on the draft bill of Mr P Smith (IFP) which would change the constitution to allow for the return of the death penalty.

CONSTITUTION OF THE REPUBLIC OF SOUTH AFRICA
AMENDMENT BILL
[Private Member's Bill: PF Smith]

To amend the Constitution to enable Parliament to adopt legislation imposing the death penalty as determined by law and to provide for matters incidental thereto.

Be it enacted by the Parliament of the Republic of South Africa as follows.

1. Capital Punishment
Subsection 12(1)(e) of the Constitution of the Republic of South Africa. 1996 is hereby amended by substituting the word "or" the first time it occurs with the punctuation "," and by adding the words "or executed" after the word "punished".

2. Short Title
This Act shall be referred to as the "Capital Punishment Constitutional Amendment Act".

MEMORANDUM
This Bill has the purpose of allowing Parliament to enact legislation which imposes capital punishment for crimes identified by law and to ensure that the administration of such punishment complies with the requirement of humanity and lack of cruelty and degradation of the persons concerned.

Clause 1 of the Bill amends subsection 12(1)(e) of the Constitution to clearly provide far the possibility of capital punishment within the constraints and guarantees of the remainder at the provision.

Clause 2 provides for the short title.
