SUMMARY
The Committee heard the proposal for a new amendment to the General Intelligence Laws Amendment Bill from the Ministry, Intelligence Services. The Bill was unanimously adopted with the new amendment.

MINUTES
Ms T Netshitenzhe (Legal Adviser) read out the proposed amendment that gave the right to the directors and employees of Comsec to become members of any medical scheme established in terms of the Intelligence Services Act, 2002 (Act No. 65 of 2002).

Discussion
Ms Netshitenzhe said that the National Assembly already approved the above mentioned amendment and asked the Ad hoc Intelligence Legislation Committee to consider adopting it in the Bill.

The Chairperson asked whether the amendment applied to all employees of Comsec.

Mr D Dlono (Head of the Ministerial Services) explained that theoretically the amendment did apply to all employees of Comsec but it was not compulsory.

The Chairperson asked the State Law Adviser if the amendment was written in the proper legal terms.

Mr Hoon (State Law Adviser) said that he was satisfied with the formulation of the new amendment.

The Chairperson asked the Committee members if they had any questions. There were none. e asked if all were in favour of the proposed amendment. All members agreed to adoptting the Bill with the new amendment.

The Chairperson announced that after consideration by the members, the General Intelligence Laws Amendment Bill [B47B-2003] was passed with the new amendment.

The meeting was adjourned.

The Select Committee on Security and Constitutional Affairs, having considered the subject of the General Intelligence Laws Amendment Bill [B47B-2003] (National Assembly - sec 75), referred to it, reports the Bill with a proposed amendment, as follows:

1. That the following be a new Clause:

NEW CLAUSE

Amendment of section 14 of Act 68 of 2002
19. Section 14 of the Electronic Communications Security (Pty) Ltd Act, 2002, is hereby amended by the addition of the following section:
"(5) Notwithstanding any other law, the directors and employees of Comsec may be members of any medical scheme established in terms of the Intelligence Services Act, 2002 (Act No. 65 of 2002).".
