Meeting Summary

The Employment Equity Amendment Bill was agreed to by the Portfolio Committee. Prior to voting, Clauses 1 to 30 of the Bill were read through and approved. The DA abstained from voting on clause 3, on the grounds that equal work for equal pay was nebulously defined. The DA objected to clause 11, on the grounds that it would create onerous problems for the small employer. The DA objected to clauses 13 and 14, on the grounds that it would take things away from inspectors. The abstention and objections were noted, but clauses were adopted, without further debate on the matter. The Portfolio Committee had already agreed to reject clause 23, as it duplicated what was already stated elsewhere.
 

Meeting report

Introduction
Mr Thembinkosi Mkalipi, Department of Labour: Chief Director: Labour Relations, listed the Portfolio Committee amendments to the Employment Equity Amendment Bill. Clauses referred to were clauses 4, 23, 24, 25, 28, 30, and the Long Title. All amendments were minor, and mostly related to punctuation. One sentence was omitted from the Long Title. The Portfolio Committee had agreed to the rejection of clause 23, as it duplicated what was stated elsewhere.

Consideration and adoption
Mr Mkalipi took the Committee through clauses 1 to 30 of the Bill. Each clause was moved for adoption, seconded and adopted.

Clauses 1 and 2 were adopted.

Clause 3 was adopted, with abstention noted by Mr Motau (DA), as he found equal work for equal pay to be nebulously defined.

Clauses 4 to 11 were adopted, with an objection by Mr Motau to clause 11 noted, on the grounds that it would create onerous problems for the small employer.

Clause 12 was adopted.

Clauses 13 and 14 were adopted with an objection by Mr Motau noted, on the grounds that things were being taken away from inspectors.


Clauses 15 to 22 were adopted.

Clause 23 was rejected by the Committee during previous considerations.

Clauses 24 to 30 were adopted.

The Chairperson pronounced the Amendment Bill adopted with amendments.

The Chairperson adjourned the meeting.
