Revised draft of Road Accident Benefit Scheme Bill

The Department of Transport invites you to submit written comments on a revised draft of the Road Accident Benefit Scheme Bill.

The draft Bill replaces proposed new legislation released in February 2013 for comment with the aim of implementing government's 2011 policy on road accident benefits. Once in force, it will introduce a set of defined benefits on a no-fault basis ‒ also excluding certain persons from civil liability in respect of bodily injuries or death caused by or arising from road accidents.

The draft Bill provides for the appointment of an administrator as a juristic person reporting to a board and financed from a road accident benefit scheme levy in terms of the 1964 Customs and Excise Act. It is envisaged that all administrative functions relating to claims made under the 1996 Road Accident Fund Act would be funded from monies appropriated by Parliament. Provision is made for transitional arrangements regarding the Board, staff, assets, rights and obligations of the Road Accident Fund.

Any interested persons are requested to submit written comments in connection with the draft Road Accident Benefit Scheme Bill, 2014, within 60 days from the date of publication of this notice in the Government Gazette.
