The Budget Committee met to consider and adopt its Final Mandate on the 2023 Division of Revenue Bill. During the meeting, it was noted that National Treasury met the Committee’s recommendations with the statement, “No recommendations”. Some Members of the Committee were disappointed by their response.

The Committee maintained its position to not support the Bill. The minority vote to support the Bill was noted for the African National Congress (ANC) and Al Jama-ah.

Meeting report

Opening
The Chairperson asked Ms W Kamish-Achmat, Procedural Officer of the Western Cape Provincial Parliament (WCPP), to confirm the responses received from National Treasury.

She acknowledged that the responses had been sent through and that the Western Cape received no responses from National Treasury.

She requested that the final mandate be flighted for all Members to see.

Final Mandate on the Division of Revenue Bill
Whilst the document was flighted, the Chairperson explained that the Committee usually went through the National Treasury responses to the province based on the negotiating mandate. Should the Bill change or Members be satisfied with it, then the Members are free to place their new view; which is regarded as the final mandate.

The mandate was flighted and the Chairperson noted National Treasury responded, “No recommendations”.

The Chairperson asked that the Members share their views on how they want to vote on the final mandate.

Mr D America (DA) said that regardless of the response from National Treasury, the Committee had formulated reasons as to why it did not support the Bill. In light of this, he did not feel said reasons had been adequately addressed by the National Council of Provinces (NCOP) when considering the Bill. Therefore, he proposed the Committee stick to its original position in the negotiating mandate [to not support the Bill].

Ms C Murray (DA) seconded Mr America’s (DA) proposal.

Mr L Mvimbi (ANC) proposed the Bill be supported, in line with the minority view expressed in the negotiating mandate. He suggested that perhaps what is meant by “no recommendations” is that the Western Cape just submitted reasons for not supporting the Bill but did not offer any proposals.

To this, the Chairperson responded by saying she remembered the Committee made several recommendations (regarding: provincial equitable share, unallocated money, energy money, inclusion of home-based care data) in their submitted negotiating mandate. She noted that she cannot speak on behalf of National Treasury. She expressed disappointment in National Treasury's response and wondered if they do not consider the Western Cape as important as the other provinces.

She asked for the draft report to be edited with their current views in mind.

Mr G Brinkhuis (Al Jama-ah) expressed his minority view in support of the Bill.

The Chairperson read the edited report for the record.

The report was adopted with the changes. It would be sent to the NCOP as the final mandate.
