Administrative Adjudication of Road Traffic Offences Amendment Bill [B42-2002]

SUMMARY
The committee met to discuss and consider the amendments to the Administrative Adjudication of Road Traffic Offences Amendment Bill. The few technical amendments were agreed to unanimously by members.

MINUTES
Amendments Agreed to Administrative Adjudication of Road Traffic Offences Amendment Bill

The Chair, Mr J Cronin, pointed out that there were a few NCOP amendments to the Bill.
Please refer to Appendix for Amendments.

The first amendment on Clause 2 concerned the amendment of section 2 line 18 amendment of national and provincial and municipal bye-laws with 'municipal bye-laws'

The second amendment on Clause 14 was to add movable, as in movable property.

Mr Ainsley (ANC) expressed concern that movable was deemed as the suitable term to use. The chair pointed out that since the state law advisers were not in attendance the committee would not be able to discuss the issue at length and since they were the ones responsible for these changes, they would on consultation be able to clarify the usage. He suggested that the committee went ahead with other amendments, this one withstanding.

The chair pointed out that the long title of the bill included the caption, ' to further regulate the appointment of sheriffs, usually the Minister of Transport had the jurisdiction in this regard, but in the above case, the Minister of Justice was responsible for the appointment.

A member expressed concern that no state legal advisers were in attendance since they were dealing with the amendment of a bill.

The amendments were unanimously agreed upon.

Meeting adjourned.
