Meeting Summary

The Committee received final mandates from eight provinces on the Spatial Planning and Land Use Management Bill. The Eastern Cape Provincial Legislature had failed to submit its mandate and the Committee was not certain about its position. Nevertheless, the Bill was approved as seven provinces supported it, with the Western Cape Provincial Legislature being the only exception.
 

Meeting report

The Chairperson welcomed the Minister Rural Development and Land Reform, members of the Committee, and the Department officials and asked all attendees to introduce themselves except the Minister. She asked each province to state what its provincial legislature had decided.

Free State Provincial Legislature
Mr D Worth (Free State, DA) read the final mandate and informed the Committee that the Free State Provincial Legislature voted in favour of the Bill.

Gauteng Provincial Legislature
Ms B Mabe (Gauteng, ANC) read the final mandate and informed the Committee that the Gauteng Provincial Legislature supports the principle and detail of the Bill and therefore voted in its favour.

Kwazulu Natal Provincial Legislature
Ms N Magadla (Kwazulu Natal, ANC) read the final mandate and informed the Committee that Kwazulu Natal Provincial Legislature supported the Bill.

Limpopo Provincial Legislature
Mr M Makhubela (Limpopo, COPE) read the final mandate and informed the Committee that Limpopo Provincial Legislature, after a heated debate, voted in favour of the Bill.

Mpumalanga Provincial Legislature
The Chairperson read the final mandate and informed the Committee that the Mpumalanga Provincial Legislature voted in favour of the Bill.

North West Provincial Legislature
The Chairperson read the final mandate and informed the Committee that North West Provincial Legislature voted in favour of the Bill.
Northern Cape Provincial Legislature
The Chairperson read the final mandate and informed the Committee that the Northern Cape Provincial Legislature voted in favour of the Bill.

Western Cape Provincial Legislature
The Chairperson read the final mandate and informed the Committee that the Western Cape Provincial Legislature voted against the Bill.

The Chairperson informed the Committee that she had not received the Eastern Cape Provincial Legislature final mandate.

She informed the Committee that the Bill had passed because 7 provinces out of 9 supported the Bill. Only the Western Cape Provincial Legislature had opposed it and the position of the Eastern Cape was unclear. She thanked the permanent delegates for their commitment shown during the drafting process, in particular, attending the public meetings.

The Minister thanked members of the Committee for the work well done and stated that the Department was ready to assist municipalities to implement the Bill as it had allocated budget to do so.

The Chairperson thanked the Minister for his appreciation as well as the Department officials for their cooperation.

Consideration and adoption of Committee minutes
The Committee deferred the consideration outstanding minutes to the next meeting.
