Meeting Summary

The Committee met to hear final mandates on various Bills as well as to consider and adopt the Committee’s Legacy Report and Outstanding Minutes for 8 and 11 March 2014 which was done without amendments.

On the Restitution of Land Rights Amendment Bill, five provinces, namely, the Eastern Cape, Limpopo, Mpumalanga, Northern Cape and North West voted in favour of the Bill while the Western Cape Province did not vote in favour of the Bill. With five votes in favour and one against, the Restitution of Land Amendment Bill was adopted by the Committee.
On the Property Valuation Bill. because the Bill was tagged as a section 75 bill, provincial mandates were not heard and instead Members indicated their individual votes on the Bill. Six Members voted in favour while the DA voted against the Bill. With this majority, the Property Valuations Bill was adopted by the Committee.

On the National Environmental Management Laws Third Amendment Bill, six provinces, namely, the Eastern Cape, Limpopo, Mpumalanga, Gauteng, Northern Cape and North West voted in favour of the Bill while the Western Cape did not vote in favour of the Bill. With six votes in favour and one against, the National Environmental Management Laws Third Amendment Bill was adopted by the Committee.

Finally on the National Environmental Management Waste Amendment Bill, five provinces, namely, the Eastern Cape, Gauteng, Limpopo, Mpumalanga and Northern Cape voted in favour of the Bill while the Western Cape and North West did not vote in favour of the Bill. The North West Province sough more time to deliberate the Bill. With five votes in favour and two against, the National Environmental Management Waste Amendment Bill was adopted by the Committee.

Apologies
The Chairperson noted that apologies were received from Prince M Zulu (IFP, KZN), Mr M Mokgobi (ANC, Limpopo) and Ms N Ntwanambi (ANC, Western Cape).

Final Mandates on the Restitution of Land Rights Amendment Bill
Eastern Cape Final Mandate

The Chairperson stated that the Eastern Cape Province had voted in favour of the Bill without further amendments.

The Committee accepted the final mandate.

Limpopo Final Mandate
Mr T Makunyane (ANC, Limpopo) stated that the Province voted in favour of the Bill. 

The Committee accepted the final mandate.

Mpumalanga Final Mandate
In the absence of a permanent delegate, the Chairperson presented the Mpumalanga Province’s final mandate to the Committee saying that the Province had voted in favour of the Bill.

The Committee accepted the final mandate.

Northern Cape Provincial Legislature
Mr G Mokgoro (ANC, Northern Cape) stated that the Northern Cape Province voted in favour of the Bill. 

The Committee accepted the final mandate.

North West Final Mandate
In the absence of a permanent delegate, the Chairperson presented the North West Province’s final mandate to the Committee saying that the Province had voted in favour of the Bill.

Mr D Worth (DA, Free State) noted there were, what appeared to be, certain terms and conditions attached to the Province’s mandate. He was concerned about this because this was a final mandate and not a negotiating mandate.

The Chairperson reiterated that this was a final mandate and the Province voted in favour of the Bill. 

Western Cape Final Mandate
Mr O De Beer (COPE, Western Cape) stated that the Western Cape Province voted against the Bill. 

KZN Mandate
Ms N Magadla (ANC, KZN) apologised on behalf for her Province, Kwazulu-Natal, who was still deliberating final mandates on all Bills on the Committee’s agenda today.

Voting on the Restitution of Land Amendment Bill
The Chairperson called for a motion of desirability and thereafter the provinces agreed to pass the Bill with amendments.

Mr Worth wanted to hand in his party’s, the DA’s, minority report as the party had presented proposed amendments to the Bill which were rejected in the House so he wanted this to be recorded. 

Mr De Beer remarked that the meeting was for carrying of the mandates of the provinces and not parties.

Mr Worth said he was entitled to submit a minority report and for to be noted. 

The Chairperson would note the minority report but she agreed with Mr De Beer that the Committee was dealing with provincial mandates. 

The Chairperson read out the Select Committee Report on the Restitution of Land Rights Amendment Bill. 

The Committee adopted the Committee Report.

A statement on the Bill would be made in the House on 27 March 2014 which would be read by the Chairperson. 

Voting on the Property Valuation Bill
The Chairperson asked that the Members indicate whether they supported the Bill or not. 

Mr Mokogoro accepted the Bill.

Mr M Makhubela (ANC, Limpopo) accepted the Bill.

Mr Worth rejected the Bill.

Mr De Beer supported the Bill.

Mr Makunyane supported the Bill.

Ms Magadla supported the Bill.

The Chairperson supported the Bill.

With six votes in favour and one against, the Property Valuation Bill was adopted by the Committee.

The Chairperson read out the Report of the Select Committee on the Property Valuation Bill.

The Committee adopted the Report. 

Mr Worth wanted the rejection of the DA noted in the Report.

The Chairperson said there would be a statement on the Bill in the House on 27 March 2014 by herself.

Consideration and Adoption of Committee Legacy Report
The Chairperson noted Members had the Report already to read at their leisure so now it just needed to be adopted. 



The Committee adopted the Select Committee Legacy Report.

Eastern Cape Final Mandates
The Chairperson said the Eastern Cape Province voted in favour of the adoption of the Bill.

The Committee accepted the final mandate. 

Gauteng Final Mandate
In the absence of a permanent delegate, the Chairperson presented the Gauteng Province’s final mandate to the Committee stating the Gauteng Province voted in favour of the Bill.

The Committee accepted the final mandate.

Limpopo Final Mandate
Mr Makunyane stated the Limpopo Province voted in favour of the Bill.

The Committee accepted the final mandate.

Mpumalanga Final Mandate

In the absence of a delegate from the Province, the Chairperson presented the Mpumalanga Province’s final mandate to the Committee stating the Province voted in favour of the Bill.

Northern Cape Final Mandate
Mr Mokgoro stated the Northern Cape Province voted in favour of the Bill.

The Committee accepted the final mandate. 

North West Final Mandate
In the absence of a delegate from the Province, the Chairperson presented the North West Province’s final mandate stating the Province did not vote in favour of the Bill to allow for further consultation on the Bill.

Western Cape Final Mandate
Mr De Beer stated the Western Cape Province did not vote in favour of the Bill. 

Voting on the National Environmental Management Waste Amendment Bill
With five provinces voting in favour, the National Environmental Management Waste Bill was adopted by the Select Committee.

The Chairperson called for a motion of desirability and thereafter the provinces agreed to pass the Bill with the amendments.

The Chairperson read the Select Committee Report on the National Environmental Management: Waste Amendment Bill

The Committee adopted the Committee Report.

Closing Remarks
The Chairperson noted the mediation committee would be meeting today at 13h15 on the Integrated Coastal Management Bill.

She wished the Members farewell and asked them to campaign for the elections nicely.
