SUMMARY
In the voting on the Immigration Amendment Bill, the Democratic Alliance objected to Clause 5, which the party felt was too exclusive and not hospitable to civil society. The Chairperson noted a passive objection by the Democratic Alliance to Clause 15. The Bill was voted on as a whole and adopted with amendments.

The Committee then discussed their objection to an 'adult shop' operating in full view to Parliament. As this was currently operating legally, Members felt the relevant legislation should be revisited to address their concerns.

The motion to vote on the Amendment Bill was adopted.

Ms Kalyan mentioned the DA's objection to Clause 5 of the Amendment, which the party felt was too exclusive and not hospitable to civil society. The Chairperson noted a passive objection by the DA to Clause 15.

The Portfolio Committee adopted the Bill with amendments.

 

Adult shop near Parliament
In the Committee meeting of the previous day, the Chairperson had voiced his concern about an 'adult shop' situated in clear view of Parliament. He had asked the legal advisors to research the present legislation protecting these shops, because he wanted it resituated where it would not offend Parliamentarians.

Mr Mateba, State Law Advisor, now reported on the legal status of the Adult Shop. At present, the Film and Publications Act protected the shop, and Members would not have sufficient grounds to relocate it. It could only be shut down if it contained video materials that had not been licensed by the municipality.

Mr Wang asked if this meant adult shops might open wherever they pleased, including nearby to schools and churches. Ms A Van Wyk (ANC) said the shops were prohibited from operating within a specific vicinity to churches and schools. She suggested that Members take their complaint to the City Council. She noted that the shop had previously operated for four years on a site also near to Parliament, and there had been no resistance then from Parliament officials.

The Chairperson replied that the previous site was not in view of Parliament. Members of the ANC concluded that legislation would have to be revisited to find a solution.
