SUMMARY
Members were briefed on the latest developments in the Petroleum Products Amendment Bill and Petroleum Pipelines Bill. Due to time constraints there was little discussion of the details.

MINUTES
Mr Gumede (Chief Director: Hydrocarbons) briefed members on the two pieces of legislation (see presentation).

Discussion on Petroleum Pipelines Bill
Dr Conroy (NNP) asked about a definition in section 6(a) and 20(1b). He wondered whether "South African citizen" should not read "individual" as South Africa is a sovereign country and therefore the laws abide for all.

Mr Gumede replied that this bill was formulated in 2000 already and that not all of the definitions are aligned yet. It will still be done.

Dr Conroy (NNP) commented that he liked the definition as it is but that it was not consistent with other pieces of legislation such as the Employment Equity Bill and Black Economic Empowerment Bill.

Mr Adams asked if the Minister would consult first before making appointments to the regulatory body. Would there be a shortlist?

Mr Gumede replied that there will be a process. The positions will be publicly advertised. He will inform the Committee of the details.

Discussion on Petroleum Products Amendment Bill
Dr Conroy stated that the definition in Clause 2c (1a) poses the same problems as in the previous Bill.

Ms Mtwanambi (ANC) asked whether one person could hold licences for Manufacturing, Site and Wholesale and Retail.

Mr Gumede replied that not all these activities are currently licensed. What this Bill is saying is that everyone will get licences if they comply with national, provincial and local legal requirements. You cannot hold all three licences at the same time as you cannot be a wholesaler and retailer at the same time.

The meeting was adjourned due to time constraints.
