Draft Municipal Fiscal Powers and Functions Amendment Bill

National Treasury has published the draft Municipal Fiscal Powers and Functions Amendment (MFPFA) Bill for public comment.

The draft Bill seeks to amend the Municipal Fiscal Powers and Functions Act, 2007 by, among others

- (a) inserting certain definitions;

(b) regulating the power of municipalities to levy development charges;

(c) setting out the permissible uses of income from development charges;

(d) providing for the basis of calculation of development charges;

(e) providing for municipal development charges policies, community participation and by-laws;

(f) providing for matters relating to the budgeting of and accounting for development charges;

(g) providing for transitional provisions relating to development charges; and

(h) empowering the Minister to make regulations for the effective implementation of matters relating to development charges

Comments on the draft Bill must be submitted to [email protected] or [email protected] by no later than Thursday, 30 April 2020. The original deadline for comments was 31 March 2020 and this was extended.

Parallel to the publication of the MFPFA Bill for public comments, National Treasury will also undertake national and provincial workshops to provide technical clarity on the provisions of the Bill. The proposed schedule of the workshops for each province will be communicated in due course.
